RESOLUTION OF THE BOARD OF DIRECTORS
CARDIFF SANITATION DISTRICT
ANNEXING TERRITORY TO WHICH OWNERS HAVE CONSENTED
ROBERTA HADDEN ANNEXATION NO. 8720.0
WHEREAS, pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985 (Govt. Code, section 56000 et seq.)
preliminary proceedings were commenced by resolution of
application by this Board on April 15, 1987, as Resolution No.
87-19, for annexation to the Cardiff Sanitation District
(thereinafter referred to as the District) of certain territory
therein described, which description has been modified pursuant
to the directions of the Local Agency Formation Commission; and
WHEREAS, the annexation proposed by said resolution of
application was presented to and approved by the Local Agency
Formation Commission of San Diego County on September 14, 198?,
and this District was designated as the conducting district and
authorized by resolution to order said annexation without notice
or hearing and without an election pursuant to Government Code,
section 56837;
NOW THEREFORE, BE IT RESOLVED, ORDERED AND DETERM~NED,
pursuant to Government Code section 57025 et seq.:
a. The manner in which and by whom preliminary proceedings
were commenced was by resolution of application by this
Board as stated above.
b. The territory to be annexed has been designated 8722 by
the Local Agency Formation Commission, and the exterior
boundaries of such territory are as hereinafter
described.
c. The territory proposed to be annexed is uninhabited and
will be benefited by such annexation as described in
Health and Safety Code section 4830.

d. The reasons for the proposed annexation as set forth in
the resolution of application referred to above are:
1. The District is empowered to and is engaged in
furnishing sewage disposal facilities.
2. The terr i tory proposed to be annexed to said
District is proposed to be developed and used for
residential and/or commercial purposes and
provision for sewage disposal facilities for said
territory is essential for such purposes.
e. The terms and conditions of the proposed annexation
are: None.
f. All the owners of land within such territory have given
their written consent to such annexation, as provided
in Government Code, Section 56837; and therefore, as
approved and authorized by the Local Agency Formation
Commission, this Board may adopt its resolution
ordering the annexation without notice and hearing and
without election, as provided in Government Code,
section 57002.
g. The regular County assessment role will be utilized and
the affected territory will be taxed for existing
bonded indebtedness.
h. Pursuant to state CEQA Guidelines section 15303
(California Environmental Quality Act of 1970), the
Board finds that this annexation is not subject to the
environmental impact evaluation because it is
categorically exempt as a project initiated for the
purpose of making sewer serV1ce available to new
construction or conversion of small structures.
IT IS FURTHER RESOLVED AND ORDERED that pursuant to
Government Code section 57002, the following described territory
in the City of Encinitas, State of California, be and it hereby
is annexed to and made a part of the Cardiff Sanitation District.
IT IS FURTHER ORDERED that the Clerk of this Board
immediately transmit a certifieå copy of this resolution along
with a remittance to cover fees required by the Government Code
Section 54902.5 to the Executive Officer of the Local Agency
Formation Commission of San Diego County, so that the Executive
Officer may make the filings required by Chapter 8 (commencing

Annexation is required in order to provide sewer service for a single

I)-Adopt the resolution of the Board of Directors of the Cardiff
Sanitation District annexing territory to the District.
Discussion:

This proposed annexation is in conformance with your Bo~rd's policy
on annexations, as a single family dwelling on a legal lot (condition 4).
On April 15, 1987, your Board adopted a Resolution of Application for
'annexation of territory to the Sanitation District. On September 14, 1987,
the Local Agency Formation Commission adopted a resolution approving
this annexation and authorizing your Board to initiate proceedings

Pursuant to published ~. public hearing on the ordinance was

opened. Dan Peterka spoke in favor of a connection fee of $2,652,
the lower of two possible connectio~ fees which had been presented
for Council decision. He also asked that people who had sub::titted
their applications for annexation in January, even if the
annexation process was not completed by July 8, be exempted from
paying the new, higher connection fee. He sz~ id that, through no
fault of the applicants, it was impossible to complete the
annexation process in that length of time. Mr. Peterka was asked
to direct to staff his questions about whether such cases were or
could be considered exempt. No one else wished to be heard and the
hearing was closed.
city Attorney Krauel recommended introducing the ordinance at this
meeting and that additional study be given to the Council's concern
about the single unit on a very large parcel. Then if an equitable
and feasible method for handling the situation could be formulated
the Council could amend the fee ordinance at a later date.
Ordinance 87-06 was read by title.
Omsted moved, Steel seconded, carried unanimously to waive further
reading.
Omsted moved, Steel seconded to introduce Ord. 87-06. Motion
carried with Luke, omsted, Shea and Steel voting aye, Gaines voting
no.
Another public hearing was set for lI.ay 6, 1987 when the ordinance
will be considered for adoption.

Interim City Engineer Hoffland gave the Staff report recommending
annexation of the territory consisting of 1. 64 acres to provide
sewer service for two single family dwellings.

Interim city Engineer Hoffland gave the Staff report. He stated
the proposed agreement with En'tech Engineers, Inc. was for plans,
specifications and cost estimates for platform modifications,
electrical controls, wiring, pumps. plumbing and site work for the
installation of a centrifuge previously approved and purchased.
The proposed agreement with Harris and Associates was for
preparation of Environmental Impact Reports. He recommended
( 1) Authorization to execute the Entech agreement; ( 2 )
Authorization to execute the Harris and Associates agreement;and
(3) For the Director of the Department of Public Works to act as
the County OfficE-.r responsible for the adrr.inistration of the two
contracts.

recommendation Nos. 1 and 3; and that number 2 be modified to
direct that the agreement be prepared and ready for signature
following the next regular Board meeting and that someone from the
Harris & Associates firm be present at that meeting to discuss the
proposed agreement with the Board
E. Authorization to Execute Contract with Xinos Enterprises, Inc.
for Desiqn of Emerqencv Wet Well for Cardiff Pump Station, not to
exceed $7,400.
Interim city Engineer Hoffland gave the Staff report stating that
there already existed an agreement with Xinos Enterprises, Inc. to
do the parking lot design Yo' i th Cardiff Sanitation District
participating with the County Department of Parks and Recreation at
the nature center in front of the Cardiff Pump station. The Board
had directed at an earlier meeting that, instead of a 200,000
gallon s1:.orage area in the parking lot, a permanent type facility
be designed. This contract would be an amendment to that agreement
for design of an underground tank which would give a total of six
hours of storage time before any spill into the lagoon and four
hours protection before a spill into the parking lot. He
recommended approval of authorization to e):ecute the amendment and
for the Director of the Department of Public Works to act as the
County Officer responsible for administration of this first

A legal description (Exhibit A), a reproducible map and ten (10) prints
of the specific boundaries of the territory proposed to be annexed,
two (2) copies of a general vicinity map and one topographical map
are enclosed herewith.
In addition, the original completed form of questionnaire and application,

OF THE CARDIFF SANITATION DISTRICT
FOR THE ANNEXATION OF TERRITORY
ROBERTA HADDEN ANNEXATION

Ornsted , the following resolution is adopted:
WHEREAS, this Board of Directors has received a request from
Roberta Hadden (Document No. ) that the hereinafter
described territory to be annexed to the Cardiff Sanitation
District (hereinafter referred to as the Sanitation District);
and
WHEREAS, this Board of Directors desires to initiate
proceedings to annex said territory to the Sanitation District;
BE IT RESOLVED AND ORDERED as follows:
1. Pursuant to Government Code sections 56800 and 56700,
application is hereby made to the Local Agency Formation Commission
of the County of San Diego for a proposed change of organization as
follows:
A. This proposal is made pursuant to the Cortese-Knox
Local Government Reorganization Act of 1985 (56000, et. seq., Govt.
Code).
B. The nature of the proposed change of organization
and the names of all districts for which any such change of
organization is proposed as follows:

c. The names of all other affected counties, cities and
districts are: None.
D. A description of the exterior boundaries of the
territory proposed to be annexed to the Sanitation District is
described in Exhibit "A" hereto attached.
E. Said territory is uninhabited and comprlses
approximately 0.50 acres.
F. It is proposed that said territory to be annexed
subject to the following conditions: None.
G. All the owners of land within such territory have
given their written consent to such annexation subject to the
aforementioned terms and conditions.
H. The reasons for this proposal are as follows:
(1) The Sanitation District is empowered to and
engaged in furnishing sewerage disposal facilities.
(2) The territory proposed to be annexed to said
District is proposed to be developed and used for residential
and/or commercial purposes and provision for sewage disposal
facilities for said territory is essential for such purposes.
1. It is hereby requested that proceedings be taken for
the annexation of territory as hereinabove proposed.

J. This annexation is consistent with the sphere of
influence of the Sanitation District, which is the only affected
city or district.
2. The Board finds, pursuant to Article 19,
Section 15303 of the State EIR Guidelines, that this annexation lS
not subject to the environmental impact evaluation process because
it is categorically exempt as a project initiated for the purpose
of making sewer service available for new construction or
conversion of small structures.
3. The Clerk of the Board of Directors is hereby
authorized and directed to file a certified copy of this resolution
with the Executive Officer of the Local Agency Formation Commission
of the County of San Diego.

RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION
OF THE COUNTY OF SAN DIEGO
MAKING DETERMINATIONS AND APPROVING THE
"HADDEN ANNEXATION" TO THE CARDIFF SANITATION DISTRICT
On motion of Commissioner Hersom, seconded by Commissioner Mahr, the
following resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the Cardiff Sanitation District, which resolution was
adopted by the Board of Directors of said District as Resolution No, 87-19, dated
April 15, 1987, pursuant to Title 5, Division 3, commencing with Section 56000 of the
Government Code; and
WHEREAS, the terri tory proposed for annexation is as described in the
application on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed her report on
said annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission certifies that the determination by the County of San
Diego that this annexation is exempted by State CEQA Guidelines Section l53l9(a)
from the requirements of CEQA has been reviewed and considered,
(2) The Commission hereby approves the annexation with modified boundaries,
as descri bed in Exhi bi t A a ttached hereto,
(3) The boundaries of the territory as described in Exhibit A are definite
and certain,
(4) The boundaries of the territory do conform to lines of assessment and
ownership,
(5) The district is a registered-voter district,
(6) The territory includes 0,5 acre and is uninhabited,
(7) The territory proposed to be annexed is hereby designated the "Hadden
Annexation" to the Cardiff Sanitation District.
(8) The Commission hereby designates the Cardiff Sanitation District as the
conducting authority and authorizes the Board of Directors to initiate proceedings in
compliance with this resolution without notice and hearing,
(9) The Executive Officer is hereby authorized and directed to mail certified \
copies of this resolution as provided in Section 56853 of the Government Code,
