A. Approval of Minutes from meeting of: September 26, 1991.
Motion: Board Member Birnbaum - To accept and adopt the
Consent Calendar with the following revisions:
1. Item 7B, Case No. 91-162V(Winn) is moved to the
8 consent calendar and continued to the November 21,
1991 meeting of the Old Encinitas CAB to allow time
for the applicant to correct the 300 ft. notice
package.

light standards (27 ft. pole with 3 ft.
base) at the previously approved north
parking lot.
ENVIRONMENTAL
STATUS: Negative Declaration certified for 6-
Phase Master Plan.
NOTE: The applicant has withdrawn this application and
8 will comply with the 18 ft. height limit for parking lot
light standards.

DESCRIPTION: Re-Submittal of variance request to
encroach 10 ft. into the required 20 ft.
rear yard setback for a proposed 2 story
duplex in the R-15 Zone.
ENVIRONMENTAL
STATUS: Exempt per Section 15303 of CEQA
NOTE: This item was moved to the consent calendar and
subsequently continued to the November 21, 1991 meeting
of the Old Encinitas CAB to allow time for the applicant
to re-notice all property owners within 300 ft. of the
site.
C. CASE NUMBER: 91-168 DR
APPLICANT: Linda Mettling
LOCATION: 707 Third street
8 DESCRIPTION: Design Review for the remodel of an
existing single family home with addition
of a 2nd dwelling unit.
ENVIRONMENTAL
STATUS: Exempt per Section 15301(e) of CEQA
Motion: Board Member Steyaert - to cotinue Case No. 91-
168 DR to the November 21, 1991 meeting of the Old
Encinitas CAB to allow time for the applicant to address
the following issues:
1. Lot coverage shall be reduced to a maximum 40% of
lot size, or 2,000 sq. ft.
2. The roof structure of the south elevation shall be
redesigned with some type of hipped roof to "break
Up" it's linear appearance.
3. The applicant shall retain a licensed Landscape
Architect or Arborist to evaluate the location of
the proposed carport with second unit above to
ensure that the existing Torrey pine tree will not
be negatively impacted. In addition, a program
shall be provided which will protect the tree
8 during building construction.
4. The site plan shall be revised to more clearly
indicate the location of the buildings, existing

8 and proposed paving and landscaping. This includes
identifying the building footprint with a heavier
line and highlighting the sidewalks to better
differentiate the paving from the landscaping
areas.
5. The Landscape and site plans shall be revised as
follows:
A. The planting strip between the two driveways
shall be increased to at least a width of 3
ft. to accommodate a 15 gallon tree (tree
variety was not specified but it must be
drought tolerant).
B. Two additional 15 gallon trees shall be
planted in the planting areas in the northeast
and southeast sections of the lot (tree
variety not specified).
c. The proposed 5 ft. wide sidewalks in each of
the side yards shall be reduced in width by at
least 1 ft. to accommodate a 1 ft. planting
strip along each property line. These
planting strips shall be planted with
Bougainvillea or another variety of climbing
8 plant.
D. Another 15 gallon tree shall be planted in the
south side yard west of the existing sidewalk
(if possible).
E. Two 24-inch box street trees shall be planted
in the Third street parkway of a variety
acceptable tot he Director of Public Works.
F. The applicant shall evaluate the landscape
plan to determine whether additional shrubs
are necessary in the planting strips,
particularly in the rear yard. In addition,
all shrubs shall be a minimum 5 gallon size.
