. RESOLUTION NO. OL-87-016
A RESOLUTION OF THE OLIVENHAIN
COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW
PERMIT FOR PROPERTY OF THE
NORTHEAST QUARTER OF SECTION 8, TOWNSHIP 13 SOUTH,
RANGE 3 WEST, SAN BERNARDINO MERIDIAN,
COUNTY OF SAN DIEGO, CITY OF ENCINITAS
WHEREAS, Shea Homes, Inc. applied for a Design Review permit
for 71 single family residences on 2 acre lots as per section
23.08.030, A, of the Design Review Ordinance of the City of
Encinitas;
WHEREAS, public hearings were conducted on the application
by the Olivenhain community Advisory Board on September 8, and
September 22, 1987, and all persons desiring to be heard were
heard; and

WHEREAS, evidence was submitted and considered to include
without limitation:
a. site plan submitted by the applicant;
b. written information submitted with the application;
c. Oral testimony from staff, applicant, and public made a
part of the record at said public hearing;
d. CAB staff report (87-033-DR) dated September 22, 1987
which is on file in the office of Planning and community
Development; and
e. Additional written documentation.
NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community
Advisory Board of the City of Encinitas that the Design Review
permit for 87-033-DR for 71 single family dwelling units is hereby
approved subject to the following findings:

A. That the proposed project is in conformance with the
intent of section 23.08.72;
B. That the proposed project is in conformance with the
intent of section 23.08.74;
C. That the proposed project is in conformance with the
intent of section 23.08.76;
D. That the proposed project is in conformance with the
intent of section 23.08.077;
E. That the proposed paroject is in conformance with the
intent of section 23.08.79.
BE IT FURTHER RESOLVED, that the Design Review Permit is
hereby approved subject to the following conditions:
1. That optional perimeter fencing be APPROVED on the north,
south, east and west property lines of the entire
subdivision in a natural color rail fencing; that fencing
be deleted on individual property lines except on the
. three model home lots; and that all pilasters be deleted.
2. That the proposed horse trails be APPROVED subject to
City acceptance of an easement or offer of dedication,
with the addition of a trail on the entire east property
line from Bummann Road south to be improved in accordance
with City of Encinitas standards and to the satisfaction
of the City Engineer.
3. That the 3 floor plans and accompanying elevations be
APPROVED as submitted and reviewed on the site plans
dated approved September 22, 1987. The applicant may
submit additional floor plans or elevations for review
by CAB if he feels the need for more variation in the
future.
4. That the design, colors, and materials, be APPROVED for
the 68 lots and the 3 models as submitted with natural
rail fences on the 3 model home property lines; and that
the model home sites be reinspected by staff at the time
the models are returned to production homes to verify
conformance with the approved grading plan.

5. That Grading Plan #1, dated July 21, 1987, be approved
for lots 2 & 3, 6-12, 14-28, 36-38, 40-64, 66 and 68.
That amendments to grading Plan #1 be approved as shown
on grading and site Plan #2 dated June 25, 1987, and
documented as follows:
a) Exhibit A: Changes to the grading for lots 1, 4,
and 5.
b) Exhibit B: Changes to the grading for lots 13,65,
69, 70 and 71.
c) Bridges proposed for lots 33, 34, 35 and 39.
d) site Plan #3 and Grading Plan #3 approved for lots
29-33.
e) 3 Model Home sites and grading. Plan approved as
submitted on Plan #4.

6. That the placement of the house on lot 7 be adjusted 20'
to 25' west as shown on Exhibit I submitted by Richard
Haeger.
7. That trees be removed from the area within 100' of the
Blinkey's property at 3537 Do9ve Hollow Road, and
replanted elsewhere on the site as appropriate.
8. That the equestrian trails with landscaping and rail
fences be approved as shown on the landscape plan (Plan
#5) revised september 11, 1987, subject to the City of
Encinitas acceptance of an easement, or acceptance of an
offer of dedication for the trails.
