2. Public Hearing for a Design Review and Variance request to
allow a proposed 865 square foot addition to one unit of an
existing triplex and to allow the addition to encroach five
feet into the required 15' front yard setback for a total
setback of ten feet: located in the DR-25 zone of the Downtown
Encinitas Specific Plan. CASE NUMBER: 94-131 DR/V; APPLICANT:
Clay and Tawn Babcock: LOCATION: 306 W. "I" Street:
ENVIRONMENTAL STATUS: Exempt per section 15301, Class l(e) (1)
of CEQA: Staff Contact: Assistant Planner Langager.
STAFF RECOMMENDATION: Receive public testimony, review the
project and adopt the draft Resolution denying Case No. 94-131
DR/V.
Motion: Board Member Birnbaum - To continue the item to the
meeting of November 17,1994 to allow staff to return with a draft
resolution approving the project (including variance and design
8 review findings, and conditions of approval) and to allow the
applicant to address additional landscaping for the site. The
Board suggested that the use of queen palms be continued to wrap
around the structure, especially to the north east corner to
resolve design concerns in the northeast corner of the structure.
The findings required to approve the variance can be made since the
si te was subject to modified zoning, including a specific plan,
which created more stringent setback regulations. The existence of
improvements on the site at the one story area, which is proposed
to be used in terms of foundation, was constructed at a 10' setback
and was done so with the reliance that the structure, in the
future, could be utilized to support a second story. To enable the
continuity of design, at the second story level, the 10' setback
needs to be maintained in line with the existing structure. The
addition is not self-induced because the modified zoning was not
created by the applicant. There are other properties in the area
which were developed with a 10' front yard setback. An alternative
available would be the complete removal of the existing one story
structure which is infeasible and an economic hardship. Other
alternatives would require penetrating existing structural walls.

3. Public Hearing for a Major Use Permit request to allow a
proposed tire sales and tire mounting retail business to
occupy an existing building and to allow off-site parking in
association with the operation: located in the General
Commercial Zone. Design Review of proposed facade color
changes, landscape modifications and signage is included as
part of the application. CASE NUMBER: 94-123 MUP: APPLICANT:
4-Day Tires; LOCATION: lO Encinitas Blvd.: ENVIRONMENTAL
STATUS: Exempt per section 15301 of CEQA: Staff Contact:
Assistant Planner Langager.
STAFF RECOMMENDATION: Receive public testimony, review the
project, and, should the Board be able to resolve the issues
related to color, recommend that the Planning Commission adopt
the draft Resolution approving Case No. 94-123 MUP.
Motion: Board Member Birnbaum - To recommend to the Planning
commission to adopt the draft resolution approving Case No. 94-123
MUP with the additional condition that the awning be of a canvas
material similar in color to the vinyl sample #627 Scarlett Supreme
manufactured by signmaster Supreme and with specification that the
8 service bay doors match the white color proposed for the exterior
building siding.

STAFF RECOMMENDATION: Receive public testimony, review the
project and adopt the draft Resolution approving Case No. 94-
141 TPM/V.
Motion: Board Member Wells - To adopt the draft resolution
approving Case No. 94-141 TPM/V with the additional condition that
on-site parking be provided for the existing single family
residence, in conformance with the Municipal Code and the Off-

5. Review City Council actions from the meetings of September 20,
21, 28 and October 12, 1994 and Planning Commission actions
from the meetings of September 29 and October 13, 1994.
Contact Person: Assistant Planner Langager.
Assistant Planner Langager reviewed past Council and Planning
commission actions with the Board. The Board agreed by
consensus that Chairperson Birnbaum would represent the Board
8 if an Administrative Hearing were held relative to Case No.
93-175 MUP/EIA.
6. November Old Encinitas CAB meeting is scheduled for November
17, 1994 rather than November 24, 1994 due to Thanksgiving
Holiday.
The above was noted by Chairperson Birnbaum as a reminder.
BUSINESS
7. General Discussion of Joint City Council/Planning
Commission/CAB meeting held on October 17, 1994.
Issues discussed at the October 17,1994 meeting were reviewed
by Chairperson Birnbaum.

meeting to be held Thursday, November 17, 1994.
