1987-12 ~ .' RESOLUTION NO. OE-12 8 A RESOLUTION OF THE OLD ENCINITAS COMMUNITY ADVISORY BOARD APPROVING A DESIGN REVIEW APPLICATION FOR THE ADDITION OF A SECOND DWELLING UNIT ON A SITE PRESENTLY CONTAINING A SINGLE FAMILY DWELLING, LOCATED AT 735 FOURTH STREET IN OLD ENCINITAS WHEREAS, an application for Design Review to permit the construction of an additional unit on a site, presently zoned RV- 15 and containing one single family home was submitted by Stephen T. Lilburn; and WHEREAS, the subject property is legally described as Lot 12 Block 31 of Encinitas, according to the Map thereof #148, filed in the office of the San Diego County Recorder on June 12, 1883; and 8 WHEREAS, a public hearing was conducted on the application on September 24 and October 22, 1987; and WHEREAS, the CAB considered: 1. The staff reports dated September 24. and October 22, 2. The proposed project development plans, 3. Oral evidence submitted at the hearing, 4. Written evidence submitted at the hearing: and WHEREAS, the Community Advisory Board found that subject to the recommended conditions of approval, the project is in substantial compliance with the City's adopted design criteria. NOW} THEREFORE, BE IT RESOLVED that Design Review application 87-040DR is hereby approved subject to the following conditions: 1. Building plans shall specify the following design - related revisions, subject to review and approval by the Community Development Department, prior to permit issuance: 8 TCjhzjCABl-292 (10-26-87) .. ., a. Incorporation of white accent trim around all windows (including the bay windows) doorways, building corners, 8 eaves, and fascia. b. Alterations in roof design at the north and south ends of the new structure to indicate construction of a smaller projecting gable element within a taller, higher gable element. c. Incorporation of Eucalyptus trees within the northeast and southeast yard areas (off the alley) of a species which maintains a lower, broader profile through maturity. 2. All light fixtures shall be designed and adjusted to reflect light downward, away from any road or street, and away from any adjoining premises, and shall otherwise conform to Sections 6322 or 6324 of the Zoning Ordinance. 3. A Coastal Permit or finding of exemption must be obtained from the California Coastal Commission prior to building permit issuance. 4. All street improvements, including curb, gutter, and sidewalk shall be secured through a Lien Contract or other instrument satisfactory to the Director of Publ ic Works in accordance with City standards prior to final occupancy. 8 5. This Design Review approval expires on October 22, 1988 (one year from date of approval except where construction or use of the property in reliance on such site plan approval h as commenced prior to its expiration.) If construction and use of the property in the reliance on a site plan approval has not commenced within the one year period, said period may be extended by the Director of Community Development at any time prior to the original expiration date.
