A. Adoption of Resolution 88-05 Annexing 48.9 Acres, Located
in the Vicinity of Manchester Avenue to the Cûrdiff
Sanitation District and 15.38 Acres to the Rancho
Santa Fe Fire Protection District, Thomas Kern.
Omsted moved, Shea seconded to adopt Staff recommendation (to
adopt Resolution 88-05 approv1ng the annexation of the Kern
Reorganization.)
Al :Kern stated that the portion of his land to be served by
Cardiff S?nita"'.:ion District 1S alreé.dy 1n the City and the
flood plain area \-,'Quld never be served even if annexed. He
suggested approvlng the annexation, completion of his parcel
map and then extension of the City boundaries to include all
of his property, which is now bisected by the city Limits line.
District Manager Shafer recommended ap~roving the annexation to
the Cardiff Sanitation District, su:: 'èc::. to conditionG that

The motion was amended to add the District Manager' :;
recommendations.
Public Works Director August suggested that the approval also
be with a condition that prior to connection to the sewer Lots
1; 2 and 4 be annexed to the city.
The motion was again amended to also add Mr. August's
suggestion. Amended motion carried: Ayes: Gaines, Luke,
Omsted, Shea, Steel; Nays: None.
B. Report by John Murk Enqineers on Transition Between f;olD \
Dieqo County and Sùn ElilO JPA and Cardiff Sanitation ..
District Operations
Consulting Engineer John Murk displayed a chart graphically
illustrating which functions are now being performed by the
Joint Powers Authority, by the County, by each of the two
sanitation districts and which are being contracted for. He
explained that some of the functions are so intertwined with
the County that they are under County management until July 1.
District Counsel Roger Krauel arrived and Assistant Counsel
Francesca Krauel left at 5:15 P.M.
Mr. Murk stated they had received recommendations from the JPA
as to how to sever the ties with the County. Public Works
Director August stated direction was needed from the Board
whether to hire Staff, contract for it, etc. There was general
agreement that there were some areas of responsibility which
need to be given to the JPA and others which should be retained
by Cardiff Sanitation District. Also, that the two Board
members who are on the JPA should at their meeting talk tú ::.he
other merr,bers to try to determine what the JPA policies are.
The Board also expressed a willingness, where it had the
ability to do so, to contract to perform some types of services
for Solana Beach Sanitation District. H:. was brought out that
at some future time the City might want to have its own sewer
department and that would be rcore easily accomplished if not
all functions were given over to the JPA. Mr. Shafer also
pointed out that '-I- might be possible 1n the near future to

contract with Encinitas Sanitary District for some services and
at some later date consolidate into one sewer operation. The
Board askec. that a chart sirr.ilar to the one :¡:::resented at this
meeting be prepared showing in ea,~h box, representing a
function, what the options are and which option is recommended
by Staff. The direction was to minimize administration and to
try to allow for City wide operation at sor:'le future time of
lines, etc.

RESOLUTION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
KERN REORGANIZATION/ANNEXATION
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on July 15, 1986, as Resolution No.
SAN-5, for annexation to the Cardiff Sanitation District
(thereinafter re f erred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, a petition was submitted to the Local Agency
Formation Commission for the reorganization of territory
including annexation of territory to the Rancho Santa Fe Fire
Protection District, which petition was certified sufficient by
the Executive Officer on February 19, 1987; and
WHEREAS, the annexation proposed by said resolution of
application and petition were presented to and approved by the
Local Agency Formation Commission of San Diego County on March 2,
1987, and the Cardiff Sanitation District was designated as the
conducting district and authorized by resolution to order said
annexations without notice or hearing and without an election
pursuant to Government Code, Section 56837;
NOW THEREFORE, BE IT RESOLVED, ORDERED AND DETERMINED,
pursuant to Government Code Section 57025 et seq.:
a. The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this
Board and petition as stated above.

b. The territory to be annexed has been designated the
Kern Reorganization by the Local Agency Formation
Commission, and the exterior boundaries of such
territory are as hereinafter described.
c. The territory proposed to be annexed is uninhabited and
will be benefited by such annexation as described in
Health and Safety Code section 4830.
d. The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The Districts are empowered to and are engaged in
furnishing sewage disposal facilities and fire
protection.
2. The territory proposed to be annexed to said
Districts is proposed to be developed and used for
residential and/ or commercial purposes, and
provision for sewage disposal facilities and fire
protection for said territory is essential for
such purposes.
e. The terms and conditions of the proposed annexation
are: Payment of Rancho Santa Fe Fire Protection
District annexation fees; 15.38 acres to be annexed to
Rancho Santa Fe Fire Protection District; 48.9 acres to
the Cardiff Sanitation District.
f. All the owners of land within such territory have given
their written consent to such annexation, as provided
in Government Code, section 56837; and therefore, as
approved and authorized by the Local Agency Formation
Commission, this Board may adopt its resolution
ordering the annexation without notice and hearing and
without election, as provided in Government Code,
Section 57002.
g. The regular County assessment role will be utilized and
the affected territory will be taxed for existing
bonded indebtedness.
h. Pursuant to state CEQA Guidelines Section 15074
(California Environmental Quality Act of 1970), the
Board finds in accordance with the Negative Declaration
dated April 11, 1985, prepared with respect to the
proposed annexation and the project designated TPM
18397 Log No. 85-7-10, that the project would have no
significant impact on the environment.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code Section 57002, the following described territory,

portions of which are located in the City of Encinitas and
in an unincorporated area of San Diego County, state of
California, be and it hereby is annexed to and made a part of the
Cardiff Sanitation District and Rancho Santa Fe Fire Protection
District.
IT IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certified copy of this resolution along
with a remittance to cover fees required by the Government Code
section 54902.5 to the Executive Officer of the Local Agency
Formation Commission of San Diego County, so that the Executive
Officer may make the filings required by Chapter 8 (commencing
with Section 57200), Part 5, Division 1, Title 6 of the
Government Code and by Chapter 8 (commencing with Section 54900),
Part 1, Division 2, Title 5 of the Government Code.

FINDINGS:
The City of Encinitas City council has examined the initial study
and finds that the proposed project will not have a significant
effect on the environment and that an environmental impact report
need not be prepared pursuant to the City Procedures for
Environmental Impact Review.
INITIAL STUDY SUMMARY
PROJECT DESCRIPTION AND LOCATION
The proposed project is a minor subdivision of approximately 51.3
acres into four single family residential parcels of
approximately 8.0, 18.7, 8.3 and 16.3 gross acres. Additionally,
the project includes the annexation of 48.9 acres of the 51. 3
acres to the Cardiff Sanitation District. The 48.9 acres to be
annexed includes Parcel Numbers 1, 2 and 4; and a portion of
Parcel 3. The project is located east of Manchester Avenue and
south of Encinitas Boulevard directly north of the San Elijo
Lagoon in Encinitas. Tentative Parcel Map 18397 received
conditional approval requiring annexation to the Cardiff
Sanitation District. A 12" PVC sewer line bisects the subject
property, therefore no additional construction of public sewer
facilities 1S required.

ENVIRONMENTAL SETTING:
The project site is largely the floodplain of the Escondido Creek
which bisects the property. The site is just north of the San
Elijo Lagoon and exhibits some wetland marsh vegetation. The
majority of the property is overlain by a floodplain easement and
open space easement granted to the State of California.

property. As a result the buildable areas are limited to a
narrow strip (200 feet wide) along the western boundary and an
area adjacent to Stonebridge Lane along the eastern boundary.
POTENTIALLY SIGNIFICANT EFFECTS:
Project development could adversely impact sensitive marsh and
lagoon habitats.
MITIGATING MEASURES PROPOSED BY APPLICANT:
None.
REASONS TO SUPPORT FINDING OF NEGATIVE DECLARATION:
An open space easement has been granted to the State of
California over the majority of the project site and floodplain
Îor the protecLion on sensitive habitat.

Board Member Gaines expressed concern because the majority of
the property to be annexed crosses the floodplain. She
questioned whether the pr:.Jp(';rty should be annexed to Cardiff
Sanitation District or to Sclanu Beach Sanitation District.
District Manager Shafer stated he had spoken to L..~FCO and to
the property owner who indicated that he would be válling to

Board Member Gaines asked whether the resolution could be
conditioned that the property be annexed to the City of
Encinitas. Public Works Director August stated that would be
Staff's intent.ion for future applications, however, this
application was not so conditioned previously. He also stated
that LAFCO had already approved the application on March 2,
1987 and that approval would expire on March 2, 1988.
Board Member Shea questioned the statement "the following
described territory 1n the city of Encinitas.." on the bottom
of page 3E-4 and the top of page 3E-5 in the resolution.
Public Works Director August stated this was an error, only a
portion of the property is located in the city of Encinitas.
Board Member Steel had three questions:
- Dc we want to expand the Cardiff Sanitation District
across the floodplain?
- Do we have to?
- Do we only want to do it if the properties are comlng
into the City of Encinitas?
Board Member Luke suggested that a condition be added that no
sewer connection service be provided until the property was
annexed to the city of Encinitas.
District Counsel Krauel stated that this would mean the
property would have to be annexed to all the various subsidiary
districts as well.
This item was tabled fo~ discussion later in the meeting.
4. ADMINISTRATIVE MATTERS
A. Reauest from Member Gaines to Discuss Annexation and
Extension of Service policv.
Board Member Gaines addressed the issue of ho'w far the
District wants to go in servicing land, 1. e., whether the
District wants to only service land with gravity flow (which
used to be the policy) or also to serVlce rugged areas and
provide pump stations.
Board Member Omsted stated she wanted to know the legal
obligations of the District.
Public Works Director August stated that the current
subdivision ordinance requires all new subdivisions to have
sewer hook-up. He also stated that the sphere of influence
goes beyond the city boundaries and into some very rugged

Board Member Gaines suggested that septic systems could be
used. Public Works Director August stated that In
discussions with the Health Department they had indicated
septic tanks would not be allowed.
The Board directed that this item be brought back to a future
meeting and directed staff to provide sphere of influence maps
of t.he Cardiff Sanitation District and the City sho\\'ing who
created the sphere maps, the process to go through to adjust
the sphere maps, what the policy options of the District are in
extending lines across the floodplain: and a report from the
Health Department regarding the use of septic systems in major
subdivisions and lot splits, sewer v. septic, and whether
septic is possible.
Betty Knutson stated she could provide maps of the Cardiff
Sanitation District's sphere of influence.
3E. Adoption of Resolution No. 88-05, Annexinq 48.9
acres. located in the vicinity of Manchester Avenue
to the Cardiff sanitation District and 15.38 acres to
the Rancho Santa Fe Fire Protection District, Thomas
Kern.
The Board directed staff to find out if the District serves
the Stonebridge development, and what the twelve inch line on
the property is and who it serves.
This item was continued to the February 24, 1988 meeting.
B. status Report on San ElilO Powers Authority.
District Manager Shafer advised the Board that Murk, consulting
engineers, had started co-managing the plant on February 3,
1988. They were currently working in conjunction with County
staff to ful~.y understand the complexities of the
interrelationships and all the various facets that are actually
being managed out of the plant by the County sanitation
districts. Murk had issued a comprehensive report on the
various agreements and int€-relationships. In terms of the
progress of upgrading to sc;condary treatment, a preliminary
draft of the EIR from the environmental consultant had been
prepared and was ready for review by staff. Solana Beach had
installed a new meter at their pump station. The plant has
five months of data and after six months of data M'J.rk will
prepare a report to be brought back to the Joint Powers Board.
The plant is operating under a contract with the County to
provide personnel to operate the plant and pump station. Murk
will be evaluating the situation to c etermine the best
availatle method for providing the necessary labor to operate
the plant.

BACKGROUND:
The Board of Directors at their February 10, 1988 meeting,
continued their consideration of the adoption of Resolution 88-
05 giving final approval of the annexation of 48.9 acres to the
Cardiff Sanitation District and 15.38 acres to the Rancho Santa
Fe Fire Protection District in conjunction with TPM 18397.
Concern was expressed for any excavations within the flood
plain for new sewer laterals and building pad sites.
DISCUSSION:
I have met with the applicant, Mr. Al Kern, and discussed the
proposed subdivision. Mr. Kern advised that he would be in
attendance at the Board's February 24, 1988 meeting to address
any questions germane to the proj ect and its needs for sewer
serV1ce.
There is currently one house on the existing 50:!: acre single
lot which is located on Stonebridge Drive and is currently
served by the Cardiff Sanitation District (as is the entire
Stonebridge Drive subdivision). At the time this lot was
initially annexed in the District, it was the District policy
not to annex open space such as the San Elijo Lagoon and
Escondido Creek 100 year flood plain since the annexation fee
was based on acreage. Therefore, only the relatively small
building site on Stonebridge Drive was included in the former
annexation action. However, since that time the Board has
adopted a fee schedule based on equivalent dwelling unit (EDU)
rather than acreage. Thus, now that this single lot is to be
subdivided into four lots, it is appropriate to also annex
those open space areas within the proposed subdivision.
The proposed subdivision consists of four lots including the
existing house on the east side of the Escondido Creek 100 year
flood plain and three new lots with relatively small building
sites along the west side of the flood plain. These new
building sites are accessed from Manchester Avenue and no new
construction is anticipated within the flood plain. The three
new building sites will be connected to the sewer which
generally runs parallel to and along the west side of the

RECOMMENDATION:
It is recommended that the Board of Directors adopt Resolution
88-05 approving the annexation of the Kern Reorganization.
