Items on the Consent Calendar are matters which are either routine, self
explanatory or have been discussed at previous meetings. It is
8 anticipated they will not be discussed separately. with a motion "to
adopt the Consent Calendar" the Community Advisory Board approves all
Consent Calendar staff recommendations, as shown on the agenda. These
items are grouped together to allow time for other items on the regular
agenda.
However, items may be removed from the Consent Calendar for discussion
either by a "Request to Speak" form from the public, handed to staff, or
a request by a Board Member.
Items removed by a member of the public will be taken up immediately
following adoption of the Consent Calendar. Items removed by a Board
Member will be taken up at the end of the regular agenda.
CLOSING AND ADOPTION OF THE CONSENT CALENDAR
1. Approval of Minutes: Regular Meeting of August 18, 1994,

STAFF RECOMMENDATION: Adopt the Consent Calendar Approving the
Minutes of August 18, 1994.

4IÞ Oral comments (maximum of three minutes per person) will be heard from
people who submit a white speaker's slip to staff. The law precludes
the Board from discussing or taking action upon such non-agenda items.
They will be referred to the Planning staff.
REGULAR AGENDA
2. Public Hearing for a Design Review and Variance request to allow a
proposed 865 square foot addition to one unit of an existing
triplex and to allow the addition to encroach five feet into the
required 15' front yard setback for a total setback of ten feet;
located in the DR-25 zone of the Downtown Encinitas Specific Plan.
CASE NUKBER: 94-131 DR/V; APPLICANT: Clay and Tawn Babcock;
LOCATION: 306 W. "I" Street; ENVIRONMENTAL STATUS: Exempt per
Section 15301, Class l(e) (1) of CEQA; Staff Contact: Assistant
Planner Langager.
STAFF RECOMMENDATION: Receive public testimony, review the project
and adopt the draft Resolution denying Case No. 94-131 DR/V.
3. Public Hearing for a Major Use Permit request to allow a proposed
tire sales and tire mounting retail business to occupy an existing
building and to allow off-site parking in association with the
operation; located in the General Commercial Zone. Design Review
of proposed facade color changes, landscape modifications and
signage is included as part of the application. CASE NUMBER: 94-
8 123 MUP; APPLICANT: 4-Day Tires; LOCATION: 10 Encinitas Blvd.;
ENVIRONMENTAL STATUS: Exempt per section 15301 of CEQA; Staff
Contact: Assistant Planner Langager.
STAFF RECOMMENDATION: Receive public testimony, review the
project, and, should the Board be able to resolve the issues
related to color, recommend that the Planning Commission adopt the
draft Resolution approving Case No. 94-123 MUP.
4. Public Hearing for a proposed Tentative Parcel Map for a three lot
single family residential subdivision, and associated Variance for
rear yard setback encroachment; CASE NUMBER: 94-141 TPM/V;
APPLICANT: Helmut Kiffman; LOCATION: 227 N. Vulcan Ave.;
ENVIRONMENTAL STATUS: Exempt per Section 15315 of CEQA; Staff
Contact: Junior Planner Kennedy.
STAFF RECOMMENDATION: Receive public testimony, review the project
and adopt the draft Resolution approving Case No. 94-141 TPM/V.

6. November Old Encinitas CAB meeting is scheduled for November 17,
1994 rather than November 24, 1994 due to Thanksgiving Holiday.

7. General Discussion of Joint City Council/Planning Commission/CAB
meeting held on October 17, 1994.
ADJOURNMENT
Meeting to be adjourned to the next regularly scheduled meeting to be
held Thursday, November 17, 1994.
A proponent or protestant of record may appeal a final decision of the
hearing body by filing the appeal within fifteen (15) calendar days
after the hearing, ten (10) days after the hearing for a Tentative
Parcel Map or Tentative Map through the Office of the City Clerk, City
