ENVIRONMENTAL STATUS: Negative Declaration certified in
conjunction with previous approvals 89-196 TM/EIA and 89-197
DR: Staff Contact: Associate Planner Curriden.
STAFF RECOMMENDATION: Receive public testimony, and advise
the Planning Commission to adopt the draft Resolution
approving Case No. 94-193 DR.
Motion: Board Member Birnbaum - To recommend Planning commission
approval of the application in accordance with the findings and
conditions presented in the draft resolution.

3. continued Public Hearing for a Design Review and Variance
application to allow an addition to an existing three unit

STATUS: Exempt per section 15301(e) of CEQA: Staff Contact:
Junior Planner Kennedy.
STAFF RECOMMENDATION: Receive public testimony, review the
project and adopt the draft Resolution denying Case No. 94-190
DR/V.
Motion: Board Member Birnbaum - To direct staff to prepare a
resolution of approval for the Board Chair to review and sign (thus
not requiring the Resolution to be returned to the CAB for
adoption), reflecting finding language as specified by the Board
Chair in the motion.
Second: Board Member Comeau

COMMUNITY ADVISORY BOARD/DIRECTOR REPORTS
Associate Planner Curriden reported to the CAB the City
Council action of December 14,1994 relating to the Encinitas
Auto Center (Case # 93-175 MUP/EIA). The three Board members
present agreed that Boardmember Harden would be present at the
Council meeting of February 22, 1995 to answer any questions
the Council might have concerning the Board's previous
advisory action on this application.

Meeting to be adjourned to the next regularly scheduled
meeting to be held Thursday, January 19, 1995.
Motion: Board Member Birnbaum - To adjourn the meeting at
7:41 P.M. to the next regularly scheduled meeting of this
Community Advisory Board to be held January 19, 1995.
