A RESOLUTION OF THE OLD ENCINITAS COMMUNITY ADVISORY BOARD
8 APPROVING A DESIGN REVIEW PERMIT
FOR A PROPOSED DUPLEX LOCATED
AT 658 SANTA FE DRIVE
WHEREAS, a request for a Design Review permit for a
proposed duplex was filed by Mr. Eugene Mallin for the property
located at 658 Santa Fe Drive, legally described as:
LOT 10 IN BLOCK K OF AVOCADO ACRES NO. 5, IN THE COUNTY OF
SAN DIEGO, STATE OF CALIFORNIA, ACCORDING TO MAP THEREOF
NO. 2130 FILED IN THE OFFICE OF COUNTY RECORDER OF SAN
DIEGO COUNTY, SEPTEMBER 19, 1928. EXCEPTING THEREFROM THE
EASTERLY 60 FEET THEREOF; and
WHEREAS, a public hearing was conducted on the application
on February 18, 1988; and
WHEREAS, the Community Advisory Board considered:
1. The building plans submitted by the applicant,
2. The staff report dated February.
3. Oral testimony submitted at the hearing,
4. written testimony submitted at the hearing; and
8 WHEREAS, the Community Advisory Board found that subject
to the herein contained conditions of approval the proposal is
in substantial compliance with the City's adopted design
criteria and that none of the regulatory conclusions contained
in Chapter 23.08 of the City of Encinitas Municipal Code can be
made.
NOW THEREFORE, BE IT RESOLVED that Design Review
application 88-037DR is hereby approved subject to the
following conditions:
1. A revised landscape plan shall be submitted, subject
to Community Advisory Board review and approval, to
contain the following elements:
a. A more intensive use of landscape materials,
particularly in the west yard area fronting
-- Arcadia Street.

b. A landscape island incorporated in the driveway
between the two 2-car garages to remain.
8 2. The garage doors in the building wing connecting the
two units shall be deleted and replaced with regular
man doors to match those used in the rest of the
project, to be found satisfactory by the Community
Development Department prior to permit issuance.
3. Prior to final occupancy, the developer shall execute
a covenant with the City to guarantee public
improvements required under Title 23 of the City of
Encinitas Municipal Code.
4. Building plans shall indicate a bay window in the
west elevation of the building, subject to Community
Development Department review and approval prior to
permit issuance.
5. Building plans shall indicate a six-foot wooden fence
to separate the courtyard into two equal-sized yard
areas for the residents of each unit, to run from the
wall of the connecting building to a point
coterminous with the ends of each building wing.
6. Building plans shall indicate the incorporation of
sliding doors accessing the courtyard area at the
first level of each unit, and windows at the second
8 level of said courtyard elevations, to be found
satisfactory by the Community Development Department
prior to permit issuance.
7. Prior to permit issuance, the applicant shall provide
evidence of a Coastal Development Permit or Notice of
Exemption from the California Coastal Commission.
8. That a plan be submitted for approval by the Director
of Planning and Community Development and the
Encinitas Fire Protection District regarding the
treatment of the site during the construction phase,
and the circulation and parking of construction
workers' vehicles and any heavy equipment needed for
the construction of the project.
9. Project is approved as submitted and shall not be
altered without community Advisory Board review and
approval.
10. Prior to the City Building Department issuing a final
inspection on framing, the applicant shall provide a
survey from a civil engineer as to the building
height. Building height shall not exceed 34 feet 6
inches at the highest point.

11. Prior to final occupancy, the owner shall pay all
development fees required pursuant to the City of
Encinitas Municipal Code including, but not limited
8 to, traffic mitigation, fire mitigation, flood
control, and park in-lieu fees.
PASSED AND ADOPTED this 18th day of February, 1988, by the
following vote, to wit:
