CLOSING AND ADOPTION OF THE CONSENT CALENDAR
1. Approval of Minutes: Regular Meeting of August 24, 1995.
Contact Person: Senior Planner Curriden.
2. Major use permit modification to allow two existing day care/preschool classrooms to remain in
operation on the site of an existing church complex for an additional five years, until September 7,
2000. CASE NUMBER: 95-223 MUPMOD/CDP; APPLICANT: Bethlehem Lutheran Church;
LOCATION: 925 Balour Drive; ENVIRONMENTAL STATUS: Exempt under Section 15301
of the California Environmental Quality Act (CEQA).
STAFF RECOMMENDATION: Adopt the Consent Calendar approving the Minutes of August
24,1995
8 Motion: Board Member Davis - To adopt consent calendar approving the Minutes of the
August 24, 1995 regular meeting of the Old Encinitas CAB and recommending Planning
Commission approval of Case 95-223 MUPMOD/CDP.

3. Continued Public Hearing for a Design Review permit to allow exterior modifications to a portion
of the existing Moonlight Plaza commercial center located in Downtown Encinitas Specific Plan
area, along with a minor use permit to allow eating and drinking establishments within Moonlight
8 Plaza Phase I to have on-site sale and consumption of alcoholic beverages. CASE NUMBER: 95-
040 DR/MIN/CDP; APPLICANT: Jourdain LOCATION: 345 First S1. ENVIRONMENTAL
STATUS: Exempt under Section 15301 ofthe California Environmental Quality Act (CEQA).
STAFF RECOMMENDATION: Review information submitted since the time of the last CAB
meeting and provide direction to staff and the applicant as to further action.
Motion: Board Member Birnbaum - To approve the Design Review, Minor Use Permit,
and Coastal Development Permit application 95-040 DR/MIN/CDP with the present blue
awning material and with direction given to staff to confirm that building plans reflect the
revised framing plan reviewed by the Board.

scheduled meeting of this Community Advisory Board to be held October 19, 1994
[subsequently rescheduled to November 2,1995].
