RESOLUTION NO. OE-34
A RESOLUTION OF THE OLD ENCINITAS COMMUNITY ADVISORY BOARD
APPROVING A SIGN PROGRAM AMENDMENT FOR A SERVICE STATION
8 AND CARE WASH FACILITY, LOCATED AT THE NORTHWEST
CORNER OF ENCINITAS BOULEVARD AND THE 1-5 OFF-RAMP
WHEREAS, a request for an amendment to Design Review
approval 87-203 DR to allow two monument signs, one 8 ft. by 9
ft. containing the Shell insignia and gasoline prices, and one
8 ft. high by 6 ft. wide monument sign containing shopping
center identification and tenant directory for the adjacent Big
Bear shopping center, along the southerly properly line of the
Shell Service station and car wash, located at 108 (#50)
Encinitas Boulevard, was requested by GMI Inc. for Shell oil
Company, on a site legally described as:
Parcell:
Parcel 2 in the County of San Diego, State of California, as
shown at Page 14490 of Parcel Maps, filed in the Office of the
8 County Recorder of San Diego County, September 30, 1986.
Parcel 2:
An easement for ingress, egress, road and public utility
purposes, over, under, along and across that portion of Parcel
1 of Parcel Map No. 14490 shown as designated on said Map as
"Proposed 50 foot Private Road and utility Easement" and
"Proposed Private Road Easement."; and
WHEREAS, a public hearing was conducted on the application
on June 9, 1988; and
WHEREAS, the CAB considered:
1. The staff report dated June 1, 1988;
2. The project/sign plans submitted by the applicant;
3. Oral evidence submitted at the hearing;
4. written evidence submitted at the hearing; and
WHEREAS, at said hearing the Community Advisory Board
determined that subject to the conditions of approval contained
herein the proposal was in substantial conformance with the

City of Encinitas' adopted Design Review Guidelines relating to
signs, and that none of the regulatory conclusions contained in
8 section 23.08.078 of the Municipal Code could be made, and
WHEREAS, this proposal is categorically exempt from
environmental review pursuant to section 15311 of the State
CEQA Guidelines.
NOW THEREFORE, BE IT RESOLVED that sign program Design
Review amendment application 88-136 sign is hereby approved
subject to the following conditions:
1. The Shell insignia wall sign mounted on the north wall of
the Big Bear market shall be modified to contain only that
insignia and no lettering, as per design review approval
87-203 DR, prior to permit issuance.
2. The tenant identification sign near the southwest corner
of the site shall be modified to contain only tenant
identification parcels without the "header", and shall
legibly display the shopping centers address on the
monument base.
8 3. Prior to permit issuance, the applicant shall furnish the
Community Development Department with satisfactory
evidence of a Coastal Development Permit or Notice of
Exemption from the California Coastal Commission.
PASSED AND ADOPTED, this 9th day of June, 1988, by the
following vote, to wit:
