B. Request by Terral Investment Co. for District to
Consider Use of Eminent Domain for Construction of a
Sewer Line.
Board Manager Shafer requested direction from the Board as to use
r..'f eminent domain to obtain the necessary easements for the
installation of a sanitary sewer line for the Terral Investment.
Gus Theberge, Terral Investment Company, requested the Board to
use eminent domain and offered his assistance to that end. Mr.
Theberge requested that the necessary forms be provided at the
next meeting to expedite this process.
The Board Manager was directed to draft a policy for use of
eminent domain procedures, but not as applied to this specific
project, for consideration at the next meeting.
Board Member Gaines left the meeting at 6:08 P.M.
C. Removal and Installation of Boiler at San Eli-;o \'¡ater
Pollution Control Facility.
Interim City Engineer Hoffland reported to the Board that there
was an existing hot water boiler that needed to be removed, the
installation of a new boiler was necessary and had been budgeted.
Steel moved, Omsted Seconded to approve the request as stated in
a memo dated June 5, 1987 from Granville Bowman, County Director
of Public Works. Motion carried. Ayes: Omsted, Luke, Shea,
Steel. Absent: Gaines.
8. ADJOURNMENT
Chairman Shea declared the meeting adjourned at 6:10 P.M.

A. Consideration of Resolution 87-09 Annexinq Terral
Subdivision, 159.34 acres.
Omsted moved, Luke seconded to adopt Resolution 87-09 annexing
Terral Subdivision.
Board Member Gaines stated she would like to see the plans for the
layout of the sewer lines.
Board Member Luke stated he was unsure whether his firm had worked
on this project and he would, therefore, disqualify himself from
voting.
Motion carried with Gaines, omsted, steel voting aye, Luke
abstaining.
B. Consideration of Applications for Annexation
1. Resolution 87-10, H.G. Frankland, 2.68 Acres
Omsted moved, Luke seconded to adopt Resolution 87-10 applying for
annexation of territory to the Cardiff sanitation District, with
the finding that the project was categorically exempt from
environmental quality review. Staff was asked to direct to the
Planning Department information that this property is prone to
landslides. Motion carried unanimously.
2. Resolution 87-11, Georqe smith, 0.37 Acres
Luke moved, Omsted seconded, carried unanimously to adopt
Resolution 87-11, applying for annexation to the Cardiff
sanitation District, with the finding that it would have no
significant effect on the environment and meets the requirements
for a negative declaration.
3. Resolution 87-12, McBride-Elder, 21.67 Acres
Omsted moved, Luke seconded, carried unanimously to adopt
Resolution 87-12, applying for annexation to the Cardiff sanitation

RESOLUTION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
TERRAL SUBDIVISION ANNEXATION
On motion of Director Omsted seconded by Director
Luke the following resolution is adopted:
,
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 56000 et seq.)
preliminary proceedings were commenced by resolution of application
by this Board on December 1, 1981 as Resolution No. SAN-7, for
annexation to the Cardiff Sanitation District (thereinafter
referred to as the District) of certain territory therein
described, which description has been modified pursuant to the
directions of the Local Agency Formation Commission; and
. WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diego County on April 1, 1985, and this
District was designated as the conducting district and authorized
by resolution to order said annexation without notice or hearing
and without an election pursuant to Government Code, Section 56837;
NOW THEREFORE
IT IS RESOLVED, ORDERED AND DETERMINED, pursuant to Government
Code section 57025 et seq.:
(a) The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this Board as
stated above.

(b) The territory to be annexed has been designated the

Terral Subdivision Annexation by the Local Agency Formation
Commission, and the exterior boundaries of such territory are as
hereinafter described.
(c) The territory proposed to be annexed is uninhabited, and
will be benefited by such annexation as described in Health and
Safety Code section 4830.
(d) The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged in furnishing
sewage disposal facilities.
2. The territory proposed to be annexed to said District is
" proposed to be developed and used for residential and/or
commercial purposes and provision for sewage disposal
facilities for said territory is essential for such
purposes.
(e) The terms and conditions of the proposed annexation are:
None
(f) . All the owners of land within such territory have given
their written consent to such annexation, as provided in
Government Code, section 56837; and therefore, as
approved and authorized by the Local Agency Formation
Commission, this Board may adopt its resolution ordering
the annexation without notice and hearing and without an
election, as provided in Government Code, section 57002.

(g) The regular County assessment role will be utilized and
the affected territory will be taxed for existing bonded
indebtedness.
(h) The Board certifies, in accordance with Section 15064 of
the state CEQA Guidelines (California Environmental
Quality Act of 1970), that it has reviewed and considered
the information contained in the Environmental Impact
Report dated June 28, 1979 and revised July 19, 1979 and
prepared by the County of San Diego with respect to the
project designated Terral Subdivision, TM 3904 EAD Log
No. 78-8-286.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to Government
Code Section 57002, the following described unincorporated
territory in the County of San Diego, State of California, be and
it hereby is annexed to and made a part of the Cardiff Sanitation
District. t
IT IS FURTHER ORDERED that the Clerk of this Board immediately
transmit a certified copy of this resolution along with a
remittance to cover the fees required by the Government Code
Section 54902.5 to the Executive Officer of the Local Agency
Formation Commission of San Diego County, so that the Executive
Officer may make the filings required by Chapter 8 (commencing with
Section 57200), Part 5, Division 1, Title 6 of the government Code
and by Chapter 8 (commencing with Section 54900), Part 1, Division
2, Title 5 of the Government Code.

San Marcos County above-cited annexation. Our policy requires that we

Alternate Members However, there are some other processing problems that

District approval. The third paragraph outlines the items that
George F. Bailey must be forwarded to us. No. 1 requires that six (6)

CARDIFF SANITATION DISTRICT
The following filings to be made after the conducting authority has
ordered the change(s) of organization (boundary change(s) must be pro-
cessed by the LAFCO office:
1. County Recorder
2. County Assessor
3. County Surveyor
4. County Auditor
5. State Board of Equalization
Any other filings remain the responsibility of the conducting authority.
Proceedings must be initiated within 35 days after adoption of the Com-
m~ssion's resolution, and completed within one year after LAFCO approval,
or the proposal must be considered abandoned (Calif. Govt. Code Sects.
35201/54799.2/56292).
If your Board/Council adopts a resolution/ordinance ordering the boundary

RESOLUTION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
TERRAL SUBDIVISION ANNEXATION
On motion of Director Omsted seconded by Director
Luke the following resolution is adopted:

WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 56000 et seq.)
preliminary proceedings were commenced by resolution of application
by this Board on December 1, 1981 as Resolution No. SAN-7, for
annexation to the Cardiff Sanitation District (thereinafter
referred to as the District) of certain territory therein
described, which description has been modified pursuant to the
directions of the Local Agency Formation Commission; and
, WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diego County on April 1, 1985, and this
District was designated as the conducting district and authorized
by resolution to order said annexation without notice or hearing
and without an election pursuant to Government Code, section 56837;
NOW THEREFORE
IT IS RESOLVED, ORDERED AND DETERMINED, pursuant to Government
Code section 57025 et seq.:
(a) The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this Board as
stated above.

(b) The territory to be annexed has been designated the
Terral Subdivision Annexation by the Local Agency Formation
Commission, and the exterior boundaries of such territory are as
hereinafter described.
(c) The territory proposed to be annexed is uninhabited, and
will be benefited by such annexation as described in Health and
Safety Code Section 4830.
(d) The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged in furnishing
sewage disposal facilities.
2. The territory proposed to be annexed to said District is
proposed to be developed and used for residential and/or

commercial purposes and provision for sewage disposal
facilities for said territory is essential for such
purposes.
(e) The terms and conditions of the proposed annexation are:
None
(f) All the owners of land within such territory have given
their written consent to such annexation, as provided in
Government Code, Section 56837; and therefore, as
approved and authorized by the Local Agency Formation
Commission, this Board may adopt its resolution ordering
the annexation without notice and hearing and without an
election, as provided in Government Code, Section 57002.

(g) The regular County assessment role will be utilized and
the affected territory will be taxed for existing bonded
indebtedness.
(h) The Board certifies, in accordance with section 15064 of
the State CEQA Guidelines (California Environmental
Quality Act of 1970), that it has reviewed and considered
the information contained in the Environmental Impact
Report dated June 28, 1979 and revised July 19, 1979 and
prepared by the County of San Diego with respect to the
project designated Terral Subdivision, TM 3904 EAD Log
No. 78-8-286.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to Government
J Code Section 57002, the following described unincorporated
territory in the County of San Diego, State of California, be and
it hereby is annexed to and made a part of the Cardiff Sanitation
District.
IT IS FURTHER ORDERED that the Clerk of this Board immediately
transmit a certified copy of this resolution along with a
remittance to cover the fees required by the Government Code
Section 54902.5 to the Executive Officer of the Local Agency
Formation Commission of San Diego County, so that the Executive
Officer may make the filings required by Chapter 8 (commencing with
Section 57200), Part 5, Division 1, Title 6 of the government Code
and by Chapter 8 (commencing with Section 54900), Part 1, Division
, 2, Title 5 of the Government Code.

SUBJECT: Terral Subdivision Annexation to the Cardiff
Sanitation District
This is a request to annex 159.34 acres into the Cardiff Sanitation District.
Annexation is required in order to provide sewer service for a 71 unit,
single family dwelling, subdivision project.
RECOMMENDATIONS: That your Board
Adopt the resolution of the Board of Directors of the Cardiff Sanitation
District annexing territory to which the owners have consented.
DISCUSSION:
On December 1, 1981, the then Board of Directors adopted a Res~lution of
Application for Annexation of territory to the Sanitation District.
On April 1, 1985, the Local Agency Formation Commission adopted a resoulution
approving this annexation and authorizing your Board to initiate proceedings
in compliance with their resolution, without notice and hearing (DA 81-54).
The one-year expiration date of this resolution has been extended to April 1987.
The zoning is R-R,5, which allows.5 dwelling units per acre (DUA). The
Community Plan designation is Estate 17 which allows .5 and .25 DUA depending
on the topography.
