RESOLUTION NO. OE-27
8 A RESOLUTION OF THE OLD ENCINITAS COMMUNITY ADVISORY BOARD
DENYING A PROPOSED VARIANCE TO ALLOW PLACEMENT OF
A MONUMENT SIGN WITHIN THE SIGHT DISTANCE REQUIREMENTS
OF SECTION 23.36.070 OF THE MUNICIPAL CODE AND APPROVING A
DESIGN REVIEW PERMIT FOR THE SIGN IF PLACED ELSEWHERE
ON THE SUBJECT PROPERTY
(88-030V/DR)
WHEREAS, a request for variance and design review permits
to allow construction of a monument sign within the sight
distance triangle prescribed by Municipal Code section
23.36.070 was requested by Sanesco oil Company; and
WHEREAS, a public hearing was conducted on the application
on March 10, 1988; and
WHEREAS, the CAB considered:
8 1. The staff report dated March 2, 1988,
2. Project plans submitted by the applicant,
3. Oral evidence submitted at the hearing,
4. written evidence submitted at the hearing, and
WHEREAS, the board members found that no special
circumstances were present and no such modification was
necessary to warrant approval of the variance in accordance
with Municipal Code section 24.01.180.
NOW THEREFORE, BE IT RESOLVED that Variance Application
88-030V/DR is hereby denied and the asociated Design Review
Permit is hereby approved subject to the following condition:
1. The proposed monument sign shall be placed in a
location on the subject site outside of the sight
distance area requirement of Municipal Code section

23.36.070, to be verified by the Community
Development Department prior to permit issuance.

following vote, to wit:
