Approval of Minutes: Regular Meeting of September 21, 1995. Contact Person: Senior Planner Curriden. 2. Scheduled review of previously issued minor use penn it and Coastal Development Pennit for operation of a tattoo studio in the GC zone. CASE NUMBER: 95-019 MIN/CDP; APPLICANT: Neil Kotter; LOCATION: 454 N. Highway 101; ENVIRONMENTAL STATUS: Categorically exempt under Section 15061 of the State CEQA Guidelines. Contact Person: Senior Planner Curriden. 8 STAFF RECOMMENDATION: Adopt the Consent Calendar approving the Minutes of September 21, 1995 regular meeting and affirming the Board's previous approval of Case #95- 019 MIN/CDP along with issuing the associated Coastal Development Permit. 8 Motion: Board Member Birnbaum - To adopt consent calendar approving the Minutes of the September 21, 1995 regular meeting of the Old Encinitas CAB and affirming the Board's previous approval of Case 95-019 MINICDP along with issuing the associated Coastal Development Permit. Public hearing for a proposed Major Use Permit Modification, Coastal Development Permit, and Environmental Initial Assessment to allow for the addition of an assisted living residential facility, and administration building and coffee house with enclosed walkways to the existing Seacrest Village Residential Care and Skilled Nursing Facility. CASE NUMBER: 95-164 MUPM 0 DICD PIElA; APPLICANT: San Diego Hebrew Home; LOCATION: 211 Saxony Road; ENVIRONMENTAL STATUS: Recommended Negative Declaration pending certification. STAFF RECOMMENDATION: Disclose all additional information upon which the decision will be based, receive public testimony, and recommend that the Planning Commission adopt the draft resolution approving Case # 95-164 MUPMODICDPIEIA and certifying the associated Negative Declaration. Motion: Board Member Birnbaum - To recommend that the Planning Commission adopt the draft resolution approving Case # 95-164 MUPMOD/CDPIEIA and certifying the associated Negative Declaration in accordance with the findings and conditions presented by staff in the draft resolution. Public hearing for a variance, Design Review and Coastal Development Pennit request to allow construction of a new single-family residence on the coastal bluff in the R-8 zone. The variance is requested to allow the residence to encroach into the required 25 ft. ITont yard setback by 6 ft. for a total setback of 19 ft., and to encroach into the required 10ft. side yard setback by 5 ft. for a total setback of 5 ft. A Design Review pennit is requested to allow residence to exceed the standard 22 ft. height envelope by 6.5 ft. for a maximum height of 28.5 ft. and to allow a second story cantilevered deck to project 7 ft. into the standard 40 ft. coastal bluff setback. CASE NUMBER: 95-186 V /DR/CDP; APPLICANT: Stephen Borow; LOCATION: 120 Neptune; ENVIRONMENTAL STATUS: Exempt under Section 15303(a) of the California Environmental Quality Act (CEQA). STAFF RECOMMENDATION: Disclose all additional infonnation upon which the decision will be based, receive public testimony, and recommend that the Planning Commission adopt the draft resolution approving Case # 95-186 V/DR/CDP. Motion: Board Member Birnbaum - To recommend that the Planning Commission deny Case # 95-164 MUPMOD/CDPIEIA based upon findings that (1) Finding D(I) in Section 30.78.030 cannot be made since an alternative development strategy is available to construct a smaller home meeting the setback regulations for the zone established in the Municipal Code, and (2) that the requested Authority to Exceed the Standard Height Envelope also " should not be approved in accordance with Section 30.16.010 (b7d.) of the Municipal Code since the bulk and mass of the structure is incompatible with the surrounding area and exacerbates a "walled effect" of development along the west side of Neptune. Public hearing on Design Review and Coastal Development Pennit application for construction of a new approximately 2,400 sq. ft. office building in the D-CM-1 zone of the Downtown Encinitas Specific Plan. CASE NUMBER: 95-246 DR/CDP; APPLICANT: Lloyd and Associates; LOCATION: 1120 First St. ENVIRONMENTAL STATUS: Categorically exempt under Section 15301 (e2) of the State CEQA Guidelines. STAFF RECOMMENDATION: Disclose all additional infonnation upon which the decision will be based, receive public testimony, and adopt the draft resolution approving Case # 95-246 DR/CDP. .
