1988-18 RESOLUTION No. OE-18 A RESOLUTION OF THE OLD ENCINITAS COMMUNITY ADVISORY BOARD APPROVING A FINAL PARCEL MAP 8 FOR CONVERSION OF FOUR EXISTING RESIDENTIAL UNITS INTO A ONE LOT AIRSPACE CONDOMINIUM FORM OF OWNERSHIP, LOCATED AT 797 THIRD STREET (87-141 TPM/EXT) WHEREAS, a request for extension of a Tentative Parcel Map and approval of a Final Parcel Map was filed by Mr. Bob Lewis and Mr. Charles Elsbree for conversion of four existing residential units into a one lot airspace condominium form of ownership for the property located at 797 Third Street, legally described as Lots 9 and 10 in Block 18 of Encinitas, in the County of San Diego, State of California, according to the Map-thereof No. 148 filed in the office of the San Diego County recorder; and WHEREAS, a public hearing was conducted on the application 8 on January 7, 1988; and WHEREAS, the Community Advisory Board considered: 1. The staff report dated January 7, 1988; 2. The Tentative Map and proposed Final Parcel Map previously submitted to the County of San Diego for processlng, 3. Oral evidence submitted at the hearing, 4. written evidence submitted at the hearing. 8 CAB6-4085(12-31-87-1) NOW THEREFORE, BE IT RESOLVED that Tentative Parcel Map 8 18370 is hereby extended in accordance with Section 24.50.130 of the COE Subdivision Ordinance and Parcel Map application 87-141 PM is hereby approved subject to the following conditions: 1. Prior to recordation of a Final Map, the applicant shall submit satisfactory evidence to the Community Development Department that the provision of the State Map Act relating to notification to tenants that a conversion condominium has been applied for (Section 66452.8,.9 et.al.) have been complied with if occupancy of any one or more of the dwelling units has been allowed. 2. Each living unit shall be provided with approved detectors of products of combustion other than heat conforming to the latest U.B.C. standards, mounted on the ceiling or wall at a point centrally located in the corridor or area giving access to rooms used for sleeping purposes. 3. Maintenance of Fire Protection Systems. All fire hydrants, fire alarm systems, portable fire 8 extinguishers and other fire protective appliances shall be retained in an operable condition at all times. 4. Each unit shall have at least 200 cubic feet of enclosed weather-proofed and lockable private storage space in addition to closets customarily provided. Such space may be provided in any location approved by the Department of Planning and Community Development, but shall not be divided into two or more locations. In such cases where the subdivider can demonstrate that this standard cannot or should not reasonable be met, this standard may be modified by the authorized agency. 5. Each dwelling unit shall be separately metered for gas and electricity. A plan for equitable sharing of communal water metering shall be developed prior to final map approval and include in the covenants, conditions and restrictions. In such cases where the subdivider can demonstrate that this standard cannot or should not reasonably be met, this standard may be modified by the authorized agency. 6. A laundry area shall be provided in each unit; or if common laundry areas are provided, such facilities 8 shall consist of not less than one automatic washer and dryer for each five units or fraction thereof. In such CAB6-4086(12-31-87-1) cases where the subdivider can demonstrate that this standard cannot or should not reasonably be met, this 8 standard may be modified by the authorized agency. 7. The applicant shall furnish the Community Development Department with a Coastal Development Permit or Notice of Exemption from the California Coastal Commission prior to recordation. 8. Prior to recordation of the Parcel Map, the applicant shall obtain final occupancy approval for the structures and furnish the Community Development Department with satisfactory evidence of such approval. Note: Pursuant to City of Encinitas Subdivision Ordinance section 24.50.130, the Final Parcel Map must be recorded on or before 5:00 p.m. on May 3, 1988, or this approval will no longer be valid.
