RESOLUTION NO. OE-17
8 A RESOLUTION OF THE OLD ENCINITAS
COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW
PERMIT FOR CONSTRUCTION OF A SECOND DWELLING UNIT
ON A SITE PRESENTLY CONTAINING A SINGLE FAMILY RESIDENCE
LOCATED AT 435 THIRD STREET (87-038 DR)
WHEREAS, a request for a design review permit to allow
construction of a two story structure containing an additional
dwelling unit to be attached to an existing single family
residence at 435 Third Street was requested by applicant Peter
McBride; and
WHEREAS, a public hearing was conducted on the application
on December 10, 1987; and
WHEREAS, the Community Advisory Board considered:
8 1. The staff report dated December 4, 1987;
2. The site plans and elevations received with the
application;
3. Oral evidence submitted at the public hearing; and
4. Written evidence submitted at the public hearing; and
WHEREAS, at said hearing the Community Advisory Board found
that the proposal to be in substantial conformance with the
City's adopted design criteria subject to the conditions of
approval set forth in this resolution.
NOW THEREFORE, BE IT RESOLVED that Design Review application
87-038 DR is hereby approved subject to the following conditions:
8 1. Building plans shall indicate the following to the

satisfaction of the Department of Community Development
prior to building permit issuance:
8 a. Use of horizontal siding along all elevations of
the first floor of the new structure, with
vertical trim elements matching the proposed
exterior treatment of the second floor.
b. Replacement of the proposed sliding glass door
along the south elevation adjacent to the
"courtyard" area with solid wall containing no
widows.
c. Incorporation of a bay window along the east
elevation of the second floor.
d. Deletion of the proposed "gatehouse" in the south
front yard area.
e. Incorporation of a means of pedestrian access
within the south side yard linking the
driveway/parking area with the stairway to new
unit.
f. Revision of the proposed landscape plan to
incorporate landscaping within the front yard and
north and south side yard areas in accordance with
the City's design criteria.
8 g. Incorporation of a concrete or stone entry-way to
the new unit in place of the proposed asphalt
paving.
2. The driveway and parking area off the alley shall be of
concrete poured to City standards, to be verified by
the Community Development Department prior to final
occupancy.
3. The applicant shall obtain a Coastal Development
permit, or obtain a finding of exemption from the
California Coastal Commission, prior to building permit
l.ssuance.
