8 A RESOLUTION OF THE OLD ENCINITAS COMMUNITY ADVISORY BOARD
APPROVING A DESIGN REVIEW APPLICATION FOR AN EXTERIOR REMODEL,
REVISED LANDSCAPE PLAN, AND SIGN PROGRAM FOR THE
OLD MARKET PLACE, LOCATED AT 1010 OLD HIGHWAY 101
WHEREAS, an application for Design Review for a proposed
remodel to the exterior of the Old Market Place, including
revisions to the project's sign program and landscape plan, was
filed by Mr. Peter Kuhns;
WHEREAS, a public hearing was conducted on the application on
July 23, 1987; and
WHEREAS, the CAB considered:
1. The staff report dated July 23, 1987.
2. The project site plan and elevations received July 14,
1987.
8 3. Oral testimony submitted at the public hearing.
4. Written testimony submitted at the public hearing.
NOW THEREFORE, BE IT RESOLVED that the Old Encinitas
Community Advisory Board finds this proposal to substantially
comply with the City's adopted design criteria and that Design
Review Application 87-002DR is hereby approved subject to the
following conditions:
1. Encroachment permits shall be obtained from the Public
Works Department for awnings and any other element
projecting into the public right-of-way.

2. The eleven palm trees to be installed along the site's
frontage with Old Highway 101 shall be Queen Palms of a
8 minimum 20' trunk height, and a planting permit shall
be obtained from the City's Public Works Director prior
to the issuance of any building permits.
3. No roof mounted signs, such as the pylon mounted flags
depicted in the elevations shall be allowed pursuant to
Section 6266 (a) of the Zoning Ordinance.
4. Any future signing on the premises, apart from that
depicted in the approved sign program, shall be subject
to staff and/or CAB approval prior to permit issuance.
5. A Coastal Permit or finding of exemption must be
obtained from the California Coastal Commission prior
to building permit issuance.
PASSED AND ADOPTED this 23th day of July, 1987, by the
following vote, to wit:
