8 A RESOLUTION OF THE OLD ENCINITAS
COMMUNITY ADVISORY BOARD
APPROVING A VARIANCE FROM THE SIGN REGULATIONS
OF THE CITY'S ZONING ORDINANCE TO ALLOW
FOR A 48.75 SQ. FT. FREESTANDING DIRECTORY SIGN
AND ADDITIONAL WALL SIGNS
AT MOONLIGHT PLAZA, LOCATED AT 345 OLD HIGHWAY 101
WHEREAS, a request for a variance from the sign size
regulations contained in the zoning ordinance to allow for a
48.75 sq. ft. wall mounted directory sign at Moonlight Plaza was
applied for by Mr. Paul Rotsheck and approved by the Old
Encinitas Community Advisory Board on July 9, 1987 (87-001V); and
WHEREAS, Mr. Rotsheck is proposing with this application to
delete said wall sign and propose in its place (1) a 48.75 sq.
ft. freestanding directory sign in front of the most southerly
8 wall of Moonlight Plaza facing First street, and (2) two 12 sq.
ft. tenant identification signs attached to said wall; and
WHEREAS, a public hearing was conducted on the application
on November 19, 1987; and
WHEREAS, the CAB considered:
1. The staff report dated November 19, 1987;
2. The sign plans and elevations received with the
application;
3. Oral evidence submitted at the public hearing; and
4. Written evidence submitted at the public hearing; and
WHEREAS, at said hearing the CAB made the following findings
required under the variance provisions of the Zoning Ordinance,
subject to the conditions of approval contained in this
8 resolution:

1. The Applicant's property is subject to special
8 circumstances relative to other properties in the same
vicinity because the applicant has not taken full
advantage of the sign size allowance for monument signs
under code and they should be allowed to compensate
with a directory sign and wall signage as proposed;
2. The privilege sought by the applicant would not be
inconsistent with the limitation upon other properties
in the vicinity and zone since the applicant is not
proposing signage greater than the amount set forth in
the sign regulations.
3. This variance will not authorize a use or activity
which is not otherwise expressly authorized by the
zoning regulation governing the parcel of property;
4. The granting of this variance would grant a privilege
that is enjoyed by other property in the vicinity for
the reasons set forth in Item D of the staff report; and
NOW, THEREFORE, BE IT RESOLVED by the Old Encinitas CAB that
variance application 87-077V is hereby approved subject to the
following conditions:
8 1. A maximum of 18 sq. ft. of signage shall be allowed for
the west face of the southernmost building of the
center, in accordance with the provisions of the City's
Sign Ordinance.
2. The proposed freestanding directory sign shall be
placed in the landscaped island within the parking lot
located along the northerly border of the driveway,
perpendicular to First Street. The freestanding
directory sign shall be of a maximum 8 feet in height
and shall be of an area which) in combination with the
existing freestanding center identification sign, does
not exceed the 175 square foot limitation of the sign
ordinance.
3. A COASTAL DEVELOPMENT PERMIT OF NOTICE OF EXEMPTION THERE-
FROM SHALL BE OBTAINED PRIOR TO PERMIT ISSUANCE.
