A RESOLUTION OF THE OLD ENCINITAS
COMMUNITY ADVISORY BOARD
APPROVING A VARIANCE FROM SECTION 6261
OF THE CITY'S ZONING ORDINANCE TO ALLOW
FOR A 48.75 SQ. FT. DIRECTORY SIGN
AT MOONLIGHT PLAZA, LOCATED AT 345 OLD HIGHWAY 101
WHEREAS, a request for a variance from the sign size
regulations contained in the zoning ordinance to allow for a
48.75 sq. ft. wall mounted directory at Moonlight Plaza was
applied for by Mr. Paul Rotscheck; and
WHEREAS, a public hearing was conducted on the application
on July 9, 1987; and
WHEREAS, the CAB considered:
1. The staff report dated July 9, 1987;
2. The sign plans received June 23, 1987;
3. Oral evidence submitted at the public hearing; and
4. Written evidence submitted at the public hearing.
NOW THEREFORE, BE IT RESOLVED by the Old Encinitas Community
Advisory Board that:
1. The applicants property is subject to special
circumstances relative to other lots in the same
vicinity, for the reasons set forth in Item A of the
staff report;
2. The privilege sought by the applicant is not
inconsistent with the limitation upon other properties
in the vicinity and zone, for the reasons set forth in
Item B of the staff report;
3. The variance will not be granted for the parcel of
property which authorizes a use or activity which is
not otherwise expressly authorized by the zoning
regulation governing the parcel of property, for the
reasons set forth in Item C of the staff report;
4. The granting of this variance would grant a privilege
that is enjoyed by other property in the vicinity for
the reasons set forth in Item D of the staff report;
and

5. The application for variance V85-254 is hereby
APPROVED.
PASSED AND ADOPTED this 9th day of July, 1987, by the
