1988-25 RESOLUTION NO. OE-25 A RESOLUTION OF THE OLD ENCINITAS COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW PERMIT FOR A PLANNED 8 RESIDENTIAL DEVELOPMENT CONTAINING 25 DETACHED SINGLE FAMILY HOMES LOCATED AT THE NORTHWEST CORNER OF MELBA AND GARDENA WHEREAS, a request for a Design Review permit for a planned residential development containing 25 single family residences was filed by Pearson Planning, Inc., for the property located at the northwest corner of Melba and Gardena, legally described as; All that portion of the Northwest quarter of the Southeast quarter of Section 15, Township 13 South, Range 4 West, San Bernardino Base and Meridian, in the County of San Diego, State of California, according to Official Plat thereof, described as follows: Beginning at the Southwest corner of the Northwest Quarter of the Southeast Quarter of said section 15; thence East along the South line thereof 183.13 feet to the TRUE POINT OF BEGINNING; thence continuing East along said South line 497.87 feet; thence North 319.8 feet; thence West on a 8 line parallel with the South line 497.87 feet to the Northwest corner of the land described in deed to Charles F. White, Jr. et ux, recorded February 20, 1961 as Document No. 30450 of Official Records; thence South 319.8 feet to the TRUE POINT OF BEGINNING, and WHEREAS, a public hearing was conducted on the application on February 18, 1988; and Whereas, the CAB considered: 1. The staff report dated February 11, 1988, 2. The project plans and revised elevations and landscape plan submitted by the applicant, 3. Oral testimony submitted at the hearing, 4. written testimony submitted at the hearing; and WHEREAS, subject to the conditions of approval the Community Advisory Board found the proposal to be consistent with the City's adopted design criteria and that none of the regulatory conclusions contained in Chapter 23.08 of the City 8 of Encinitas Municipal Code can be made. TC/06/CAB6-525Wp (3-14-88) 1 NOW THEREFORE, BE IT RESOLVED that Design Review application 87-144DR is hereby approved subject to the 8 following conditions: 1. The developer shall substitute other colors from the approved palette of colors for the proposed "peach" and "grey" homes, to be verified by the Community Development Department prior to final occupancy. 2. The applicant shall furnish the Community Development Department with a Coastal Development Permit or Notice of Exemption from the California Coastal Commission prior to permit issuance. 3. That a plan be submitted for approval by the Director of Planning and Community Development and the Encinitas Fire Protection District regarding the treatment of the site during the construction phase, and the circulation and parking of construction workers' vehicles and any heavy equipment needed for the construction of the project. 4. Project is approved as submitted and shall not be altered without Community Advisory Board review and approval. 5. Prior to the City Building Department issuing a final inspection on framing, the applicant shall provide a survey from a civil engineer as to the building height. 8 Building height shall not exceed 24 feet at the peak of the roof. 6. Prior to final occupancy, the owner shall pay all development fees required pursuant to the City of Encinitas Municipal Code including, but not limited to, traffic mitigation, fire mitigation, flood control, and park in-lieu fees. 7. Project landscaping shall be in conformance with the revised landscape plan approved by the Old Encinitas Community Advisory Board on February 18th, 1988, showing Holly Oak and Carrot Wood Street trees, to be verified by the Community Development Department prior to final occupancy. 8. The interior elevations of the homes shall incorporate window shelves as indicated on the revised elevations approved by the Community Advisory Board on February 18, 1988, to be verified by the Community Development Department prior to final occupancy. 9. The per imeter fencing along the westerly boundary of the site shall be constructed of wood to match the wood fencing used elsewhere throughout the site, to be verified by the Community Development Department prior to final 8 occupancy.
