RESOLUTION NO. OE-21
8 A RESOLUTION OF THE OLD ENCINITAS COMMUNITY ADVISORY BOARD
APPROVING A DESIGN REVIEW PERMIT FOR A PROFESSIONAL
OFFICE BUILDING LOCATED AT 230 SECOND STREET
WHEREAS, a request for a Design Review Permit to allow
construction of a 2 story professional office building,
approximately 2,600 square feet in size and located within the
C-36 zone at 230 Second Street was requested by Richard Huston,
applicant, for the property legally described as:
Lot 4, Block 23, Encinitas, according to Map thereof No.
148, filed in the Office of the County Recorder of San
Diego County on June 12, 1883; and
WHEREAS, a public hearing was conducted on the application
of February 4, 1988; and
WHEREAS, the CAB considered:
1. The staff report dated January 28, 1988;
2. The project plans submitted by the applicant;
8 3. Oral evidence submitted at the hearing;
4. Written evidence submitted at the hearing; and
WHEREAS, the CAB found that subject to the conditions of
approval the proposal is in substantial compliance with the
City's adopted design criteria and that none of the regulatory
conclusions contained in Chapter 23.08 of the City's Municipal
Code can be made.
NOW THEREFORE, BE IT RESOLVED that Design Review
application 87-ll2DR is hereby approved subject to the
following conditions:
1. Prior to issuance of building permits, the developer
shall provide evidence satisfactory to the Community
Development Department that a Coastal Development
Permit or Notice of Exemption from the California
Coastal Commission has been obtained.
8 2. A revised landscape plan shall be submitted

indicating medium-height shrubs in the parkway area,
along with the proposed tree, to replace the proposed
tile paving. Said landscape plan shall be found
. satisfactory by the Community Development Department
prior to building permit issuance.
3. Prior to final occupancy, any damage caused to curb,
gutter or sidewalk shall be repaired to the
satisfaction of the Public Works Department.
4. Driveway approach shall be constructed to City
standards.
PASSED AND ADOPTED this 4th day of February , 1988, by the
following vote, to wit:
