8 A RESOLUTION OF THE OLIVENHAIN COMMUNITY ADVISORY BOARD
OF THE CITY OF ENCINITAS RECOMMENDING
THAT THE PLANNING COMMISSION APPROVE
THE RESOLUTION AMENDMENT TO TM 4436
FOR PROPERTY OF BLOCK 86 COLONY OLIVENHAIN
COUNTY OF SAN DIEGO, CALIFORNIA, MAP 326
WHEREAS, an application for a Resolution Amendment for TM
4436 to mod~fy the wording of condition C-7-j on the resolution
of approval was filed by Arthur Beland;
WHEREAS, a public hear ing was conducted by the Olivenhain
Community Advisory Board on the Resolution Amendment on June 16,
1987, as required by law; and
WHEREAS, the Community Advisory Board considered:
1. Application TM 4436-RA;
2. Staff report dated June 16, 1987;
3. Oral information submitted at hearing; and
4. Written information submitted at hearing.
8 NOW THEREFORE, BE IT RESOLVED that the Olivenhain Community
Advisory Board of the City of Encinitas recommends that the
Planning Commission approve Resolution Amendment TM 4436-RA, and
that approval is based on the following findings:
A. That the modification of the wording on condition C-7-j of
the Resolution of Approval for TM 4436 is consistent with
the intent of said condition; and
B. That a negative declaration of environmental impact, Log
#83-8-99 was recommended on June 2, 1987.
BE IT FURTHER RESOLVED, that the Olivenhain Community
Advisory Board recommends that the Planning Commission approve
Resolution Amendment TM 4436-RA and the associated Negative
Declaration of Environmental Impact subject to the following
condition:

condition:
l. That condition C-7-j of the Resolution of Approval be
rewritten as follows: "Vacate California street and West
l4th street offsite and scarify California street to the
satisfaction of the Director of Public Works and provide
security satisfactory to the Director for the roadway
scarification. This vacation will require the improvement
and acceptance of Claudius street and West 14th street prior
to final vacation and scarification of California street.
The onsite portion of West l4th street and California street
will occur on the final map."
