A RESOLUTION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
Dennis Hauswirth ANNEXATION 8806.0
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on 04/13/88, as Resolution No. 8810,
for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diegc County on 06/06/88, and this
District was designated as the conducting district and
authorized by resolution to order said annexation without
notice or hearing and without an election pursuant to
Government Code, Section 56837;
NOW, THEREFORE, IT IS RESOLVED, ORDERED AND DETERMINED,
pursuant to Government Code Section 57025 et seq.;
a. The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this
Board as stated above.
b. The territory to be annexed has been designated the DA
8812 by the Local Agency Formation Commission, and the
exterior boundaries of such territory are as
hereinafter described.
c. The territory proposed to be annexed is uninhabited,
and will be benefited by such annexation as described
in Health and safety Code Section 4830.

d. The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said
District is proposed to be developed and used for
residential and/or commercial purposes and
provision for sewage disposal facilities for said
territor¥ is essential for such purposes.
e. The terms and conditions of the proposed annexation
are: Payment of annexation and state Board fees.
f. All the owners of land within such territory have given
their written consent to such annexation, as provided in
Government Code, Section 56837; and therefore, as
approved and authorized by the Local Agency Formation
Commission, this Board may adopt its resolution ordering
the annexation without notice and hearing and without an
election, as provided in Government Code, Section 57002.
g. The regular County assessment role will be utilized and
the affected territory will be taxed for existing
bonded indebtedness.
h. Pursuant to State CEQA Guidelines Section 15074
(California Environmental Quality Control Act of 1970),
the board finds in accordancé with the Negative
Declaration dated 11/23/87, prepared with respect to the
proposed annexation and the project designated
TPM18962&87-008 Log No. 87-8-57 that the project would
have no significant impact on the environment.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code Section 57002, the following described
incorporated territory in the City of Encinitas, State of
California, be and it hereby is annexed to and made a part of
the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certified copy of this resolution along
with a remittance to cover the fees required by the Government

Code Section 54902.5 to the Executive Officer of the Local
Agency Formation Commission of San Diego County, so that the
Executive Officer may make the filings required by Chapter 8

On motion of Commissioner Loscher, seconded by Commissioner Hersom, the fol1owing
resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for annexation of
territory to the Cardiff Sanitation District, which resolution was adopted by the Board of
Directors of said District as Resolution No. 88-10, dated April 13, 1988, pursuant to Title 5,
Division 3, commencing with Section 56000 of the Government Code; and
WHEREAS, the territory proposed for annexation is as described in the application on file
with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on said
annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds, determines, and
orders as follows:
(1) The Commission certifies that it has reviewed and considered the inf orma tion
contained in the Negative Declarations prepared by the Cardiff Sanitation District.
(2) The Commission hereby approves the annexation with modified boundaries, as
described in Exhibit A attached hereto, subject to the following condition:

Descri otion / J ustifica tion
Proposed by Resolution is the annexation of approximately 4.5 acres of territory to the
Cardiff Sanitation District. The area is within the City of Encinitas and the Sphere of
Influence of the Cardiff Sanitation District. The City of Encinitas has approved development
of this area with eight single family dwelling units and annexation is necessary to provide
sewer services. Annexation to the Sanitation District is a condition of approval for Tenta-
tive Parcel Maps No. 18962 and No. 87-008. The Cardiff Sanitation District has sufficient
capacity to service the development and the distance to the nearest District sewer line is
approximately 500 feet, The Board of Supervisors has adopted a Master Enterprise District
Resolution stating that no property tax transfer would be required as a result of this
jurisdictional change.
General Plan/Zoning
City of Encinitas General Plan designation for this area is Rural-Residential.
City zoning is RR-2 (2 du/acre).

A RESOLUTION OF THE BOARD OF DIRECTORS
OF THE CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
Dennis Hauswirth ANNEXATION 8806.0
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, Section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on 04/13/88, as Resolution No. 8810,
for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diego County on 06/06/88, and this
District was designated as the conducting district and
authorized by resolution to order said annexation without
notice or hearing and without an election pursuant to
Government Code, Section 56837;
NOW, THEREFORE, IT IS RESOLVED, ORDERED AND DETERMINED,
pursuant to Government Code Section 57025 et seq.;

a. The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this
Board as stated above.
b. The territory to be annexed has been designated the DA
8812 by the Local Agency Formation Commission, and the
exterior boundaries of such territory are as
hereinafter described.
c. The territory proposed to be annexed is uninhabited,
and will be benefited by such annexation as described
in Health and Safety Code Section 4830.

d, The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The territory proposed to be annexed to said
District is proposed to be developed and used for
residential andlor commercial purposes and
provision for sewage disposal facilities for said
territor¥ is essential for such purposes.
e. The terms and conditions of the proposed annexation
are: payment of annexation and state Board fees.
f. All the owners of land within such territory have given
their written consent to such annexation, as provided in
Government Code, Section 56837; and therefore, as
approved and authorized by the Local Agency Formation
Commission, this Board may adopt its resolution ordering
the annexation without notice and hearing and without an
election, as provided in Government Code, Section 57002.
g. The regular County assessment role will be utilized and
the affected territory will be taxed for existing
bonded indebtedness.
h. Pursuant to state CEQA Guidelines Section 15074
(California Environmental Quality Control Act of 1970),
the board finds in accordance with the Negative
Declaration dated 11/23/87, prepared with respect to the
proposed annexation and the project designated
TPM18962&87-008 Log No. 87-8-57 that the project would
have no significant impact on the environment.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code Section 57002, the following described
incorporated territory in the City of Encinitas, State of
California, be and it hereby is annexed to and made a part of
the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certified copy of this resolution along
with a remittance to cover the fees required by the Government

Code Section 54902.5 to the Executive Officer of the Local
Agency Formation Commission of San Diego County, so that the
Executive Officer may make the filings required by Chapter 8
(commencing with Section 57200), Part 5, Division 1, Title 6 of

54900), Part 1, Division 2, Title 5 of the Government Code.

described boundaries:

DISCUSSION:
On January 23, 1988. your Board approved Tentative Parcel Map (TPM) 18962
and on January 27, 1988, TPM 87-008. These two TPM's will create eight lots
for single family dwellings.
On April 13, 1988, your Board adopted Resolution of Application No. 88-10.
On June 10, 1988, the Local Agency Formation Commission approved Resolution
DA 88-12 approving annexation to the Cardiff Sanitation District.

FOR THE ANNEXATION OF TERRITORY

WHEREAS, this Board of Directors has received a request
from Dennis Hauswirth (Document No. ) that the
hereinafter described territory to be annexed to the Cardiff
Sanitation District (hereinafter referred to as the Sanitation
District); and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code sections 56800 and 56700,
application is hereby made to the Local Agency
Formation Commission of the County of San Diego for
a proposed change of organization as follows:
A. This proposal is made pursuant to the
Cortese-Knox Local Government Reorganization
Act of 1985 (S. 56000, et. seq., Govt. Code).
B. The nature of the proposed change of
organization and the names of all districts for
which any such change of organization is
proposed as follows: The annexation of the
hereinafter described territory to the
Sanitation District.
C. The names of all other affected counties, cities
and districts are: city of Encinitas.
D. A description of the exterior boundaries of the
territory proposed to be annexed to the
Sanitation District is described in Exhibit "A"
hereto attached.
E. Said territory is uninhabited and comprises
approximately 4.50 acres.
F. It is proposed that said territory be annexed
subject to the following condition: Payment of
district annexation and State Board fees.
G. All the owners of land within such territory
have given their written consent to such

annexation subject to the terms
and conditions.
H. The reasons for this proposal are as follows:
(1) The Sanitation District is empowered to and
is engaged in furnishing sewerage disposal
facilities.
(2) The territory proposed to be annexed to
said District is proposed to be developed
and used for residential andlor commercial
purposes and provision for sewerage
disposal facilities for said territory is
essential for such purposes.
I. It is hereby requested that proceedings be taken
for the annexation of territory as hereinabove
proposed.
J. This annexation is consistent with the sphere of
influence of the Sanitation District.
2. Pursuant to state CEQA Guidelines section 15074
(California Environmental Quality Act of 1970), the
Board finds in accordance with the Negative
Declaration dated 11/23/87, prepared with respect to
the proposed annexation and the proj ect designated
TPM 18962 and 87-008, Log No. 87-8-57, that this
project would have no significant impact on the
environment.
3. The Clerk of the Board of Directors is hereby
authorized and directed to file a certified copy of
this resolution with the Executive Officer of the
Local Agency Formation Commission of the County of
San Diego.

To develope the property described herein, sewer service is required as soil
conditions dictate that septic systems would not be sufficent. Annexation in-
to Cardiff Sanitation District is a condition of approval of the Tentative
Parcel Map(s).

proposal submitted to the Local Agency Formation Commission (LAFCO). A party is

THE CITY OF ENCINITAS
APPROVING A TENTATIVE PARCEL ¥.hP (TPM 18962)
FOR THE PROPERTY BEING A PORTION OF LOT 19 OF
RANCHO LJ.S ENCINITAS, MAP 848, ALSO BEING
PORTIONS OF LOTS 81 AND 8lA OF COLONY OLIVENHAIN,
MAP :.; ¿ ': 1 TOGETHER WITH PORTIONS OF "B", AND "CII,
AND 13TH STREETS ALL WITHIN SECTION 7, T13S, R3h', S BI'1
WHEREAS, Dennis J. Haus\Úrth applied for a Tentative Parcel
Map for a division of a 2.77 acre lot into four parcels of .60,
.60, .92, and .65 of an acre for property of a portion of Lot
19, Rancho Las Encinitas, Map 848, also being portions of lots 81
and 81A of Colony Olivenhain, Map 326, together with portions of
"B" and "C", and 13th Streets all v.'i thin Section 7, T135, R3W,
SBM for the purpose of creating 4 single family residential lots;
and
WHEREAS, the City of Encinitas City Council determined that
none of the following findings requiring the denial of a
Tentative Map pursuant to State Subdivision La'vl can be made ln
the case of TPM 18962:
a. That the proposed map is not consistent with applicable
general and specific plans as specified ln section
65451.
The map proposes a 4 lot subdivision meeting City
standards. The Circulation Element identifies a
regional connecting road (SA 680) to be located across
this subdivision, eliminating 2 of the 4 lots. The map
is conditioned to notify the County of the approval to -
allow the County opportunity to protect the reg ional
access. The map does not prohibit the implementation
of the Circulation Element, maintaining consistency
~ith the General Plan.

The 4 lot subdivision meets the city standards. The
General Plan identifies the Circulation Element road

approved to place the County on notice of action. The
design is consistent vith the General Plan
c. That the site is not physically sL:itable for the type
of development.
The site 1S 2.7 +/- acres and is located off of 13th
Street. The property has some slope with lot Slzes
averaging 0.5 acres. The site 1S physically suitable
for the residential development and density.

proposed density of development.

NOW THEREFORE, BE IT RESOLVED by the City of EncirÜ tas
City Council, that Tentative Parcel Map TPM 18962 1S hereby

approved subject to the following conditions:

p'rior to recordation of the final map, the fol1o"..ing conditions
. shall be complied with:
1. The prope:-ty owned shall dedicate any required right-of-way
along 13th and C streets and install street improvements in
accordance v\Ì th Title 23 of the City of Encinitas JI1unicipal
Code.
2. The subdivider shall submit plans and specifications for
improvements of all public and private street right-of-~ay,
drainage easements, culverts, drainage structures and
drainage channels to the Department of Publ ic \\1or}:s for
approval.
3. The exact depth of imported base material shall be based on
soil tests which have been approved by the Director of the
Department of Public Works.
4. If the improvement plans show a need to excavate In any
public road right-of-way, the developer shall place a cash
deposit with the Director of the Depa:-tment of Public Wor}:s
to insure that any damage to the existing roadway is
repaired in a timely manner.
5. The subdivider shall construct, or agree to construct, the
public improvements and private road improvements shown on
the improvement plans as approved by the Director of the
Department of Public Works.
6. All ne.....' and existing utility distribution facilities,
including cable television lines, within the boundaries of
the subdivision or within any half street abutting the
subdivision shall be placed underground in accordance with
Section 81. 403 (a) (6) of the Subdivision Ordinance. The
subdivider is responsible for complying Hith the
requirements of this condition, and shall make the necessary
arrangements Hith each of the serving utilities,; including
licensed cable television operators, for the installation of
such facilities. The subdivider shall either provide the
installation of such facilities. The subdivider shall
either provide the Director of the Department Public 'works
with documentation from a licensed cable television operatc:-
stating cable television service is available, or with
documentation that the Cable Television Review Commission
has reported that no licensed cable television operator is
Hilling and able to provide service to the subdivision.
7. The installation (if required) of all gas, electric, sewer, -
and Hater lines and any other beloH surface utilities lS to
ta}:e place before the installation of any concrete curbs,
gutters, sideHalks and the surfacing of the streets.
8. The subdivider shall provide for the improvement of all
drainage easements by culvert or drainage channel of
adequate size, whichever is required by the Director of the

. Department of Public Works. All such drainaGe easements
shall be monumented along property lines - +- locations

approved by the Director of the department of Public vJorks.
An access easement shall be provided to each drainage system
maintenance access point not directly accessible from a
public roadway. Such access easement to the improved,
fenced and aligned to the satisfaction of the Director of
Public Works.
9. Each building lot shall have a flood-free site for a
residence. The building site shall be safe from the fl ood
flow peak of a 100-year frequency storm.
10. Hydrology and hydraulic calculations for determining the
storm system design vlith water surface profile and adequate
field survey cross section data shall be provided
satisfactory to the Director, Department of Public \vor}:s or
verification shall be provided that such calculations are
not needed.
11. Submit a letter from the applicable fire serv1ng protection
district stating satisfaction with the type and location of
fire improvements and the m1n1mum required water flow in
gallons per minute together with a letter from the
applicable water serving agency certifying that the fire
department's minimum required water flow 1S available to
serve the site or verification shall be provided that such
improvements are not needed.
12. The final map shall show the dedication of all on-site
drainage easements, including easements for access thereto,
and shoo¡.; monumentation for such easements, as required by
the Director of the Department of Public Wor}:s, or verify
that no easements are required.
13. The final map shall include the entire area sho'itlTI on the
tentative map and shall not be filed as units or groups of
units unless requested by the subdivider and approved by the
Director of Planning and Land Use. If filed as units or
groups of units or g::::-oups of units there will be a m1n1mum
two v;eek interval between approval of each final map. Lot
numbering and design on the final IT,c.p shall be ln
substantial conformance to that shown on the tentative map.
14. The subdivider shell accomplish the following pr1or to
approval of the final map by the Community Advisory Board.
a. Provide the Department of Public Works with a letter of -
commitment of public services and utilities that
includes but are not necessarily limited to, fire,
water and sewer services to the site.
b. Provide the Department of Public Wor}:s with a
certification from each public utility and each public
entity owning easements within the proposed subdivision

stating that: ( a) they have received from the developer
a copy of the proposed final map; (b) they object or do
not object to the filing of the Ir.3p without their
signature; (c) in case of a street dedication affected
by their existing easement, they v-'ill sIgn a

on the map when required by the governing body. In
addition, the subdivider shall furnish proof to the
satisfaction of the Director, Department of Public
Works, that no new encumbrances have been created that
would subordinate the County's interest over areas :'0

c. Grant to the appropriate agency by recorded document
all required off-site easements and all on-site water
main easements that serve fire hydrants or furnish a
letter from said agency that none are required.
d. Provide the Department of Public Wor}:s with evidence
that any offer of dedication or grant of right-of-way
shall be free of all encumbrances as subordinated at
the time of recordation of the final map.
e. The developer shall execute a covenant for the benefit
of the City of Encinitas agree1ng to pay those
development fees established by Ordinances 87-11, 87-
17, 87-18, and 87-19 or other ordinances 1n effect at
time of issuance of building permits on the lots
created pursuant to this tentative map. By this
reference, the development fees mentioned herein are
imposed on this subdivision.
f. Applicant shall pay all appropriate City fees.
g. Approval of this project does not relieve the applicant
from complying with other applicable federal, state and
local regulations.
h. Approval of this project is subject to the Planning
staff contacting the County of San Diego to advise them
of the approval of this project and to enable the
County to respond to the Property owner within a
reasonable time regarding whether or not the County

RESOLUTION NO. 88-07
A RESOLUTION OF THE -CIT~ COUNCIL
APPROVING A TENTATIVE PARCEL MAP TO DIVIDE
A PORTION OF LOT 19 OF RANCHO LAS ENCINITAS, MAP 849,
ALSO BLOCK 81 AND 81A OF COLONY OLIVENHAIN, MAP 326
WHEREAS, Steve Robins applied for a subdivision to create
4 parcels of approximately .50 net acre each from a parcel
located at the northeast corner of 13th Street and Rancho
Santa Fe Road in the Olivenhain area;
WHEREAS, a public hearing was conducted on the application
87-008 TPM on Dec~mber 16, 1987, by the City council, at which
time all persons desiring to be heard were heard; and,
WHEREAS, evidence was submitted and considered to include
without limitation:
a. site plan submitted by the applicant;
b. written information submitted with the application;
c. Oral testimony from staff, appl icant, and public
made a part of said public hearing;
d. staff reports dated December 9, 1987, December 30,
1987, and January 22, 1988 which are incorporated by
this reference as though fully set forth herein; and
e. Additional written documentation.
NOW, THEREFORE, BE IT RESOLVED by the city council of the
City of Encinitas that the following findings are made pursuant
to the Government Code and the Municipal Code:
1. That the Tentative Parcel Map is consistent with all
elements of the City of Encinitas General Plan and with
the land use designation of the General Plan because it
proposes a single family residential use type at a density
of 2 dwellings per acre in the RR-2 Use Regulation; and

2. ~e CirculatJt element of the General pit indicates that
. Highway SA 680 is planned to trave e the subject
, property. SA 680 is a regional highway and a minor
subdivision is not expected to implement a regional
highway. The approval of this-- subdivision does not
preclude an alternate location for SA 680, nor does it
preclude the purchase of the land for highway purposes by
the County of San Diego should that body wish to proceed
with the routing of SA 680 as shown on the circulation
element. Notwithstanding the foregoing, the design and
improvements of the proposed subdivision are consistent
with all elements of the City of Encinitas General Plan
and comply with the provisions of the State Subdivision
ì-1ap Act and the Subdivision Ordinance of the City of
Encinitas; and
3. The site is physically suitable for the proposed
residential type of development because only minor grading
will be necessary to effect the improvements and house
pads; and
4. The site is physically suitable for the proposed density

5. The design of the subdivision or the type of improvements
will not cause public health problems because adequate
water supply and sewage disposal services are available,
or will be available with annexation of the property to

are not likely to cause substantial environmental damage
or substantially and avoidably injure fish or wildlife or
their habitat based upon the findings of a Negative
Declaration dated January 13, 1988; and
7. The design of the subdivision or the type of improvements
does not conflict with easements, acquired by the public
at large, for access through, or use of property -....ithin
the proposed subdivision, as defined under section 664ï4
of the Government Code, state of California.
IT IS FURTHER FOUND, DETERMINED AND certified that the

State and City CEQA Guidelines, that the decision-making body

environment for the following reasons::.
1. No known endangered species or other environmental
resources will be significantly affected by this project.
2. The proposal will not have significant growth-inducing
impacts.
NOW, THEREFORE, IT IS DETERMINED AND ORDERED that based
on the findings hereinbefore stated, Tentative Parcel Map is
hereby approved subject to the following conditions:
A. The approval of this Tentative Parcel Map expires on
January 27, 1991 at 5:00 p.m. unless, prior to that date,
a request for a time extension has been filed as provided
by the municipal code.
The following conditions shall be complied with before a Parcel
Map is recommended by the Department of Public Works and filed
with the authorized agency of the city of Encinitas for
approval prior to recordation by the recorder of San Diego
County:
B. The Parcel Map shall show an accurate and detailed

C. Road Improvements
1. Private
a. Road shall be graded 20 feet and paved 20 feet

centerline with a rolled concrete curb and
gutter on the south side abutting the proposed
subdivision and a six-inch a.c. berm on the
north side.
b. Rancho Santa Fe Road
A registered civil Engineer shall certify that
the existing improvements within the half street
abutting the subj ect property are to city of
Encinitas standards.
Those improvements not meeting standards shall
be designed and the road shall be improved to
city standards.
Specific improvements will be a 20-foot a.c.
paved half-street with standard (type G)
concrete curb and gutter, a 36-inch diameter
underground storm drain replacing the existing
ODen culvert with a catch basin appropriately
located and a ten-foot- wide graded parkway.

c. Intersection of Rancho Santa Fe Road and 13th
street
A 35 foot radius return shall be designed and
constructed at the intersection of Rancho Santa
Fe Road and 13th Street. Return shall meet city
design standards. Suff icient right-of-way must
be dedicated to ensure that all required public
improvements are located within the public
domain.
3. The developer shall ente~ into a ~eimbu~sable
agreement with the City \o:he~eby the cost of :tmblic
improvements herein identified shall be rei~~u~sed to
the developer by the city not to exceed $50,000.00
The reimbursement shall be made based upon the public
imp~ovements and cost estimates. The Public Works
Department shall review the cost esti17\ates provided
by the applicant for adequacy.
The reimbursement agreement shall apply to the
drainage improvements for Rancho Santa Fe (condition
C2b) and those improvements necessary to upgrade 13th

D. Covenants and Agreements

1. The parcel map shall show vehicular access rights
relinquished for the length of the property frontage
along Rancho Santa Fe Road.
2. The developer shall execute and record a private road
maintenance agreement.
3. The developer shall execute and record a covenant not
to oppose an assessment district for those necessary
public improvements not otherwise satisfied by other
means.
4. The developer shall provide security for the
necessary public improvements in order to guarantee
the necessary public improvements. The security
shall be in the form of either cash or letter of
credit in the amount of 150% of the estimated cost of
the improvements.
5. The applicant shall make application for, and receive
approval of, a road vacation of right-of-way along
the 13th Street frontage of the site.
E. Drainage
Drainage on and through the site shall be designed and
constructed to the satisfaction of the City Engineer.
F. Development Fees
Appropriate development fees as established by Chapters
23.90 through 23.98 shall be paid in accordance with the
municipal code.
G. Fire Protection

and installed at the corner of 13th Street and the private
road shall be provided to the satisfaction of the
Encinitas Fire Protection District.
H. Utilities
The developer shall make adequate provisions for utilities
including installation and grant of easements to the
satisfaction of the appropriate utility.

~ If annexation to a district is necessary, the developer
shall cause the annexation.
I. Parcel Hap -.
1. The parcel map pursuant to the approved tentative
parcel map shall be reviewed and certified by the
authorized agency prior to recordation. A processing
fee to cover the cost of the review shall be paid by
the applicant.
2. No parcel shall be sold and no building permits shall
be issued for the parcels being created until a
parcel map approved by the authorized agency is
recorded. All applicable regulations in effect at
time of building permit issuance must be met.
3. The parcels on the parcel map must meet the zoning
requirements in effect at time of approval of the
parcel map by the authorized agency.
4. All standards and conditions set forth in the
Municipal Code of the City of Encinitas are made a
part of this approval unless specifically waived.
5. The subdivider shall comply with section 66436 of the
Government Code by furnishing to the Department of
Public Works a certification from each public utility
and each public entity owning easements within the
proposed subdivision stating that: (a) they have
received from the developer a copy of the proposed
Parcel Map; (b) they object or do not object to the
filing of the Map without their signature.

requirements in full before the Department of Public
Works may file a Parcel Map with the County Recorder.
9. This subdivision is hereby approved pursuant to the
provisions of the state Subdivision Map Act, the
Municipal Code, the City Public and Private Road
Standards and all other required ordinances of the
City of Encinitas except for a waiver or modification
of the Municipal Code to allow a pan handle to serve
Parcel 4 when conditions of unusual terrain do not
exist because this design will allow for access to
the parcel via an access other than Rancho Santa Fe
Road, a light collector road on the circulation
element of the General Plan (24.12.030[F). This
waiver is granted with the stipulation that the pan
handle not serve as access to other parcels
other than Parcel 4 of 87-008 TPM.
