RESOLUTION NO. OE-48
A RESOLUTION OF THE OLD ENCINITAS
COMMUNITY ADVISORY BOARD, CITY OF ENCINITAS
APPROVING A DESIGN REVIEW PERMIT FOR A PROPOSED
LANDSCAPE PLAN IN CONJUNCTION WITH A PREVIOUSLY
APPROVED PERMIT FOR CONSTRUCTION OF A DUPLEX
LOCATED AT 658 SANTA FE DRIVE
(CASE NUMBER 88-037 DR)
WHEREAS, a request for consideration of a Design Review
Permit was filed by Mr. Gene Mallin to allow a proposed
landscape plan in conjunction with a previously approved permit
for construction of a duplex as per Chapter 23.08 of the City
of Encinitas Municipal Code, for the property located at 658
Santa Fe Drive, legally described as:
Lot 10 in Block K of Avocado Acres No. 5, in the County of
San Diego, State of California, according to map thereof
No. 2130 filed in the office of County Recorder of San
Diego County, September 19, 1928. Excepting therefrom the
easterly 60 feet thereof.
WHEREAS, a public hearing was conducted on the application
on September 8, 1988; and
WHEREAS, the Community Advisory Board considered:
1. The staff report dated August 25, 1988;
2. The application and landscape plan dated received
August 9, 1988, submitted by the applicant;
3. Oral evidence submitted at the hearing;
4. written evidence submitted at the hearing; and
WHEREAS, the Old Encinitas Community Advisory Board made
the following findings pursuant to Chapter 23.08 of the
Encinitas Municipal Code:

1. subject to the attached conditions of approval, the
proposed landscape plan will be in substantial
conformance with the Design Review Guidelines
relating to landscaping and that none of the
regulatory conclusions contained in section 23.08.77
can be made.
NOW, THEREFORE, BE IT RESOLVED by the Old Encinitas
Community Advisory Board of the City of Encinitas that the
landscape plan for application 88-037 DR is hereby approved
subject to the following conditions:

BE IT FURTHER RESOLVED by the Old Encinitas community
Advisory Board of the City of Encinitas that:
This project was found to be exempt from environmental
review, section 15301;
PASSED AND ADOPTED this 8th day of September, 1988, by the
following vote, to wit:

CONDITIONS OF APPROVAL FOR LANDSCAPE PLAN
(File No. 88-037 DR)
1. A detailed landscape and irrigation plan shall be
submitted to and approved by the Community Development
Department as consistent with the Old Encinitas Community
Advisory Board approval prior to final occupancy.
2. The landscape plan shall meet the standards of the Zoning
Ordinance, Grading Ordinance and off street Parking Design
Manual and is approved as submitted subject to the
following modifications:
A. Substitution of Tecate Cypress, Eucalyptus or
Catalina Ironwood trees for the Tristania Conferta
indicated on the approved plan.
B. Substitution of low Junipers for the Viburnum
indicated on the approved plans.
C. Substitution of Quercus Agrifolia (Coast Live Oaks)
for the Melaleucas indicated in the approved plans.
D. Substitution of Arctostaphylos Edmunds "Carmel Sur"
for the ice plant indicated on the approved plans.
E. Substitution of Eucalyptus and/or Twisted Juniper
trees for the Cupanias indicated on the approved
plans.
F. Substitution of California Holly for the Photinias
indicated on the approved plans.
G. Substitution of grass lawn in the courtyard area
separating the two units for the shrubs indicated on
the approved plans. However, shrubs shall be
retained at the interior building corners.
H. The fence along the property line shall be 42 inches
in height, not the 6 ft. indicated on the approved
plans.
3. All required plantings shall be in place prior to use or
occupancy of new buildings or structures. All required
plantings shall be maintained in good growing conditions,
and whenever necessary, shall be replaced with new plant
materials to ensure continued compliance with applicable
landscaping, buffering, and screening requirements. All
landscaping shall be maintained in a manner that will not

depreciate adjacent property values and otherwise
adversely affect adjacent properties.
4. Landscaping shall be maintained in such a way so view
corridors are not blocked.
