RESOLUTION NO. OE-54
CASE NO. 88-343 DR
Findings For Design Review
(Section 23.08.076 Municipal Code)
23.08.072 Reaulatorv Conclusions - Generallv.
A. The project design is inconsistent with the General Plan, a
Specific Plan or the provisions of this Code.
Evidence to Consider:
Subject to the conditions of approval, the project will comply
with all provisions of the Zoning Ordinance and Municipal
Code. Professional Office use of the property is consistent
with the General Plan.
B. The project design is substantially inconsistent with the
Design Review Guidelines.
Evidence to Consider:
The authorized agency found that the revised design remains
in substantial compliance with the Design Review Guidelines
and that none of the regulatory conclusions contained in
Chapter 23.08 of the Municipal Code can be made.
C. The project would adversely affect the health, safety or
general welfare of the community.
Evidence to Consider:
A Negative Declaration of Environmental Impact was previously
certified by the authorized agency, finding that no adverse
impacts to public health, safety, or general welfare will
occur.
D. The project would tend to cause the surrounding neighborhood
to depreciate materially in appearance or value.
Evidence to Consider:
The authorized agency found the project to represent a
substantial improvement to the subject property, and thus no
material depreciation to surrounding properties will occur.
