1988-54 RESOLUTION NO. OE-54 A RESOLUTION OF THE OLD ENCINITAS COMMUNITY ADVISORY BOARD CITY OF ENCINITAS, APPROVING A DESIGN REVIEW MODIFICATION TO ALLOW REVISION TO THE DESIGN APPEARANCE OF A PREVIOUSLY APPROVED OFFICE BUILDING LOCATED AT 754 SECOND STREET (CASE NUMBER 88-343 DRM) WHEREAS, a request for consideration of a Design Review Modification was filed by the San Dieguito Board of Realtors to allow revisions to the design appearance of a previously approved office building as per Chapter 23.08 of the City of Encinitas Municipal Codes/Zoning Codes, for the property located at 754 Second Street, legally described as; The Southerly 20 inches of Lot 3, all of Lots 4, 5, 6, 7 and 8, all being in Block 18 of Encinitas, in the County of San Diego, State of California, according to Map thereof No. 148, filed in the Office of the County Recorder of San Diego County, June 12, 1983. WHEREAS, a public hearing was conducted on the application on December 8, 1988; and WHEREAS, the Community Advisory Board considered: 1. The staff report dated November, 29, 1988; 2. The application and maps submitted by the applicant; 3. Oral evidence submitted at the hearing; 4. written evidence submitted at the hearing; and WHEREAS, the Old Encinitas Community Advisory Board made the following findings pursuant to Chapter 23.08 of the Zoning Ordinance: SEE ATTACHMENT "A" PM/04/CRO2-200WP5 (12-14-88-1) NOW, THEREFORE, BE IT RESOLVED by the Old Encini tas Community Advisory Board of the City of Encinitas that Design Review Modification application 88-343 DRM is hereby approved subject to the following conditions: SEE ATTACHMENT "B" BE IT FURTHER RESOLVED by the Old Encinitas Community Advisory Board of the City of Encinitas that: This project will not have a significant effect on the environment and a negative declaration is hereby certified, pursuant to the California Environmental Quality Act (CEQA), in conjunction with previous approval 88-132 DR. OE-54 CASE NO. 88-343 DR Findings For Design Review (Section 23.08.076 Municipal Code) 23.08.072 Reaulatorv Conclusions - Generallv. A. The project design is inconsistent with the General Plan, a Specific Plan or the provisions of this Code. Evidence to Consider: Subject to the conditions of approval, the project will comply with all provisions of the Zoning Ordinance and Municipal Code. Professional Office use of the property is consistent with the General Plan. B. The project design is substantially inconsistent with the Design Review Guidelines. Evidence to Consider: The authorized agency found that the revised design remains in substantial compliance with the Design Review Guidelines and that none of the regulatory conclusions contained in Chapter 23.08 of the Municipal Code can be made. C. The project would adversely affect the health, safety or general welfare of the community. Evidence to Consider: A Negative Declaration of Environmental Impact was previously certified by the authorized agency, finding that no adverse impacts to public health, safety, or general welfare will occur. D. The project would tend to cause the surrounding neighborhood to depreciate materially in appearance or value. Evidence to Consider: The authorized agency found the project to represent a substantial improvement to the subject property, and thus no material depreciation to surrounding properties will occur. PM/04/CRO2-200WP5 (12-14-88-1) \ ATTACHMENT "B" STANDARD CONDITIONS OF APPROVAL Subject: Design Review Modification for Proposed 11,600 sq. ft. Office Building Applicant: San Dieguito Board of Realtors Location: 754 Second Street Case No.: 88-343 DRM CITY OF ENCINITAS 1. GENERAL CONDITIONS (In addition to those imposed by Resolution OE-38) The following conditions 1 through 6 shall be incorporated into the project building plans, to be verified by the Community Development Department prior to permit issuance: 1. A large skylight (minimum 10 ft. x 10 ft. dimension) shall be placed with the roof over the central court yard area. 2. Flowering canopy - type trees shall be substituted for the proposed Carrot Wood Street trees, of a minimum 24 inch box size. 3. The existing Carrot Wood Street trees shall be transplanted to locations elsewhere on site. 4. Trees and shrubs shall be installed within the landscaped areas near the central entry area off the alley and near the rear property corners fronting the alley. 5. Planters and benches shall be installed within the central courtyard area separating the buildings. 6. Boston Ivy, or other variant discussed with the Community Advisory Board, shall be planted along the base of the structures to "climb" the concrete walls and soften their appearance.
