RESOLUTION NO. OE-23
A RESOLUTION OF
8 THE OLD ENCINITAS COMMUNITY ADVISORY BOARD
DENYING A BOUNDARY ADJUSTMENT BETWEEN TWO PARCELS
OF PROPERTY, LOCATED ON THE SOUTH SIDE
OF ENCINITAS BOULEVARD ACROSS FROM ITS INTERSECTION
WITH ROSEBAY DRIVE AND DELPHINIUM STREET
WHEREAS, a request for a boundary adjustment between two
lots, more specifically described as Parcels 1 and 2 of Parcel
Map 2430, filed in the Office of the County Recorder of San
Diego County on March 8, 1974 was requested by Donald Breihan
et al; and
WHEREAS, a public hearing was conducted on the application
on February 18, 1988; and
WHEREAS, the Community Advisory Board considered:
8 1. The proposed Record of Survey Map submitted by the
applicant,
2. The staff report dated February 9, 1988,
3. Oral testimony submitted at the public hearing,
4. Written testimony submitted at the public hearing;
and
WHEREAS, the Community Advisory Board found that since
there is a development proposal currently in process for the
subject property which could render one or more of the
findings applicable contained in Section 24.70.060 of the
Municipal Code, the boundary adjustment should be considered in
tandem with that development proposal.
NOW THEREFORE, BE IT RESOLVED that Boundary Adjustment and
8 Certificate of Compliance Application 87-202 BA/CC is hereby

denied without prejudice in order to allow the boundary
adjustment to be considered in conjunction with the pending
8 development proposal.
PASSED AND ADOPTED this 18th day of February, 1988, by the
following vote, to wit:
