A RESOLUTION OF APPLICATION BY THE BOARD OF DIRECTORS
. OF THE ENCINITAS FIRE PROTECTION DISTRICT REQUESTING
THE LOCAL AGENCY FORNATION COMMISSION TO TAKE
PROCEEDINGS FOR THE ANNEXATION OF ENCINITAS VILLAGE.
WHEREAS, the Encinitas Fire Protection Dis trict desires to
initiate proceedings pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985, Division 3, commencing with Section 56000 of
the California Government Code, for the Annexation of Encinitas Village; and
WHEREAS, the territory proposed to be annexed is uninhabited, and
a description of the boundaries of the territory is set forth in Exhibit "A"
attached hereto and by this reference incorporated herein; and
WHEREAS, this proposal is consistent with the sphere of influence
of the affected district; and
WHEREAS, owners of property have had an Environmental Impact
Report performed on the property with the conclusion that the project will
not have a significant impact on the environment; and
WHEREAS, it is desired to provide that the proposed annexation be
subject to the following terms and conditions:
1. Owners of property be required to pay LAFCO fees, and
. 2. Owners to pay Encinitas Fire Protection District
mitigation and annexation fees; and
WHEREAS, the reasons for this proposed annexation is as follows:
1. Fire protection
NOW, THEREFORE, BE IT RESOLVED, this Resolution of Application is
hereby adopted and approved by the Board of Directors of the Encinitas Fire
Protection District, and the Local Agency Formation Commission of San Diego
County is hereby requested to take proceedings for the annexation of
territory as described in Exhibit "A", according to the terms and
conditions stated above and in the manner provided by the Cortese-Knox
Local Government Reorganization Act of 1985.

Report performed on the property with the conclusion that the project will
not have a significant impact on the environment; and
WHEREAS, it is desired to provide that the proposed annexation be
subject to the following terms and conditions:
1. Owners of property be required to pay LAFCO fees, and
. 2. Owners to pay Encinitas Fire Protection District
mitigation and annexation fees; and
WHEREAS, the reasons for this proposed annexation is as follows:
1. Fire protection
NOW, THEREFORE, BE IT RESOLVED, this Resolution of Application is
hereby adopted and approved by the Board of Directors of the Encinitas Fire
Protection District, and the Local Agency Formation Commission of San Diego
County is hereby requested to take proceedings for the annexation of
territory as described in Exhibit "A", according to the terms and
conditions stated above and in the manner provided by the Cortese-Knox
Local Government Reorganization Act of 1985.
