8 A RESOLUTION OF THE
OLIVENHAIN COMMUNITY ADVISORY BOARD OF
THE CITY OF ENCINITAS
CONDITIONALLY APPROVING A TENTATIVE PARCEL MAP (TPM 18928)
FOR THE PROPERTY OF PARCEL 2 OF PARCEL MAP 1605
WHEREAS, a proposed Tentative Parcel Map application for a
division of a 1.09 acre lot into two parcels of .50 and .59 acres
for property of Parcel 2 of Parcel Map 1605, was submitted by
James C. Statser for the purpose of constructing 2 single family
residential units on 1/2 acre lots; and
WHEREAS, a public hearing was conducted by the Olivenhain
Community Advisory Board on the referenced request in the form
and manner required by law on July 21, 1987.
8 NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community
Advisory Board of the City of Encinitas, that the proposed
Tentative Parcel Map for Parcel 2 of Parcel Map 1605, is hereby
approved, and that approval is based upon the following findings:
A. That the proposed map is consistent with all elements of the
ci ty of Encini tas General Plan and with the land use
designation of the General Plan since it proposes a single
family residential development density of .5 dwelling units
per acre in the RR2 zone.
B. That the design and improvements of the proposed subdivision
are consistent with all elements of the Encinitas General
Plan and comply with the provisions of the State Subdivision
Map Act and the City of Encinitas subdivision Ordinance.
C. That the site is physically suitable for the type of
development.
D. That the site is physically suitable for the proposed
residential density of devèlopment and the design provides
sufficient lot area and street access for proper development.

E. That the design of the subdivision and the proposed
8 improvements are not likely to cause substantial
environmental damage or substantially and avoidably injure
fish or wildlife or their habitat and a Negative Declaration
was recommended on June 9, 1987.
F. That the design of the subdivision and type of improvements
are not likely to cause serious public health problems,
since adequate water supply and sewage disposal servlce are
available.
G. That the design of the subdivision and the type of
improvements will not conflict with easements, acquired by
the public at large, for access through or use of, property
within the proposed subdivision.
NOW THEREFORE, BE IT RESOLVED that Tentative Parcel Map
18928 and the associated Negative Declaration of Environmental
Impact are hereby approved subject to the following conditions:
THE FOLLOWING CONDITIONS SHALL BE COMPLIED WITH BEFORE A PARCEL
MAP IS APPROVED BY THE OLIVENHAIN COMMUNITY ADVISORY BOARD AND
8 FILED WITH THE COUNTY RECORDER OF SAN DIEGO COUNTY.
THE PARCEL MAP SHALL SHOW AN ACCURATE AND DETAILED VICINITY MAP,
INCLUDING DISTANCES.
1. ROAD DEDICATIONS AND IMPROVEMENT PLANS (DPW)
A. "E" Street may be vacated to within twenty-eight (28')
of centerline (optional).
B. Any offer of dedication or grant of right-of-way shall
be free of all encumbrances or subordinated at the time
of recordation of the parcel map.
2. COUNTY SERVICE AREA/ROAD MAINTENANCE/COVENANTS/DEVELOPMENT
FEES (DPW)
A. The subdivider shall deposit $1,400.00 into the
Community Services Trust Fund for the improvement of
Lone Jack Road. (This would be the requirement if the
proj ect was still in the unincorporated area of the
County). This item may be deleted at the discretion of
8 the Director of Public Works.

B. The developer shall pay for one (1) stop sign for a
four-way stop at Lone Jack Road and Rancho Santa Fe
8 Road if approved by the Traffic Advisory Committee
prior to recordation of the Parcel Map for TPM 18928.
3. FACILITY/UTILITY ARRANGEMENTS (DPW)
A. The subdivider shall comply with Section 66436 of the
Government Code by furnishing to the City Department of
Publ ic Works a certification from each public utility
and each public entity owning easements within the
proposed subdivision stating that: (a) they have
received from the subdivider a copy of the proposed
final map; (b) they object or do not object to the
filing of the map without their signature.
B. Plans and specifications for the installation of a
sewer system serving each lot must be approved by the
Director of the Department of Public Works. The
subdivider shall dedicate all necessary easements for
that portion of the sewer system which is to be public
sewer.
C. The subdivider shall cause all of the land within this
subdivision to be annexed to the Cardiff Sanitation
District.
8 D. A commitment to serve each parcel must be obtained
from the Cardiff Sanitation District.
E. No sewer commitment shall be issued until all
conditions in this Resolution of Approval have been
satisfied, the final map or parcel map, grading plan
and improvement plan has been approved by the
Department of Public Works and all fees and deposits
paid and improvement security posted.
THE FOLLOWING PUBLIC IMPROVEMENTS MUST BE COMPLETED, OR A SECURED
AGREEMENT EXECUTED, PRIOR TO RECORDING A PARCEL MAP. THE
AGREEMENT REQUIRES POSTING SECURITY IN FORM OF A CASH DEPOSIT,
IRREVOCABLE LETTER OF CREDIT OR AN INSTRUMENT OF CREDIT VALUED
AT, OR MORE THAN THE ESTIMATE IMPROVEMENT COST. IT ALSO REQUIRES
IMPROVEMENTS BE COMPLETED WITHIN 24 MONTHS OF RECORDING THE
PARCEL MAP, AND PRIOR TO GRANTING OF ANY APPROVAL OF DEVELOPMENT
OF ANY PARCEL CREATED BY THIS MAP, EXCEPT BUILDING AND ASSOCIATED
PERMITS CAN BE ISSUED REQUIRING COMPLETION OF PUBLIC IMPROVEMENTS
PRIOR TO OCCUPANCY OF THE BUILDING.
4. PUBLIC ROAD IMPROVEMENTS
A. "E" Street along the land division frontage (onsi te)
shall be improved to a paved width of 20' with A.C.
8 paving over approved base and A.C. dike on both sides.
The right-of-way shall be 56'.

B. "E" street (offsite) from the northerly boundary of the
land division to Lone Jack Road shall be improved to a
8 paved width of 20 feet with A.C. paving over approved
base and A. C. dike on both sides. The right-of-way
shall be 56'.
C. All new and existing utility distribution facilities,
including cable television lines, shall be placed
underground. All utility installations shall be
completed before surfacing the streets and installing
concrete curb, gutters and sidewalks.
D. Portland cement concrete cross gutters shall be
constructed where water crosses the roadways.
E. The exact depth of improved base material shall be used
on soil tests approved by the Director, Department of
Public Works.
F. Install all street name signs.
G. Plans for public road improvements shall be prepared by
a registered civil engineer and submitted to the
Director, Public Works. The following items shall also
apply:
1. street alignment and grade, including the change
of any existing or proposed street alignment and
8 grade, shall be as required by the Director,
Department of Public Works.
2. Sight distance at all intersections shall conform
to the intersectional sight distance criteria as
provided by the American Association of State
Highway and Transportation Officials in the
publication "Geometric Design of Highways and
Streets -- 1984" or its latest revision.
3. Plans and specifications for the improvement of
all streets, right-of-way, drainage easements and
all culverts, drainage channels and all private
easements shall meet with the approval of the
Director, Department of Public Works.
H. The City Engineer will assign a road survey number to
the offsite public roads being created. The developer
shall file with the County Recorder a Record of Survey,
after approval of the City Engineer} showing the
centerline monumentation set, right-of-way lines and
ties to adjacent property.
THE FOLLOWING PUBLIC IMPROVEMENTS MUST BE COMPLETED OR A SECURED
AGREEMENT EXECUTED, PRIOR TO RECORDING A PARCEL MAP. THE
8 AGREEMENT REQUIRES POSTING OF SECURITY IN FORM OF A CASH DEPOSIT,

REQUIRES IMPROVEMENTS BE COMPLETED WITHIN 24 MONTHS FROM THE DATE
- OF RECORDING THE PARCEL MAP OR PRIOR TO THE ISSUANCE OF A PERMIT
OR OTHER GRANT OF APPROVAL FOR THE DEVELOPMENT OF A PARCEL
CREATED BY THIS MAP, WHICHEVER OCCURS FIRST UNLESS OTHERWISE
NOTED.
5. FLOODING/DRAINAGE IMPROVEMENTS (DPW)
A. The subdivider shall pay those flood/drainage fees as
adopted by the City of Encinitas City Council.
6. FACILITY/UTILITY IMPROVEMENT
A. The subdivider shall install the sewer system and
dedicate the portion of the sewer system which is to be
public sewer as shown on the approved plans and
specifications.
NOTE: within ten (10) calendar days after the date of final
approval, these findings and conditions may be appealed
in accordance with Section 81. 615 of the Subdivision
Ordinance to the Planning Commission. No parcel map
shall be approved, no grading permit issued and no
building permits shall be issued pursuant to said
tentative subdivision map until after the expiration of
the tenth (10th) calendar day following final approval
of these conditions, or if an appeal is taken, until
8 the Planning Commission has acted.
THE APPROVAL OF THIS TENTATIVE PARCEL MAP EXPIRES ON JULY 21,
1990, AT 5:00 P.M. UNLESS, PRIOR TO THAT DATE} A REQUEST FOR A
TIME EXTENSION HAS BEEN FILED AS PROVIDED BY SECTION 24.50.130 OF
THE CITY SUBDIVISION ORDINANCE.
