L88-23 A RESOLUTION OF THE LEUCADIA COMMUNITY ADVISORY BOARD CITY OF ENCINITAS, APPROVING A DESIGN REVIEW PERMIT AND CERTIFYING A NEGATIVE DECLARATION TO ALLOW CONSTRUCTION OF SIX DETACHED SINGLE FAMILY DWELLINGS ON ONE LOT LOCATED AT 1615 VULCAN AVENUE (CASE NUMBER 88-177 DR/EIA) WHEREAS, a request for consideration of a Design Review Permit was filed by MB Shores, Inc. to allow construction of six single family dwellings on one lot, as per Chapter 23.08 of the City of Encinitas Municipal Code, for the property located at 1615 Vulcan Avenue, legally described as; The Westerly 168.00 feet of that portion of NORTH LEUCADIA, in the County of San Diego, State of California, according to Map thereof No. 763, filed in the Office of the County Recorder of San Diego County, September 25, 1893, described as follows: BEGINNING at the point 20.00 feet Northerly from the intersection of the center line of Monterey Street with a line '- which is 20.0 feet Westerly from and parallel to the center line of Hygeia Avenue: thence Westerly along a line parallel to and 20.0 feet distance Northerly from the center line of said Monterey Street, a distance of 960.00 feet to an intersection with the Easterly line of Vulcan Avenue; thence Northerly along said Easterly line of Vulcan Avenue, a distance of 226.87 feet; thence Easterly on a line parallel to the center line of Monterey Street, a distance of 960.00 feet to a point which is 20.00 feet Westerly from the center line of Hygeia Avenue; thence Southerly parallel to and 20.00 feet Westerly from said center line of Hygeia Avenue, a distance of 226.87 feet to the POINT OF BEGINNING. EXCEPTING THEREFROM the Southerly 90.00 feet. WHEREAS, a public hearing was conducted on the application on June 16, 1988 and September 15, 1988; and WHEREAS, the Community Advisory Board considered: TC/02/CR03-130WP (9-29-88-2) -1- 1. The staff report dated June 10, 1988; 2. The application and plans submitted by the applicant; 3. Oral evidence submitted at the hearing; 4. written evidence submitted at the hearing; and 5. The proposed General Plan, Local Coastal Program, Zoning Code and Maps. WHEREAS, the Leucadia Community Advisory Board made the following findings pursuant to Chapter 23.08 of the City of Encinitas Municipal Code: SEE ATTACHMENT "A" NOW, THEREFORE, BE IT RESOLVED by the Leucadia Community Advisory Board of the City of Encinitas that Design Review and Environmental Initial Assessment application 88-177 DR/EIA is hereby approved subject to the following conditions: SEE ATTACHMENT "B" BE IT FURTHER RESOLVED by the Leucadia Community Advisory Board of the City of Encinitas that: That this project will not have a significant effect on the environment and a negative declaration is hereby certified, pursuant to the California Environmental Quality Act (CEQA).
