Board Member Birnbaum pulled the Minutes of July 12, 1990 from the consent calendar. 6. PUBLIC HEARINGS CONTINUED . A. CASE NUMBER: 88-178 MUP/EIA APPLICANT: Mobil oil LOCATION: 310 Encinitas Boulevard 8 DESCRIPTION: Major Use Permit for a car wash, convenience store, and gas pump islands on site presently containing a service station (to be removed). Motion: Board Member Birnbaum - To recommend approval of Case No. 88-178 MUP/EIA with staff recommendations and the additional conditions: (1) The number of shrub plantings along both street frontages and along the easterly boundary to approximately the location of the trash enclosure shall be doubled (Le. one type/size planting for each shrub indicated on the landscape plan dated received by the City on July 17, 1990); (2) Staff shall notice the Planning Commission hearing to include the applicantls intention to conduct a business use open more than 20 hours per day and that beer/wine off-sale (type 20 license) will be sold; (3) Staff shall include a condition of approval prohibiting the operation of the car wash during the hours of 11:00 p.m. to 5:30 a.m. daily. 8 Second: Board Member Tobias Vote: Ayes - Tobias, Steyaert, Birnbaum, Townsend Nays - None Absent - Rotsheck Abstain - None B. ENVIRONMENTAL STATUS: Exempt per Section 15311(a) of CEQA. NOTE: The Board unanimously agreed with the applicantls request to continue off Calendar Case No. 90-087V without prejudice. 8 c. CASE NUMBER: 90-063 TPM APPLICANT: Westlake Group I MN/mam/CAB22-1933wp5 (8/6/90-3) 5 I 8 LOCATION: 680 Westlake DESCRIPTION: Four lot subdivision of a parcel presently containing one single family home. ENVIRONMENTAL STATUS: Exempt Section 15315 of CEQA. Motion: Board Member Birnbaum - To approve Case No. 90-063 TPM with staff recommendations and the additional conditions: 1. Specific Condition IA may be waived prior to Final Parcel Map approval if the subdivider can verify no existing kennel uses in the vicinity of the subj ect property to the satisfaction of the Director of Planning and Community Development. 2. The subdivider and future property owners shall retain the mature vegetation along Westlake to the fullest extent possible while still providing safe access to Lots 2, 3 and 4 to the satisfaction of the Directors of Public Works and Planning and Community Development. 3. Specific Condition IE shall be re-written as follows: Prior to building permit issuance, the home proposed for Lot 1 created by this permit shall obtain a Design Review Permit, . .. 8 4. Access to driveways and garages for Lots 2, 3 and 4 shall be taken from the 24 foot wide easement road. 5. The Final Parcel Map shall indicate an adjusted easterly sideyard lot line for Lot 1 which extends the line as far to the northeast as possible where it intersects the Westlake Street frontage. The adjusted lot line shall not create a situation which conflicts with any Municipal Code Standard or Development Regulations to the satisfaction of the Directors of Planning and Community Development and Public Works. ENVIRONMENTAL STATUS: Exempt per Section 15305(a) of CEQA. Motion: Board Member Steyaert - To approve Case No. 90-100V with staff recommendations and the additional condition that the wall fronting on Requeza be screened with landscaping on its exterior side. Second: Board Member Tobias Vote: Ayes - Tobias, steyaert, Birnbaum, Rotsheck, Townsend Nays - None Absent - None Abstain - None B. CASE NUMBER: 90-147 V APPLICANT: Mulvey LOCATION: Northwest corner of Cornish and "H" Street DESCRIPTION: Variance for proposed single family home to encroach within the front, side and 8 rear setbacks and to allow tandem parking space to encroach within front setback. ENVIRONMENTAL STATUS: Exempt per Section 15303 of CEQA. Motion: Board Member Tobias - To continue Case No. 90-147V to the August 16, 1990 meeting of the Old Encinitas CAB to allow time for the applicant to redesign the project and address the following Boardls concerns: 1. Redesign the building to eliminate its encroachment into the 20 ft. front yard setback to preserve the H street view corridor.
