RESOLUTION NO. OE-14
8 A RESOLUTION OF THE OLD ENCINITAS CAB
RECOMMENDING PLANNING COMMISSION APPROVAL OF A
MAJOR USE PERMIT TO ALLOW CONSTRUCTION OF A PROPOSED
PUBLIC BEACH ACCESS STAIRWAY FACILITY LOCATED BETWEEN THE
WESTERLY TERMINUS OF "D" STREET AND THE PUBLIC BEACH
WHEREAS, a request for a Major Use Permit to permit
construction of a public beach access stairway within the S-80
(open space) zone between the westerly terminus of "D" Street and
the public beach was filed by the City of Encinitas, applicant;
and
WHEREAS, a public hearing was conducted on the application
on November 19, 1987; and
WHEREAS, the CAB considered:
8 1. The geological investigation materials provided the
City by the project consultant,
2. Environmental review materials prepared by staff,
3. The Staff Report dated November 19, 1987.
4. The site and development plans for the beach access
structure.
5. Oral evidence submitted at the public hearing,
6. Written evidence submitted at the public hearing; and
WHEREAS, the CAB made the following findings of fact:
1. The location, size, design and operating
characteristics of the proposed project will be
compatible with and will not adversely affect or be
materially detrimental to adjacent uses, residences,
building, structures or natural resources for the
reasons set forth in item "1." of the Staff Report
dated November 19, 1987.
2. The proposed project will not adversely impact the
policies of the Encinitas General Plan or the
provisions of the municipal code for the reasons set
forth in item "2." of the Staff Report dated November
19, 1987.
3. The project complies with all City regulations and
8 policies for the reasons set forth in item "3." of the
Staff Report dated November 19, 1987; and

NOW, THEREFORE, BE IT RESOLVED by the Old Encinitas
8 Community Advisory Board that the CAB recommends that the
Planning Commission approve Major Use Permit application 87-
147MUP and certifies the associated Negative Declaration of
Environmental Impact 87-105EIA.
PASSED AND ADOPTED this 19th day of November, 1987, by the
following vote, to wit:

Nays: None
