8 A RESOLUTION OF
THE OLD ENCINITAS COMMUNITY ADVISORY BOARD
APPROVING A BOUNDARY ADJUSTMENT BETWEEN EIGHT LOTS
LOCATED NEAR THE NORTHEAST CORNER OF
ENCINITAS BOULEVARD AND SEEMAN DRIVE
WHEREAS, a request for a boundary adjustment among eight
parcels located near the northeast corner of Encinitas Boulevard
and Seeman Drive was filed by Guy winton Jr., engineer, on behalf
of John H. and Anne R. Clark, Franz and Liselotte Fruehwirth,
Ronald G. and Annemarie Schaffer, Gerald F. Moore, Lucille M.
Moore, Michael Lawrence Manning, Barbara Rae Taylor, and Raymond
F. and H. Helen Oesterheld, Keith and Christine M. Weatherby; and
WHEREAS, a public hearing was conducted on the application
on October 22, 1987; and
8 WHEREAS, the Community Advisory Board considered:
1. The attached boundary adjustment plat and draft record
of survey map,
2. The staff report dated October 16, 1987,
3. Oral testimony submitted at the public hearing,
4. written testimony submitted at the public hearing; and
WHEREAS, the Community Advisory Board found that the
proposed boundary adjustment will not do any of the following
pursuant to Section 24.70.060 of the Municipal Code:
A. Create a condition which does not comply with zoning
regulations, for the reasons set forth in item "A" in
the attached staff report dated October 16, 1987,
B. Create a condition which does not comply with building
regulations, for the reasons set forth in item "B" in
the attached staff report dated October 16, 1987,

C. Materially, adversely affect an agreement for the
security for the construction of public improvements,
8 for the reasons set forth in item "C" in the attached
staff report dated October 16, 1987,
D. Extend beyond the city limit boundary, for the reasons
set forth in item "D" in the attached staff report
dated October 16, 1987,
E. Require substantial alteration of any existing
improvement or creates a need for any new improvement,
for the reasons set forth in item "E" in the attached
staff report dated October 16, 1987,
F. Adjust the boundary line between lots which are subject
to an agreement for public improvements, unless the
city Engineer finds that the proposed adjustment will
not materially affect such agreement for the security
therefore, for the reasons set forth in item "Fit in the
attached staff report dated October 16, 1987.
NOW THEREFORE, BE IT RESOLVED that Boundary Adjustment
Application 87-048-BA is hereby approved subject to the following
conditions:
8 1. Prior to recordation of the Record of Survey Map, the
applicant shall furnish the community Development Department
with evidence of a Coastal Development Permit or finding of
exemption on the part of the Coastal Commission.
2. All access, private road or utility easements presently
20ft. wide or wider shall be maintained at that width in
order to provide for proper emergency vehicle access.
PASSED AND ADOPTED this 22nd day of October, 1987, by the
following vote, to wit:
Ayes: Couglar, Rollman, Tobias, Kauflin
Nays: None
