A RESOLUTION OF THE OLD ENCINITAS COMMUNITY ADVISORY BOARD
DENYING A DESIGN REVIEW PERMIT FOR A PROPOSED
DUPLEX LOCATED AT 139-141 FOURTH STREET
WHEREAS, a request for a design review permit for a
proposed duplex for a presently vacant site located at 139-141
Fourth Street was filed by Mr. Evan Harrison, a site legally
described as:
Lot 11 in Block 25 of PITCHER'S SUBDIVISION according to
Map thereof No. 187 filed in the office of the County
Recorder of San Diego county, April 4, 1887; and
WHEREAS, a public hearing was conducted on the application
on February 18, 1988; and
WHEREAS, the Community Advisory Board considered:
8 1. The staff report dated February 12, 1988,
2. Project plans submitted by the applicant,
3. written evidence submitted by project proponents
and opponents prior to and during the public
hearing,
4. Oral testimony submitted during the public
hearing; and
WHEREAS, the Community Advisory Board found that based
upon the oral and written testimony submitted by both opponents
and proponents of the project, there was insufficient evidence
to determine the proposed project density consistent with the
surrounding area as prescribed by City of Encinitas Interim
Ordinance 87-69, in that less than the required 67% of
surrounding properties as defined by that ordinance were
developed at a density equal to or above the density proposed.

NOW THEREFORE, BE IT RESOLVED that Design Review
Application 87-159DR is hereby denied.
8 PASSED AND ADOPTED this 18th day of February, 1988, by the
following vote, to wit:
