A RESOLUTION OF LEUCADIA COMMUNITY ADVISORY BOARD
APPROVING A TENTATIVE PARCEL MAP EXTENSION
(92-093-TPM/EXT; FOR CASE NO. 89-257 TPM)
FOR PROPERTY LOCATED AT 931 HERMES AVENUE
WHEREAS, Douglas Harwood submitted a Tentative Parcel Map
Extension application as required by the City of Encinitas
Municipal Code section 24.50.130.B & C for the purpose of extending
the expiration date of previously approved Case Number 89-257 TPM
f or one year; for property located at 931 Hermes Avenue legally
described as;
Lot 3, Block 4 of SOUTH COAST PARK, in the City of
Encinitas, County of San Diego, State of California,
according to Map thereof No. 1776, filed in the Office of
. the County Recorder of San Diego County, January 11,1924
a public hearing was conducted by the Leucadia
WHEREAS,
community Advisory Board on July 9, 1992 as required by law, and
all persons desiring to be heard were heard;
WHEREAS, the Community Advisory Board considered:
1. The staff report dated June 26, 1992;
2. The application, the tentative parcel map dated November
6, 1989 (consisting of one sheet), and dated received by
the City of Encinitas on May 22, 1992;
3. Oral evidence submitted at the hearing; and
4. Written evidence submitted at the hearing;
WHEREAS, the Leucadia Community Advisory Board of the city of
Encinitas, made the following findings pursuant to section
24.01.080 of the City of Encinitas Subdivision Ordinance:

a. That the proposed map is consistent with applicable
. general and specific plans as specified in section 65451
of the Subdivision Map Act.
Evidence: The subject property is designated as Residential
5.01 - 8.0 dwelling units per acre on the Land Use Policy Map
of the General Plan. The Tentative Parcel Map proposes to
create two lots which exceed minimum lot sizes. The Parcel
Map conforms to General Plan and Zoning Code requirements.
There is no specific plan for the subject parcel.
b. That the design or improvement of the proposed
subdivision is consistent with applicable General and
Specific Plans.
Evidence: The design of the two lots proposed is such that
they can accommodate single family residential development,
outside of setbacks, specified by the City's General Plan.
c. That the site is physically suitable for the type of
development.
Evidence: No reason has been identified why the site cannot
physically facilitate single family residential development.
Future development proposals would be subject to Uniform
Building and Fire Codes as well as appropriate grading
. approvals subject to City Ordinance.
d. That the site is physically suitable for the proposed
density of development.
Evidence: The density of development will support single
family residential use in conformance with General Plan
standards.
e. That the design of the subdivision or the proposed
improvements are not likely to cause substantial
environmental damage or substantially and avoidably
injure fish or wildlife or their habitat.
Evidence: Having identified no aspects in which this proposal
could have any significant adverse impacts on the environment,
staff has found the project to be exempt from environmental
review under Section 15315 and section 15061 (b) (3) of the
State CEQA.
f. That the design of the subdivision or type of
improvements is not likely to cause serious public health
problems.

Evidence: Public utilities, including water and sewer, are
. available to the site and no serious public health problems
are anticipated to occur due to the subdivision requested.
NOW THEREFORE, BE IT RESOLVED that Tentative Parcel Map
Extension 92-093 TPM/EXT is hereby APPROVED which grants a one year
extension to 89-257 TPM, and a new expiration date of May 24, 1993.
PASSED AND ADOPTED this 9th day of July 1992 by the following
vote, to wit:
Ayes: Boardmembers Allen, Cameron, Eldon, Buck and Fahlberg
