CASE NUMBER: 92-026 DR - CAB II Hearing APPLICANT: Dexter Winn LOCATION: 212 Third street DESCRIPTION: Design Review for a proposed duplex ENVIRONMENTAL STATUS: Exempt per Section 15303 of CEQA Motion: Board Member Steyaert - To continue Case No. 92-026 DR to the May 11, 1992 meeting of the Old Encinitas CAB to allow time for the applicant to address the following issues: 1. Address the landscape issues discussed at the CAB I hearing. 2. Specify the depth of the architectural projections shown on the building elevation plans. 3. PUBLIC HEARINGS A. CASE NUMBER: 91-039 DR APPLICANT: North County Transit District LOCATION: West side of Vulcan Avenue from Encinitas Blvd. to south of E. Street (may extend to F Street for parking.) DESCRIPTION: Proposal to construct a commuter rail/bus transit station with parking, landscaping, restroom and related facilities. ENVIRONMENTAL STATUS: North County Transit District, as lead agency, has certified an Environmental Impact Report. MN/03/CAB26-3105wp51 (4/30/92-2)5 Motion: Board Member Birnbaum - To deny Case 91-039 DR with the findings as follows: 1. with regard to Finding 23.08.074A, the proposed project design fails to take into account the dimensional constraints of the site in providing design screening and treatment, and this regulatory conclusion applies. 2. with regard to Findings 23.08.074G and H, with the addition of traffic and bus trips in the project area and the reduction of street improvement standards, the Board is of the opinion that the project has not minim~zed the potential for traffic conflicts, and that an adverse effect on traffic conditions on the adjacent streets would result. 3. with regard to Findings 23.08.076E and F, the inability of the project as currently proposed to provide landscaping or other buffering along the eastern edge of the proposed bus facility is determined by the Board to constitute inharmonious and functionally incompatible design in relation to location of project facilities and use of project open space. The project as proposed would adversely affect the quality of noise environment on adjacent properties by increasing noise in an area already subject to adverse noise levels, without providing the perceived mitigation of visual buffering. 4. with regard to Finding 23.08.072C, the Board concludes that air emissions immediately adjacent to the project in public and pedestrian corridors constitutes an adverse health impacti and that the above findings establish an adverse effect on the general welfare of the community.
