1988-33 RESOLUTION NO. OE-33 8 A RESOLUTION OF THE OLD ENCINITAS COMMUNITY ADVISORY BOARD, CITY OF ENCINITAS, APPROVING DESIGN REVIEW PERMIT TO ALLOW CONSTRUCTION OF A SECOND SINGLE FAMILY HOME ON A SITE AND REMODELING OF THE EXISTING RESIDENCE LOCATED AT 55 "I" STREET (CASE NUMBER 88-078 DR) WHEREAS, a request for consideration of a Design Review proposal was filed by Mr. Steve Royce to allow construction of a second single family dwelling and various site improvements to a site presently containing one single family home, to be remodeled, as per Chapter 23.08 of the City of Encinitas Municipal/Zoning Codes, for the property located at 55 "I" Street, legally described as; Lot 16 and the North Half of Lot 15, Block B, 8 Subdivision of East Block 10, Sturges and Ratton's Subdivision of East Blocks 78, 10, 11 and 42 of Encinitas, in the County of San Diego, State of California, according to Map thereof No. 33, filed in the Office of the County Recorder of said San Diego County, on March 19, 1887. WHEREAS, a public hearing was conducted on the application on June 9, 1988; and WHEREAS, the Community Advisory Board/Planning Commission considered: 1. The staff reports dated June 3, 1988; 2. The application and revised maps submitted by the applicant; 3. Oral evidence submitted at the hearing; 8 PM/02/CRO3-70WP 1(6-13-88) 4. written evidence submitted at the hearing; 5. The density compatibility study prepared by the 8 applicant; and WHEREAS, at said hearing the Community Advisory Board found that subject to the conditions of approval contained herein the project is in substantial conformance with the Encinitas Design Review Guidelines and that none of the regulatory conclusions listed in Chapter 23.08 of the Encinitas Municipal Code can be made. NOW, THEREFORE, BE IT RESOLVED by the Old Encinitas Community Advisory Board of the City of Encinitas that Design Review Application 88-078 DR is hereby approved subject to the following conditions: A. GENERAL CONDITIONS: 8 1. Prior to permit issuance, the Developer shall provide evidence of a Coastal Development Permit or Notice of Exemption from the California Coastal Commission satisfactory to the Community Development Department. 2. Prior to final occupancy, the owner shall pay all development fees required pursuant to the City of Encinitas Municipal Code including, but not limited to, traffic mitigation, fire mitigation, flood control, and park in-lieu fees. 3. This approval will expire on June 9, 1990, two years after the approval of this project unless the conditions have been met or an extension has been approved by the Authorized Agency. 4. Approval of this request shall not waive compliance with any sections of the Zoning Development Code and all other applicable City Ordinances in effect at the time.of Building Permit issuance. 5. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and 8 PMj02jCRO3-70WP 2(6-13-88) . ordinances in effect at the time of building permit issuance. 8 6. Prior to issuing a final inspection on framing, the applicant shall provide a survey from a civil engineer verifying the building height is in compliance with the design review permit. 7. Project is approved as modified and reviewed by the Community Advisory Board June 9, 1988, and shall not be altered without Old Encinitas Community Advisory Board review and approval. AP P LI CANT SHALL CONTACT THE DEPARTMENT OF PLANNING AND COMMUNITY DEVELOPMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: B. SITE DEVELOPMENT 8. Any change to the natural drainage or concentration of drainage shall be adequately handled and shall not impact adjacent properties. C. LANDSCAPING 9. All required plantings shall be in place prior to use or occupancy of new buildings or structures. All required plantings shall be maintained in good growing conditions, and whenever necessary, shall be 8 replaced with new plant materials to ensure continued compliance with applicable landscaping, buffering, and screening requirements. All landscaping shall be maintained in a manner that will not depreciate adjacent property values and otherwise adversely affect adjacent properties. 10. Landscaping shall be maintained in such a way so view corridors are not blocked. APPLICANT SHALL CONTACT THE ENCINITAS FIRE PROTECTION DISTRICT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: D. FIRE 11. Prior to delivery of combustible building materials on site, water and sewer systems shall satisfactorily pass all required tests and be connected to the public water and sewer systems. In addition, the first lift of asphalt paving shall be in place to provide adequate, permanent access for emergency vehicles. Said access shall be maintained to the satisfaction of the Fire Department. 8 PM/02/CRO3-70WP 3(6-13-88) . E. STREETS AND SIDEWALKS 8 12. Developer shall execute and record covenant with the County Recorder agreeing not to oppose the formation of an assessment district to fund the installation of right-of-way improvements. F. DRAINAGE AND FLOOD CONTROL 13. Prior to permit issuance a detailed drainage plan shall be submitted satisfactory to the Public Works Department. 14. A drainage system capable of handling and disposing of all surface water originating within the subdivision, and all surface waters that may flow onto the subdivision from adjacent lands, shall be required. Said drainage system shall include any easements and structures as required by the Director of Public Works to properly handle the drainage. APPLICANT SHALL CONTACT THE APPROPRIATE AGENCY REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: G. STANDARD MAP CONDITIONS (Chapter 24.16 of the TPM 4 Municipal Code) 8 15. That all required improvements conform to City Standards. BE IT FURTHER RESOLVED by the Old Encinitas Community Advisory Board of the City of Encinitas that: This project was found to be exempt from environmental review, Section 15303. 8 PM/02/CRO3-70WP 4(6-13-88) .
