1987-08 ~ RESOLUTION NO. OE-8 . 4 . þ A RESOLUTION OF OLD ENCINITAS CAB APPROVING A MINOR USE PERMIT FOR A GREENHOUSE 8 LOCATED AT 843 REQUEZA STREET WHEREAS, a request for a Minor Use Permit to allow construction of a greenhouse on an approximately 2 acre site under the RS-3 zone at 843 Requeza Street was filed by David and Margaret Pruitt, applicants; and WHEREAS, a public hearing was conducted on the application on August 20, 1987; and WHEREAS, the CAB considered: 1. The Staff Report dated August 20, 1987 2. The site and development plans submitted by the applicant 3. Oral evidence submitted at the public hearing 4. Written evidence submitted at the public hearing; and WHEREAS, the CAB made the following findings of fact: 8 1. The location, size, design and operating characteristics of the proposed project will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, residences, buildings, structures or natural resources for the reasons set forth in item "1." of the Staff Report dated August 20, 1987. 2. The proposed project will not adversely impact the policies of the Encinitas General Plan or the provisions of the Municipal Code for the reasons set forth in item "2." of the Staff Report dated August 20, 1987. 3. The project complies with all City regulations and policies for the reasons set forth in item "3." of the Staff Report dated August 20, 1987. NOW THEREFORE, BE IT RESOLVED that Minor Use Permit application ZAP87-033 is hereby approved. Pursuant to Section 30.74.120 (A.) of the Municipal Code, this Use Permit approval shall be valid for 2 years, to expire at 5:00 p.m. on August 20, 1989. 8 A building permit and any other permit required for the TC/hz/CM3-312 (8-11-87) -4- .,..' .. . .. construction of the project shall be obtained within the two year period. If construction has not started within the time period 8 specified in the Uniform Building Code, and is not diligently pursued thereafter, the Use Permit shall be deemed null and void. The Director shall notify the proponent by certified mail that the Use Permit is going to expire. The Director may, upon written request by the proponent, grant reasonable extensions of up to a total of two years for the Use Permit; provided no change in City policies has occurred which would be in conflict with the project. A request for such an extension shall be filed with the Director at least 15 days prior to the expiration of the Use Permit, together with the required application fee.
