1988-38 -- . RESOLUTION NO. OE-38 . A RESOLUTION OF THE OLD ENCINITAS COMMUNITY ADVISORY BOARD CITY OF ENCINITAS, APPROVING A DESIGN REVIEW PERMIT TO ALLOW CONSTRUCTION OF AN APPROXIMATELY 11,200 SQ. FT. OFFICE BUILDING LOCATED AT 754 SECOND STREET (CASE NUMBER 88-132 DR) WHEREAS, a request for consideration of a Design Review Permit was filed by the San Dieguito Board of Realtors to allow construction of an approximately 11,200 sq. ft. office building, as per Chapter 23.08 of the City of Encinitas Municipal Codes, for the property located at 754 Second Street (the northwesterly corner of Second and "G" Streets), legally described as; The Southerly 20 inches of Lot 3, all of Lots 4, 5, 6, 7 and 8, all being in Block 18 of Encinitas, in the County of San Diego, State of California, according to Map . thereof No. 148, filed in the Office of the County Recorder of San Diego County, June 12, 1983. WHEREAS, a public hearing was conducted on the application on June 23, 1988; and WHEREAS, the Community Advisory Board considered: 1. The staff report dated June 17, 1988; 2. The proposed site Plan, floor plans and elevations; 3. Oral evidence submitted at the hearing; 4. Written evidence submitted at the hearing; and "- WHEREAS, the Old Encinitas Community Advisory Board made the following findings pursuant to the Municipal Code: . ATTACHMENT "A" OLD ENCINITAS ( CAB) RESOLUTION NO. OE-38 CASE NO. 88-132 DR . Findings For Design Review (Section 23.08.076 Municipal Code) 23.08.072 Requlatory Conclusions - GenerallY. A. The project design is inconsistent with the General Plan, a Specific Plan or the provisions of this Code. Evidence to Consider: Subject to the conditions of approval, the project will comply with all provisions of the Zoning Ordinance and Municipal Code. Professional Office use of the property is consistent with the General Plan. B. The project design is substantially inconsistent with the Design Review Guidelines. Evidence to Consider: The authorized agency found that the proposal is in . substantial compliance with the Design Review Guidelines and that none of the regulatory conclusions contained in Chapter 23.08 of the Municipal Code can be made. C. The project would adversely affect the health, safety or general welfare of the community. Evidence to Consider: A Negative Declaration of Environmental Impact was certified by the authorized agency, finding that no adverse impacts to public health, safety, or general welfare will occur. D. The project would tend to cause the surrounding neighborhood to depreciate materially in appearance or value. Evidence to Consider: The authorized agency found the project to represent a substantial improvement to the subject property, and thus no material depreciation to surrounding properties will occur. . A Certificate of Compliance to consolidate the I subject property shall be prepared and recorded to the satisfaction of the Community Development Department prior to issuance of building permits. APPLICANT SHALL CONTACT THE DEPARTMENT OF PLANNING AND COMMUNITY DEVELOPMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 2. SITE DEVELOPMENT A. Prior to any use of the project site or business activity being commenced thereon, all conditions of approval contained herein shall be completed to the satisfaction of the Director of Community Development. B. For a new commercial or industrial development, or addition to an existing development, the applicant shall pay development fees at the established rate. Such fees may include, but not be limited to: Permit and Plan Checking Fees, Water and Sewer Service Fees, School Fees, Traffic Fees, Drainage Fees and Park . Fees. These fees shall be paid: Prior to issuance of building permits. C. Building elevations materials and color are approved as submitted, subject to the following modifications: a. Planter boxes within front and exterior side yard setbacks shall be no more than 42 inches in height as per zoning ordinance regulations. b. Incorporation of benches and planters within the central courtyard area. D. Applicant shall submit to the Community Development Department a security construction plan for review and approval. Said Plan shall identify any temporary fencing, temporary parking and circulation, project access and the like. E. Any change to the natural drainage or concentration of drainage shall be adequately handled and shall not impact adjacent properties. F. That a plan be submitted for approval by the Director . of Planning and Community Development and the TC/04/PCl-84WP (6-30-88-2) -2- CASE NO. 88-132DR Encinitas Fire Protection District regarding the . treatment of the site during the construction phase, and the circulation and parking of construction workers' vehicles and any heavy equipment needed for the construction of the project. G. Revised floor plans shall be submitted reflecting the approximate 400 sq. ft. reduction in floor area, wi thout substantial change to the design appearance of the building, as presented to the Community Advisory Board, subject to Community Development Department review and approval prior to permit issuance. 3. PARKING AND VEHICULAR ACCESS A. Parking lot layout shall meet the standards of the Zoning Ordinance and the off street Parking Design Manual. The approved parking layout shall be modified to meet City standards and design review as follows: Spaces shown abutting pedestrian exits shall be striped and reserved for pedestrian use only. B. Driveways shall meet the standards of the Zoning Ordinance, Public Works Standards, and the off street . Parking Design Manual. 4 . LANDSCAPING A. A detailed landscape and irrigation plan in compliance with the Community Advisory Board approved landscape plan shall be submitted to and approved by the Community Development Department prior to the issuance of building permits. B. All required plantings shall be in place prior to use or occupancy of new buildings or structures. All required plantings shall be maintained in good growing conditions, and whenever necessary, shall be replaced with new plant materials to ensure continued compliance with applicable landscaping, buffering, and screening requirements. All landscaping shall be maintained in a manner that will not depreciate adjacent property values and otherwise adversely affect adjacent properties. . TC/O3/PC1-84WP (6-29-88-1) -3- ~ . CASE NO. 88-132DR . APPLICANT S HALL CONTACT THE ENCINITAS FIRE PROTECTION DISTRICT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 5. FIRE A. Prior to delivery of combustible building materials on site, water and sewer systems shall satisfactorily pass all required tests and be connected to the public water and sewer systems. In addi tion, the first lift of asphalt paving shall be in place to provide adequate, permanent access for emergency vehicles. Said access shall be maintained to the satisfaction of the Fire Department. B. Submit a letter from the Encinitas Fire Protection District stating satisfaction with the type and location of Fire hydrants and the minimum required water flow in gallons per minute together with a letter from the appropriate agency certifying that the fire department's minimum required water flow is available to serve the site. Provisions shall be made to ensure a maximum water pressure at the fire hydrant of 150 psi. The installation of a pressure reducing station may be required. Fire hydrants . shall be of a bronze type. C. An automatic fire sprinkler system shall be installed as per M.F.P.A. 13 or 130 whichever is applicable. The most current edition shall be used. Detailed sprinkler plans shall be submitted to the Fire Prevention Bureau for approval prior to installation. APPLICANT S HALL CONTACT THE PUBLIC WORKS DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 6. GRADING A. Grading of the subject property shall be in accordance with the Grading Ordinance. B. The final grading plan shall be a subject to review and approval by the Public Works Department and shall be completed prior to final subdivision map or issuance of building permit. 7. Install 1" asphalt cap from edge of existing . gutter. To easterly edge of alley for the length of the project. 2. Patch concrete curb as required to the satisfaction of the City Engineer on 2nd Street and "G" Street. 3. Construct (2) std. wheelchair ramps at the northwest corner of 2nd and "G" Streets. 4. Remove exist. drive on "G" Street - Replace with "G" type curb and gutter. 5. Applicant to sign and record covenant agreeing not to protest any proceedings for the installation or acquisition of public improvements under any applicable special assessment proceedings. B. All damaged off-site public works facilities, including parkway trees, shall be repaired or replaced prior to final occupancy improvements, to the satisfaction of the Department of Public Works. C. Prior to any work being performed in the public right-of-way, a right-of-way construction permit . shall be obtained from the Public Works office and appropriate fees paid, in addition to any other permits required. APPLICANT SHALL CONTACT THE APPROPRIATE AGENCY REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 8. UTILITIES A. The developer shall be responsible for the relocation or undergrounding of existing public utilities, as required to provide for free and clear access to the parking spaces abutting the alley. B. Water, sewer, and fire protection systems plans shall be designed and constructed to meet requirements of the City of Encinitas, Fire District, Appropriate Agency and the Health Department of the County of San Diego. . Office Building Applicant: San Dieguito Board of Realtors Location: 754 Second Street Case No.: 88-132 DR CITY OF ENCINITAS 1. GENERAL CONDITIONS A. This approval will expire on June 23, 1990, two years after the approval of this project unless the conditions have been met or an extension has been approved by the Authorized Agency. B. Nothing in this permit shall relieve the applicant from complying with the conditions and regulations generally imposed upon activities similarly in nature to the activity authorized by this permit; . C. Nothing in this permit shall authorize the applicant to intensify the authorized activity beyond that which is specifically described in this permit; and D. Approval of this request shall not waive compliance with any sections of the Zoning Development Code and all other applicable City Ordinances in effect at the time of Building Permit issuance. E. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit issuance. F. Permits from other agencies will be required as follows prior to permit issuance: California Coastal Commission. G. Prior to issuing a final inspection on framing, the applicant shall provide a survey from a civil engineer verifying the building height is in compliance with the design review permit. .
