In compliance with your letter of August 3, 1988, I have
corrected Resolution 87-37 to show that the Statser Annexation
was included with the Patricia Wanket et al Annexation, which
correctly reflects the Board's action since the Statser
annexation legal description and map were a part of Resolution
87-37 which the Board adopted October 14, 1987.
Enclosed herewith are six certified copies of the corrected
Resolution 87-37; a copy of the memo to San Diego County
requesting a check for $160 to be sent to LAFCO; the completed
Certificate of terms and conditions and indebtedness; and a
copy of LAFCO Resolution approving the Statser Annexation.
I hope this will complete the process on the Statser
Annexation.

OF THE COUNTY OF SAN DIEGO
MAKING DETERMINATIONS AND APPROVING THE
"ST A TSER ANNEXATION" TO THE CARDIFF SANITATION DISTRICT
On motion of Commissioner Mahr, seconded by Commissioner Hersom, the
following resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the CardiH Sanitation District, which resolution was
adopted by the Board of Directors oC said District as Resolution No. 87-22, dated
May 8, 1987, pursuant to Title 5, Division 3, commencing with Section 56000 of the
Government Code; and .
WHEREAS, the terri tory proposed for annexation - is as described in the
application on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on
said annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission finds, pursuant to Section l5319(b) of the State CEQA
Guidelines, that this annexation' is not subject to the environmental impact evaluation
process because the proposal area is undeveloped, but is of the minimum size for the
construction/installation of new small facilities as defined by Section 15303.
(2) The Commission herebý approves the annexation with modified boundaries,
as described in Exhibit A attached hereto.
(3) The boundaries of the territory as described in Exhibit A are definite
and certain.
(4) The boundaries of the territory do conform to lines of assessment and
ownership.

(5) The district is a registered-voter district. - -
(6) The territory includes 1.18 acres and is uninhabited.
(7) The territory proposed to be annexed is hereby designated the "Statser
- - Ann_exa~ion~ to the Cardiff Sanitation District.
(8) The Commission hereby designates the Cardiff Sanitation District as the
conducting authority and authorizes the Board of Directors to initiate proceedings in
compliance with this resolution without notice and hearing.
(9) The Executive Officer is hereby authorized and directed to mail certified
copies of this resolution as provided in Section 56853 of the Government Code.

CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
PATRICIA WANKET ET AL ANNEXATION & STATSER ANNEXATION
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on April 1, 1987 as Resolution No. 87-
16, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission: and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation commission of San Diego County on July 6, 1987, and
this District was designated as the conducting district and
authorized by resolution to order said annexation without notice
or hearing and without an election pursuant to Government Code,
section 56837; NOW THEREFORE
IT IS RESOLVED, ORDERED AND DETERMINED, pursuant to
Government Code section 57025 et seq.:
(a) The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this Board as
stated above.
(b) The territory to be annexed has been designated the
Wanket et al Annexation & Statser Annexation by the Local Agency
Formation commission, and the exterior boundaries of such territory
are as hereinafter described.

(c) The territory proposed to be annexed is uninhabited,
and will be benefited by such annexation as described in Health
and Safety Code Section 4830.
(d) The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said District
is proposed to be developed and used for residential
andlor commercial purposes and provision for sewage
disposal facilities for said territory is essential for
such purposes.
(e) The terms and conditions of the proposed annexation
are: None
(f) All the owners of land within such territory have given
their written consent to such annexation, as provided in
Government Code, Section 56837; and therefore, as approved and
authorized by the Local Agency Formation Commission, this Board
may adopt its resolution ordering the annexation without notice
and hearing and without an election, as provided in Government
Code, Section 57002.
(g) The regular County assessment roll will be utilized and
the affected territory will be taxed for existing bonded
indebtedness.
(h) Pursuant to State CEQA Guidelines section 150303
(California Environmental Quality Act of 1970), the Board finds
that this annexation is not subject to the environmental impact
evaluation because it is categorically exempt as a project

initiated for the purpose of making sewer service available to
new construction or conversion of small structures.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code section 57002, the following described
unincorporated territory in the County of San Diego, State of
California, be and it hereby is annexed to and made a part of the
Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certified copy of this resolution along
with a remittance to cover the fees required by the Government
Code Section 54902.5 to the Executive Officer of the Local Agency
Formation Commission of San Diego County, so that the Executive
Officer may make the filings required by Chapter 8 (commencing
with Section 57200), Part 5, Division 1, Title 6 of the
Government Code and by Chapter 8 (commencing with Section 54900),
Part 1, Division 2, Title 5 of the Government Code.

Steve Seibert from the County of San Diego has been in touch
with me to try to clarify the status of the Statser Annexation.
I checked back through our records and verified that it was
combined with the Patricia Wanket, et al Annexation. The
Resolution Annexing the territory (certified copy enclosed) and
the material presented to the Board on October 14, 1987 are
clear on this. The error apparently was mine in that I
neglected to send back to LAFCO the papers we had received from
LAFCO on the Staser Annexation. They are enclosed herewith. I
hope this will clear up any possible remaining question in the
matter. If not, and I can help you in any further way, please
let me know.

HAS ADOPTED A RESOLUTION APPROVING
THE "STATSER ANNEXATION" TO THE
CARDIFF SANITATION DISTRICT
The following filings to be made after the conducting authority has
ordered the change(s) of organization (boundary change(s)) must be pro-
cessed by the LAFCO office:
1. County Recorder
2. County Assessor
3. County Surveyor
4. County Auditor
5. State Board of Equalization
Any other filings remain the responsibility of the conducting authority.
Proceedings must be initiated within 35 days after adoption of the Com-
mlssion's resolution, and completed within one year after LAFCO approval,
or the proposal must be considered abandoned (Calif. Govt. Code Sects.
57001 and 57002).
If your Board/Council adopts a resolution/ordinance ~ordering ,the boundary
change (s), the following materials must be forwarded to the LAFCO office:
1. Six (6) certified copies of the resolution/ordinance, includinG
the approved leGal description and map, with original signa-
tures on each certification paGe.
2. Certificate Re: Terms & Conditions and Indebtedness (use
attached form). Please return signed, original copy.
3. State Board of Equalization fee in the amount of $ 160 00
(make checks payable to "State Board of Equalization").
NOTE: Filings received in the LAFCO office after November 15
and to be filed by December 31 must include an additional 10%,
as required by Section 3 (f) of the State Board of Equalization
Schedule of Processing Fees effective July 1, 1984.
The Executive Officer will check all documents for compliance before
filings are made. Amendments to the LAFCO resolution, including boundary
modifications, can only be made by the Commission. All documents re-
corded and copies of letters of acknowledgment will be returned to the
conducting authority.

RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION
OF THE COUNTY OF SAN DIEGO
MAKING DETERMINATIONS AND APPROVING THE
"ST A TSER ANNEXATION" TO THE CARDIFF SANITATION DISTRICT
On motion of Commissioner Mahr, seconded by Commissioner Hersom, the
following resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the Cardit1f Sanitation District, which resol u tion was
adopted by the Board of Directors of said District as Resolution No. 87-22, dated
May 8, 1987, pursuant to Title 5, Division 3, commencing with Section 56000 of the
Government Code; and .
WHEREAS, the territory proposed for annexation - is as described in the
application on file with the Local Agenc} Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on
said annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission finds, pursuant to Section 15319(b) of the State CEQA
Guidelines, that this annexation' is not subject to the environmental impact evaluation
process because the proposal area is undeveloped, but is of the minimum size for the
construction/installation of new small facilities as defined by Section 15303.
(2) The Commission herebý approves the annexation with modified boundaries,
as described in Exhibit A attached hereto.
(3) The boundaries of the territory as described in Exhibit A are definite
and certain.
(4) The boundaries of the territory do conform to lines of assessment and
. ownership.

(5) The district is a registered-voter district. -
(6) The territory includes 1.18 acres and is uninhabited.
(7) The territory proposed to be annexed is hereby designated the IIStatser
Ann_exa!ion~ to the Cardiff Sanitation District.
(8) The Commission hereby designates the Cardiff Sanitation District as the
conducting authority and authorizes the Board of Directors to initiate proceedings in
compliance with this resolution without notice and hearing.
(9) The Executive Officer is hereby authorized and directed to mail certified
copies of this resolution as provided in Section 56853 of the Government Code.

WHEREAS, pursuant to the cortese-Ì~nox Local Government
Reorganization Act of 1985 (Govt. Code, Section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on April 1, 1987 as Resolution No. 87-
16, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, the ônnexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commiss:Íf)n of San Diego County on July 6, 1987, and
thi6 [,istrict was designated as the conducting district and

authorized by resolution to order said annexation ~ithout notice
or hearing and without an election pursuant to Government Code,
section 56837; NOW THEREFORE
IT IS RESOLVED, ORDERED AND DETERMINED, pursuant to
Government Code section 57025 et seq.:
(a) The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this Board as
stated above.
(b) The territory to be annexed has been designated the
Wanket et al Annexation by the Local Agency Formation Commission,
and the ex~erior boundaries of such ter~itory are as hereinafter
described.

(c) The territory proposed to be annexed is uninhabited,
and will be benefited by such annexation as described In Health
and Safety Code Section 4830.
(d) The reasons for the proposed annexation as set forth In
the resolution of application referred to above are:
1. The District is empowered to and lS engaged In
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said District
is proposed to be developed and used for residential
and/ or commercial purposes and provision for sewage
disposal facilities for said territory is essential for
such purposes.
(e) The terms and conditions of the proposeè. annexation
are: None
(f) All the owners of land within such territory have given
their written consent to such annexation, as provided In
Government Code, section 56837; and therefore, as approved and
authorized by the Local Agency Formation Commission, this Board
may adopt its resolution ordering the annexation without notice
and hearing and without an election, as provided in Government
Code, Section 57002.
(g) The regular County assessment roll will be utilizeè and
the affected territory will be taxed for existing bonded
indebtedness.
(h) Pursuant to State CEQA Guidelines Section 151:203
(California Environmental Quality Act of 1970), the Board finàs
that this annexation lS not subject to the environmental impact
evaluation because it is categorically exempt as a project.

immediately transmit a certified copy of this resolution along
wi th a remit tânce to cover the fees required by the Government
Code section 54902.5 to the Executive Officer of the Local Agency
Formation Commission of San Diego County, so that the Executive
Officer may make the filings required by Chapter 8 (commencing
v.7ith Section 57200), Part 5, Division 1, Title 6 of the
Governm~Dt Code and by Chapter 8 (commencing with section 54900),
Part 1, Division 2, Title 5 of the Government Code.

RESOLUTION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
PATRICIA WANKET ET AL ANNEXATION
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on April 1, 1987 as Resolution No. 87-
16, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diego County on July 6, 1987, and
this District was designated as the conducting district and
authorized by resolution to order said annexation without notice
or hearing and without an election pursuant to Government Code,
section 56837; NOW THEREFORE
IT IS RESOLVED, ORDERED AND DETERMINED, pursuant to
Government Code Section 57025 et seq.:
(a) The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this Board as
stated above.
(b) The territory to be annexed has been designated the
Wanket et al Annexation by the Local Agency Formation Commission,
and the exterior boundaries of such territory are as hereinafter
described.

. . (c) The territory proposed to be annexed is uninhabited,
and will be benefited by such annexation as described in Health
and Safety Code Section 4830.
(d) The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said District
is proposed to be developed and used for residential
and/or commercial purposes and provision for sewage
disposal facilities for said territory is essential for
such purposes.
(e) The terms and conditions of the proposed annexation
are: None
(f) All the owners of land within such territory have given
their written consent to such annexation, as provided in
Government Code, section 56837; and therefore, as approved and
authorized by the Local Agency Formation Commission, this Board
may adopt its resolution ordering the annexation without notice
and hearing and without an election, as provided in Government
Code, Section 57002.
(g) The regular County assessment roll will be utilized and
the affected territory will be taxed for existing bonded
indebtedness.
(h) Pursuant to State CEQA Guidelines Section 150303
(California Environmental Quality Act of 1970), the Board finds
that this annexation is not subject to the environmental impact
evaluation because it is categorically exempt as a project

" initiated for the purpose of making sewer service available to
new construction or conversion of small structures.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code Section 57002, the following described
unincorporated territory in the County of San Diego, State of
California, be and it hereby is annexed to and made a part of the
Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certified copy of this resolution along
wi th a remittance to cover the fees required by the Government
Code section 54902.5 to the Executive Officer of the Local Agency
Formation Commission of San Diego County, so that the Executive
Officer may make the filings required by Chapter 8 (commencing
with Section 57200), Part 5, Division 1, Title 6 of the
Government Code and by Chapter 8 (commencing with section 54900),
Part 1, Division 2, Title 5 of the Government Code.
ADOPTED this 14rh day of October , 1987 by

This is a request to annex 4.24 acres into the Cardiff Sanitation
District. Annexation is required in order to provide sewer service for
six single family dwellings~
RECOMMENDATIONS: That your Board
1. Adopt the resolutions of the Board of Directors of the Cardiff Sanita-
tion District annexing territory to the District.
Discussion:
This proposed annexation is in conformance with your Board 's pol icy
on annexations, as six legal lots requesting sewer service for a
single family dwelling on each lot (condition 4). All the lots (4.17
acres) have existing dwellings being served by failing or marginally
functioning septic systems. Five of the lots are developed to the
density allowed by current zoning. The remaining lot could be split;
however, the owner has no plans to subdivide at this time.
On April 1. 1987, your Board adopted a Resolution of Appl ication for
annexation of territory to the Sanitation District.

RESOLUTION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
PATRICIA WANKET ET AL ANNEXATION
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on April 1, 1987 as Resolution No. 87-
16, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diego County on July 6, 1987, and
this District was designated as the conducting district and
authorized by resolution to order said annexation without notice
or hearing and without an election pursuant to Government Code,
Section 56837; NOW THEREFORE
IT IS RESOLVED, ORDERED AND DETERMINED, pursuant to
Government Code section 57025 et seq.:
(a) The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this Board as
stated above.
(b) The territory to be annexed has been designated the
Wanket et al Annexation by the Local Agency Formation commission,
and the exterior boundaries of such territory are as hereinafter
described.

(c) The territory proposed to be annexed is uninhabited,
and will be benefited by such annexation as described in Health
and Safety Code Section 4830.
(d) The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged ln
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said District
is proposed to be developed and used for residential
andlor commercial purposes and provision for sewage
disposal facilities for said territory is essential for
such purposes.
(e) The terms and conditions of the proposed annexation
are: None
(f) All the owners of land within such territory have given
their written consent to such annexation, as provided in
Government Code, Section 56837; and therefore, as approved and
authorized by the Local Agency Formation Commission, this Board
may adopt its resolution ordering the annexation without notice
and hearing and without an election, as provided in Government
Code, Section 57002.
(g) The regular County assessment roll will be utilized and
the affected territory will be taxed for existing bonded
indebtedness.
(h) Pursuant to state CEQA Guidelines section 150303
(California Environmental Quality Act of 1970), the Board finds
that this annexation is not subject to the environmental impact
evaluation because it is categorically exempt as a project

initiated for the purpose of making sewer service available to
new construction or conversion of small structures.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code section 57002, the following described
unincorporated territory in the County of San Diego, state of
California, be and it hereby is annexed to and made a part of the
Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certified copy of this resolution along
with a remittance to cover the fees required by the Government
Code section 54902.5 to the Executive Officer of the Local Agency
Formation Commission of San Diego County, so that the Executive
Officer may make the filings required by Chapter 8 (commencing
with section 57200), Part 5, Division 1, Title 6 of the
Government Code and by Chapter 8 (commencing with section 54900),
Part 1, Division 2, Title 5 of the Government Code.

RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION
OF THE COUNTY OF SAN DIEGO
MAKING DETERMINATIONS AND APPROVING THE
"w ANKET ET AL. ANNEXATION" TO THE
CARDIFF SANITATION DISTRICT
On motion of Commissioner Mahr, seconded by Commissioner Hersom, the
following resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the Cardiff Sanitation District, which resolution was
adopted by the Board of Directors of said District as Resolution No. 87-16, dated
April 1, 1987, pursuant to Title 5, Division 3, commencing with Section 56000 of the
Government Code; and
WHEREAS, the territory proposed for annexation is as described in the
application on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on
said annexation, which report was received and eonsidered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission ce~tifies that the determination by the City of Encinitas
that this annexation is exempted by State CEQA Guidelines Sections 15303 and 15061
from the requirements of CEQA has been reviewed and considered.
(2) The Commission hereby approves the annexation with modified boundaries,
as described in Exhibit A attached hereto.
(3) The boundaries of the territory as described in Exhibit A are definite
and certain.
(4) The boundaries of the territory do conform to lines of assessment and
ownership. ~
(5) The district is a registered-voter district.
(6) The territory includes 3,06 acres and is uninhabited.
(7) The territory proposed to be annexed is hereby designated the "Wanket et
al. Annexation" to the Cardiff Sanitation District.
(8) The Commission hereby designates the Cardiff Sanitation District as the
conducting authority and authorizes the Board of Directors to initiate proceedings in
compliance with this resolution without notice and hearing.
(9) The Executive Officer is hereby authorized and directed to mail certified
copies of this resolution as provided in Section 56853 of the Government Code.

4. PUBLIC HEARINGS
A. Adoption of Ordinance 87-06 increasinq Connection Fee and
Annexation Use Fee.
Dan Peterka asked questions about and spoke in opposition to
adoption of the Ordinance.
Elaine McElmury spoke on behalf of the Wanket Annexation Group.
She asked the Board to either make a determination that the group
fulfilled the requirements for having completed their application
for annexation and connection in time to comply with the current
fee structure, or that that the application for connection be
accepted at this time and the fees held until the annexation was
completed. She said that the delays to their application had been
none of their doing.
Board Manager Shafer stated their application was complete and was
received by LAFCO. That appeared to be sufficient evidence that
they would meet the test of the ordinance to include them under the
old annexation and connection fees

SUBJECT: Petition of James Statser for Annexation to the Cardiff
Sanitation District
This is a request to annex 1.09 acres into the Cardiff Sanitation
District. Annexation is required in order to provide sewer
services for one single family dwelling.
RECOMMENDATION
1. Find pursuant to State CEQA Guidelines that this project
is categorically exempt from the evaluation.
2. Adopt the resolution of application of the Board of Director
of the Cardiff Sanitation District for annexation to the
district.
8 DISCUSSION
This annexation was included in the Board report for the Wanket et
al annexation and was approved by your Board March 2, 1987.
However, the resolution sent to LAFCO did not include the parcel
number for Mr. Statser.
Approval of the enclosed resolution will allow the annexation to
continue. Mr. Statser has 1.09 acres that could be split into two
parcels but has no plans to do so at this time.

RESOLUTION OF APPLICATION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
JAMES STATSER ANNEXATION
WHEREAS, this Board of Directors has received a request from
James Statser (DoCument No. -----------) that the hereinafter
described territory to be annexed to the Cardiff Sanitation
District (hereinafter referred to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code sections 56800 and 56700,
application is hereby made to the Local Agency Formation
Commission of the County of San Diego for a proposed
change of organization as follows:
A. This proposal is made pursuant to the Cortese-Knox
Local Government Reorganization Act of 1985 (Sec.
56000, et. seq., Govt. Code).
B. The nature of the proposed change of organization
and the names of all districts for which any such
change of organization is proposed as follows:
The annexation of the hereinafter described
territory to the Sanitation District.
C. The names of all other affected counties, cities and
districts are: None.
D. A description of the exterior boundaries of the
territory proposed to be annexed to the Sanitation
District is described in Exhibit "A" hereto
attached.
E. Said territory is uninhabited and comprises
approximately 1. 09 acres.
F. It is proposed that said territory to be annexed
subject to the following conditions: None.
G. All owners of land within such territory have given
their written consent to such annexation subject to

H. The reasons for this proposal are as follows:
( 1) The Sanitation District is empowered to and IS
engaged In furnishing sewage disposal
facilities.
( 2) The territory proposed to be annexed to said
District is proposed to be developed and used
for residential and/or commercial purposes and
provision for sewage disposal facilities for
said territory is essential for such purposes.
1. It is hereby requested that proceedings be taken for
the annexation of territory as hereinabove proposed.
J. This annexation is consistent with the sphere of
influence of the Sanitation District, which is the
only affected city or district.
2. The Board finds, pursuant to section 15061 of the State
CEQA Guidelines, that this annexation is not subject to
the environmental impact evaluation process because it
can be seen with certainty that there is no possibility
that the acti vi ty in question may have a significant
effect on the environment.
3. The Clerk of the Board of Directors IS hereby authorized
and directed to file a certified copy of this resolution
with the Executive Officer of the Local Agency Formation
Commission of the County of San Diego.

Subject: Petition of Patricia Wanket et ale for Connection to the
Cardiff Sanitation District
We are submitting an application for connection to the Cardiff
Sanitation District. The application is for five dwelling units
currently undergoing annexation. A recommendation for annexation
has been received from the San Diego County Department of Public
Works and the Cardiff Sanitation Board. The application is
currently under review by LAFCO. Since the request is for existing
dwellings being served by failing or marginally functioning septic
systems, approval by LAFCO is only a matter of the time involved in
processing and formal approval. Work is already underway on the
main line which will connect these properties to the sewer trunk
line (these property owners have all participated in construction
costs for this new line).
Due to delays caused by a) the sewer annexation moratorium, b) added
Board approval requirements and c) time delays inherent in LAFCO
processing, final formal approval for annexation may not occur until
August, even though these five property owners initiated annexation
procedures in January.
Although applications for connection are not normally accepted until
after annexation is complete, we are requesting an exception so that
payment can be made prior to the July cutoff in order to connect
under the current fee schedule. We feel an exception should be made
in our case because:
* Acts by the Board have created unique delays in annexation
processing which may cause the annexation process to extend
beyond six months.
* Approval for annexation is subject only to the time involved
in processing since all other criteria for annexation: need,
funding, recommendations, EIS, etc. have been met.
* These property owners have already budgeted for and, in most
cases, refinanced their homes according to the fees in effect
at the start of annexation. An unanticipated increase of
$2,000 or more for connection fees would create financial
difficulty for some of these families. They would be caught
in a situation where they have already invested a considerable
sum in construction costs and annexation fees but would be
unable to actually connect to the sewer.
In light of these considerations, we are asking that you accept and
begin processing our application for sewer connection. Could you
please put this request on the agenda for the next Board meeting.

Board Manager Shafer stated that the Patricia Wanket petition for
annexation to Cardiff Sanitation District was consistent with Board
policy.
Dan Peterka asked what today's proposed action by the Board meant.
Board Manager Shafer explained that LAFCO had asked that before
they processed petitions for annexation, the Cardiff sanitation
District Board first adopt a resolution approving each application.
They would then know, in 1 ight of the capacity issue, that this
Board did approve of the proposed annexation. Mr. Peterka stated
he would appreciate any action to expedite the annexation.

D. Approval of Purchase and Installatif)n of San Eliio Influent
Meter in the Amount of $35,000.
Interim city Engineer Hoffland stated this meter would measure all
flow into the plant from all angles. He said he was sure the
Regional Water Quality Control Board would accept its readings of
the effluent even though it would be on the influent side of the
plant. In addition there was a contract for the Olivenhain pump
station, which it was hoped would be installed in a matter of
months, which would add another meter so that each separate line
would then be also met.ered, providing a check. Board Manager
Shafer stated when enough information had been gathered for an
accurate report as to what had happened a report back to the Board
would be made.
Omsted moved, Gaines seconded, carried unanimously to approve
purchase and installation of an influent meter at San E1ijo at a
cost of $35,000.
E. Consideration of Increasinq Enqineerinq Services Contract from
$90,007 to $145,007 to Perform Emeraencv ReDairs to San Eliio Ocean
Outfall.
Interim City Engineer Hoffland stated that prior to a contract with
Atkinson Co. for major repairs to the ocean outfall, there was a
contract with Engineering Sciences Co. for engineering services
which provided diving and minor rock repair to support the ocean

WHEREAS, this Board of Directors has received a request from
patricia Wanket el al (Document No. ) that the hereinafter
described territory to be annexed to the Cardiff Sanitation
District (hereinafter referred to as the Sanitation District); and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code sections 56800 and 56700,
application is hereby made to the Local Agency Formation Commission
of the County of San Diego for a proposed change of organization as
follows:
A. This proposal is made pursuant to the Cortese-Knox Local
Government Reorganization Act of 1985 ($56000, et. seq., Govt.
Code).
B. The nature of the proposed change of organization and the
names of all districts for which any such change of organization is
proposed as follows:
The annexation of the hereinafter described territory to the
Sanitation District.
C. The names of all other affected counties, cities and
districts are:

proposed to be annexed to the Sanitation District is described in
Exhibit "A" hereto attached.
E. Said territory is uninhabited and comprises approximately
3.08 acres.

G. All the owners of land within such territory have given
their written consent to such annexation subject to the
aforementioned terms and conditions.
H. The reasons for this proposal are as follows:
(1) The Sanitation District is empowered to and is
engaged in furnishing sewerage disposal facilities.
( 2) The territory proposed to be annexed to said
District is proposed to be developed and used for residential
and/or commercial purposed and provision for sewage disposal
facilities for said territory is essential for such purposes.
I. It is hereby requested that proceedings be taken for the
annexation of territory as hereinabove proposed.
J. This annexation is consistent with the sphere of influence
of the Sanitation District, which is the only affected city or
district.
2. The Board finds, pursuant to Article 19, section 15303 of
the State EIR Guidelines, that this annexation is not subject to
the environmental impact evaluation process because it is
categorically exempt as a project initiated for the purpose of

of small structures.
3. The Clerk of the Board of Directors is hereby authorized
and directed to file a certified copy of this resolution with the
Executive Officer of the Local Agency Formation Commission of the
County of San Diego.

1. Population, density, land area and land use, per capita
assessed valuation, topography, natural boundaries. drainage
basins, proximity to populated areas, likelihood of significant

2. Need for organized community services, present cost and
adequacy of government services and controls, probable future
needs, probable effect of change of organization and of alter-
native courses of action on the cost and adequacy of services
and controls in the area and adjacent areas.
3. The effect of the proposed action and of alternative actions
on adjacent areas, on mutual social and econocic interests
and on the local governmental structure of the county.
4. Conformity of the proposal and its effects with c~ission
policies on providing planned, orderly, efficient patterns of
urban development and with state policies and priorities on
conversion of open-space lands to other uses.

integrity of lands in an agricultural preserve in open-space

The following filings to be made after the conducting authority has
ordered the change(s) of organization (boundary change(s» must be pro-
cessed by the LAFCO office:

5. State Board of Equalization
Any other filings remain the responsibility of the conducting authority.
Proceedings must be initiated within 35 days after adoption of the Com-
mission's resolutiòn, and completed within one year after LAFCO approval,
or the proposal must be considered abandoned (Calif. Govt. Code Sects.

On motion of Commissioner Mahr, seconded by Commissioner Hersom, the
following resolution is adopted:
WHEREAS, a resolution of application was submitted to this Çommission for
annexation of territory to the Cardiff Sanitation District, which resolution was
adopted by the Board of Directors of said District as Resolution No. 87-22, dated
May 8, 1987, pursuant to Title 5, Division 3, commencing with Section 56000 of the
Government Code; and
WHEREAS, the territory proposed for annexation is as described in the
application on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on
said annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission finds, pursuant to Section 15319(b) of the State CEQA
Guidelines, that this annexation is not subject to the environmental impact evaluation
process because the proposal area is undeveloped, but is of the minimum size for the
construction/installation of new small facilities as defined by Section 15303.

(2) The Commission hereby approves the annexation with modified boundaries,
as descriþed in Exhibit A attached hereto.
(3) The boundaries of the territory as described in Exhibit A are definite
and certain.
(4) The boundaries of the territory do conform to lines of assessment and
ownership.
(5) The district is a registered-voter district.
(6) The territory includes 1.18 acres and is uninhabited.
(7) The territory proposed to be annexed is hereby designated the "Statser
Annexation" to the Cardiff Sanitation District.
(8) The Commission hereby designates the Cardiff Sanitation District as the
conducting authority and authorizes the Board of Directors to initiate proceedings in
compliance with this resolution without notice and hearing.
(9) The Executive Officer is hereby authorized and directed to mail certified
