A RESOLUTION OF
8 THE OLD ENCINITAS COMMUNITY ADVISORY BOARD
APPROVING A BOUNDARY ADJUSTMENT BETWEEN TWO PARCELS
OF PROPERTY, LOCATED AT 211 SAXONY DRIVE
WHEREAS, a request for a boundary adjustment between lots,
being a portion of the south half of the southeast quarter of
the southwest quarter of Section 10, Township 13 South, Range 4
West, SBM, was requested by San Diego Hebrew Homes for the Aged
in order to comply with a condition of an earlier Maj or Use
Permit approval requiring dedication of public right-of-way;
and
WHEREAS, a public hearing was conducted on the application
on February 4, 1988; and
WHEREAS, the Community Advisory Board considered:
1. The attached boundary adjustment plat,
8 2. The staff report dated January 29, 1988,
3. Oral testimony submitted at the public hearing,
4. Written testimony submitted at the public hearing;
and
WHEREAS, the Community Advisory Board found that the
proposed boundary adjustment will not do any of the following
pursuant to Section 24.70.060 of the Municipal Code:
A. Create a condition which does not comply with zoning
regulations,
B. Create a condition which does not comply with
building regulations,
C. Materially, adversely affect an agreement for the
security for the construction of public improvements,
D. Extend beyond the City limit boundary,
E. Require substantial alteration of any existing
improvement or creates a need for any new
improvement, and

F. Adjust the boundary line between lots which are
subject to an agreement for public improvements,
unless the City Engineer finds that the proposed
8 adjustment will not materially affect such agreement
for the security therefore.
NOW THEREFORE, BE IT RESOLVED that Boundary Adjustment and
Certificate of Compliance Application 162 BA/CC is hereby
approved subject to the following condition:
1. That the Record of Survey Map, prepared by a licensed
land surveyor or Civil Engineer and in substantial
conformance with the boundary adjustment plat
approved by the Community Advisory Board, shall be
found satisfactory and recorded by the County of San
Diego, pursuant to Section 24.70.020 of the Municipal
Code.
2. That concurrent with or prior to recordation of said
Record of Survey Map, the applicant shall submit
satisfactory evidence that title to property subject
to this adjustment has been acquired by the
applicant.
PASSED AND ADOPTED this 4th day of February, 1988, by the
