A RESOLUTION OF THE OLD ENCINITAS COMMUNITY ADVISORY BOARD
APPROVING A DESIGN REVIEW PERMIT FOR THE PROPOSED REMODELING OF
AN EXISTING 13 UNIT CONDOMINIUM COMPLEX LOCATED AT 916 - 922
SEALANE DRIVE
(CASE NUMBER 95-071 DR)
WHEREAS, a request for consideration of a design review permit
was filed by the Encinitas Bluffs Homeowners Association to allow
an exterior remodel of an existing condominium complex, in
accordance with Chapter 23.08 of the City of Encinitas Municipal
Code, for the property located in the R-25 zone at 916 - 922
Sealane Drive, legally described as:
Lots 1 through 13, inclusive, of County of San Diego Tract No.
4008, according to the Map thereof No. 10757, filed in the
Office of County Recorder of San Diego county; and
WHEREAS, a public hearing was conducted on the application on
April 20, 1995 by the Old Encinitas community Advisory Board; and
WHEREAS, the Board considered:
1. The April 20, 1995 staff report to the Community Advisory
Board with attachments;
2. The application and project plans consisting of seven
sheets including site plan, floor plans, and elevations,
all dated received March 28, 1995;
3. Oral evidence submitted at the hearing;
4. written evidence submitted at the hearing; and
WHEREAS, the Old Encinitas Community Advisory Board made the
following findings pursuant to section 23.08.070 of the Encinitas
Municipal Code:

NOW, THEREFORE, BE IT RESOLVED that the Old Encinitas
Community Advisory Board of the City of Encinitas hereby approves
application 95-071 DR subject to the following conditions:

Applicant: Encinitas Bluffs Homeowners Assoc.
Findinqs: (Code Section, Factual circumstances, Reasoning,
Conclusion
a. The project desiqn is consistent with the General Plan, a
specific Plan, and the provisions of this Code.
Facts: Multi-family attached residential development is
allowed by right in the R-25 zone in the General Plan and
in accordance with Chapter 30.09 (zone definitions) of
the Municipal Code. The proj ect was approved by the
County of San Diego (Case 41 P79-81W) and, since this
proposal involves only exterior design modifications, no
aspect of the project is being changed relative to the
technical development standards set forth in the Municpal
Code. Design review for this type of remodel of a multi-
family residential development is required under Chapter
23.08 of the Municipal Code.
Conclusion: with approval of the required Design Review
Permit, this project is thus in full compliance with all
Municipal Code and General Plan provisions.
b. The project desiqn is substantially consistent with the
Desiqn Review Guidelines.
Discussion: In terms of site design (Municipal Code
section 23.08.074), the project involves the remodeling
of an existing building with negligible changes to the
existing topography of the site and no changes will be
made which would effect views through, to, or from the
subject property. Parking is provided in a basement
garage taking access from Sealane Dr.
In terms of building design (Municipal Code section
23.08.076), the building is being remodeled for purposes
of restoring the exterior of the buildings and updating
their appearance. The present exterior treatment of the
building consists of a beige-colored horizontal wood
siding with darker beige/brown fascia, trim, railings,
and accent features. The chimneys are wood shake sided.
This application involves remodeling of the exterior of
the building by (1) recoating the walls with an ivory-
colored stucco exterior with a slightly darker gray
stucco finish for fascia, pillar and chimney caps, as
well as for horizontal projecting wall elements below
balconies; (2) installation of dark green balcony, gate,

and entrance railings (replacing the tubular railings
presently used) as well as dark green horizontal beams
above the windows; and (3) installation of lighter green
chimney caps and latticework features above the windows
underneath the pitched, proj ecting roof fascia. The
complex is proposed to be re-roofed with a thick asphalt
shingle which features subtle variations in light gray
coloration. This exterior treatment does exercise
constraint in the variation of exterior materials and
colors and is carried out consistently among all
elevations (all buildings will receive the same exterior
treatment illustrated in the plans for the "922 Sealane"
building), as is encouraged in the Design Review
Guidelines.
with regard to landscape design (23.08.077) the project
site was landscaped approximately 10 years ago and
contains mature landscaping which is not proposed to be
changed through this applicaiton.
Conclusion: It is the opinion of the Board that the
proposal is in substantial compliance with the City's
adopted design criteria.
c. The project would not adversely affect the health,
safety, or qeneral welfare of the community.
Discussion: The project has existed in its present
location since 1984 and no aspect of the proposed
exterior modifications would result in any impacts to
public health, safety, or general welfare.
Conclusion: The Board finds that this project will not
adversely affect the health, safety, or general welfare
of the community.
d. The project would not cause the surroundinq neiqhborhood
to depreciate materially in appearance or value.
Conclusion: The Board finds that the proposed development
will upgrade the appearance of the condominium complex
and thus will cause no material depreciation to the
appearance or value of the surrounding neighborhood.

Applicant: Encinitas Bluffs Homeowners Assn.
1. GENERAL CONDITIONS
A. This approval will expire in two years on April 20,1997,
at 5:00 p.m. unless the conditions have been met, or an
extension has been approved by the Authorized 8gency.
B. This approval may be appealed to the authorized agency
within 15 calendar days from the date of this approval.
C. Approval of this request shall not waive compliance with
any sections of the Municipal Code and all other
applicable City Ordinances in effect at the time of
Building Permit issuance unless specifically waived
herein.
D. Permits from other agencies will be required as follows:
California Coastal Commission.
E. Project is approved as evidenced by the project plans
consisting of 7 pages, including site/landscaping plan,
floor plans, and elevations dated received by the City of
Encinitas on March 28, 1995, and signed by a City
Official as approved by the Old Encinitas Community
Advisory Board on April 20,1995 and shall not be altered
without Community Development Department review and
approval.
G. Any change to the natural drainage or concentration of
drainage shall be adequately handled and shall not impact
adjacent properties.
H. Prior to permit issuance, the applicant shall execute an
agreement to join the City's established Geologic Hazard
Abatement District (GHAD) to the satisfaction of the
Engineering Services Department.
APPLICANT SHALL CONTACT THE ENCINITAS FIRE PROTECTION DISTRICT
REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS:
2. FIRE
RECORDATION: Prior to final development approval, the
applicant shall submit to the Community Development
Department a letter from the Fire District stating that

all development impact, plan check and/or cost recovery
fees have been paid or secured to the satisfaction of the
Fire District.
