ORAL COMMUNICATIONS Oral comments (maximum of three minutes) will be heard from people who submit a white speaker's slip to the chairperson. No action may legally be taken on such non-agenda items, . such items will be referred to the Planning staff. 5. PUBLIC HEARINGS A. L1.212: Grading Plan/Design Review - Michael & Carmen Major, Crystal Ridge Road, Olivenhain. Design Review for the grading of four (4) single family residential lots to include the grading for a cul-de-sac and building pads. Environmental Status: Proposed Negative Declaration. MOTION by Fernald, seconded by DuVivier, to certify the negative declaration for Grading Permit Application No. L1212 as recommended by staff. Voted on as follows: Trujillo - Aye, DuVivier - Aye, Fernald - Aye Bobbitt - Aye MOTION by DuVivier, seconded by Trujillo, to approve the Design Review Permit for Grading Plan No. L1212 as proposed, while at the same time encouraging deviation from the plan during grading, if possible, to use more diversity and creativity resulting in a more aesthetic . project. Trujillo - Aye, DuVivier - Aye, Fernald - Aye Bobbitt - Aye B. 87-111-V: Variance Application - Cliff Mills/Charles Lombardo, 215 1/2 Meadow Vista Way (Formerly San Diego Avenue), Olivenhain. Variance application to allow a single family residence to encroach 20' into a required 40' front yard setback, and for a retaining wall to exceed the allowed 3 1/2' height limit by 1/2' in the front yard setback. Authority to exceed the interim height regulations by one inch is also requested. MOTION by DuVivier, seconded by Trujillo, to continue Variance Application No. 87-111-V in order to allow the applicant to stake the site depicting the maximum height of the proposed project at all roof corners and to submit photos of the stakes taken from neighboring properties in order to address the issue of View Preservation. Voted as follows: Trujillo - Aye, DuVivier - Aye, Fernald - Aye, Bobbitt - Aye. 6. MISCELLANEOUS .... A. General discussion regarding community characteristics and priorities unique to the Olivenhain Community Advisory Board area. 7.
