RESOLUTION NO. OL-2-87
8 A RESOLUTION OF THE OLIVENHAIN CAB
RECOMMENDING THAT THE CITY CeUNCIL OF THE CITY OF ENCINITAS
APPROVE A SUMMARY VACATION OF A UTILITY EASEMENT RESERVATION
ON C STREET BETWEEN 11TH STREET & 12TH STREET & THE NORTHERLY
10' OF 1lTH STREET WEST OF RANCHO SANTA FE ROAD, ENCINITAS
WHEREAS, a request for vacation of a utility easement has been
submitted by Boczanowski, Inc.;
WHEREAS, a public hearing was conducted on the application on
May 19, 1987, as required by law and all persons requesting to be
heard were heard; and
WHEREAS, the CAB considered:
1. Application VAC 86-025;
2. Staff report dated May 19, 1987;
3. Oral information submitted at hearing; and
8 4. Written information submitted at hearing.
NOW THEREFORE, BE IT RESOLVED that the Board recommends that
the City Council of the City of Encinitas approve a summary
vacation of utility easements on C Street between 11th Street &
12th Street & the northerly 10' of 11th Street west of Rancho Santa
Fe Road, Encinitas, in accordance with the following findings:
1. The project as proposed is consistent with the City of
Encinitas General Plan since the reservation of utility
easements is not addressed.
2. The project as proposed complys with the California
Environmental Quality Act and Stat and County Guidelines
since it is exempt from environmental review.
3. The utility easement reservation cannot be used as a non-
motorized transportation facility.
8 4. There is no present or prospective public use for the
utility easement reservation.
