1987-08 RESOLUTION NO. OL87-008 8 A RESOLUTION OF THE OLIVENHAIN COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW PERMIT FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF 11TH STREET AND RANCHO SANTA FE ROAD, OLIVENHAIN WHEREAS, Boczanowksi Inc. applied for a Design Review permit for 35 single family residences on 35 half-acre lots as per Section 23.08.030, A, of the Design Review Ordinance of the City of Encinitas; WHEREAS, a public hearing was conducted on the application by the Olivenhain Community Advisory Board on July 7, 1987, and all persons desiring to be heard were heard; and WHEREAS, evidence was submitted and considered to include without limitation: 8 a. Site plan submitted by the applicant; b. written information submitted with the application; c. Oral testimony from staff, applicant, and public made a part of the record at said public hearing; d. CAB staff report dated July 7, 1987, which is incorporated by this reference as though fully setforth herein; and e. Additional written documentation. NOW THEREFORE, BE IT RESOLVED by the Olivenhain Community Advisory Board of the City of Encinitas that the Design Review permit is hereby approved subject to the following findings: 1. That the proposed proj ect is in conformance with the intent of Section 23.08.72; 2. That the proposed proj ect is in conformance with the 8 intent of Section 23.08.74; DL/hz/CAB4-0L87-005 (9-8-87-1) 3. That the proposed proj ect is in conformance with the intent of Section 23.08.76; 8 4. That the proposed project is in conformance with the intent of section 23.08.77; and 5. That the proposed proj ect is in conformance with the intent of Section 23.08.79; BE IT FURTHER RESOLVED, that the Design Review Permit is hereby approved subject to the following conditions: 1. Delete Section 2.07 of the CC & R's. 2. Change the elevation of lot 35 to be compatible with the adjacent Olive Crest Project. 3. Homes with wood siding must continue the wood siding on all sides of the structure. 4. Adjust the front yard setbacks on lots 30, 31, and 33 to provide variation, as follows: a. Move structure on lot 30 south 5'; b. Move structure on lot 31 north 15'; and 8 c. Move structure on lot 33 north 15'.
