RESOLUTION NO. 01-87-005
8 A RESOLUTION OF THE OLIVENHAIN COMMUNITY ADVISORY BOARD
OF THE CITY OF ENCINITAS
APPROVING A RESOLUTION AMENDMENT TO TPM 18760
FOR 3083 DUSTY TRAIL
WHEREAS, a Resolution Amendment for TPM 18760 to require
that a fire hydrant be provided was filed by Douglas Cox at 3083
Dusty Trail;
WHEREAS, a public hearing was conducted by the Olivenhain
CAB on the Resolution Amendment June 16, 1987, as required by
law; and
WHEREAS, the CAB considered:
1. Application TPM 18760-RA;
2. Staff report dated June 16, 1987;
3. Oral information submitted at hearing; and
4. written information submitted at hearing.
8 NOW THEREFORE, BE IT RESOLVED that the Olivenhain Community
Advisory Board of the City of Encinitas approves the Resolution
Amendment (TPM 18760-RA) with the following conditions:
1. That Condition J of the resolution approving TPM 18760 be
amended to read as follows:
"J. FIRE PROTECTION
This property must annex to the Encinitas Fire
Protection District and a letter of commitment from the
District must be provided to the Director of Public
Works prior to recordation of the Parcel Map.
The developer shall provide a letter from the Encinitas
Fire Protection District stating that the required cost
recovery fees have been paid to the satisfaction of
said District.
A fire hydrant together with an adequate water supply
shall be provided to the satisfaction of the Encinitas
Fire Protection District, approximately 213 feet south
8 of the southerly boundary of the land division along
Wishbone Way.

2. That Condition L, 6, paragraph 2 be amended to include
Condition J as follows:
8 "Conditions F-1, H-2, I-1, and J may be complied with
either prior to or after the approval of a Parcel Map.

PASSED AND ADOPTED this l6th day of June, 1987, by the
following vote, to wit:
AYES: Board Members Susan Bobbitt, Jeff Fernald, Michelle
Tutoli, and Linda Trujillo.
NAYS: None
ABSENT: Board Member Du Vivier
ABSTAIN: None
