1991-04 RESOLUTION NO. L-91-04 A RESOLUTION OF LEUCADIA COMMUNITY ADVISORY BOARD APPROVING A TENTATIVE PARCEL MAP EXTENSION (90-249-TPM/EXT¡ FOR TENTATIVE PARCEL MAP 88-267-TPM) FOR PROPERTY LOCATED AT 773 PLATO PLACE WHEREAS, Christopher Charrette, submitted a Tentative Parcel Map Extension application as required by the City of Encinitas Subdivision Ordinance for the purpose of extending the expiration date of TPM 88-267 for one year; for property located at 773 Plato Place, legally described as; See Attachment "A" WHEREAS, public hearings were conducted by the Leucadia Community Advisory Board on January 10, and March 7, 1991, as required by law, and all persons desiring to be heard were heard; and WHEREAS, the Community Advisory Board considered: 1. The staff reports dated January 3, 1991 and February 25, 1991; 2. The application and map submitted by the applicant; 3. Oral evidence submitted at the hearing; and 4. written evidence submitted at the hearing; WHEREAS, the Leucadia community Advisory Board of the City of Encinitas, made the following findings pursuant to section 24.01.080 of the City of Encinitas Subdivision Ordinance: a. That the proposed map is consistent with applicable general and specific plans as specified in section 65451 of the Subdivision Map Act. b. That the design or improvement of the proposed subdivision is consistent with applicable general and DL/04/CRO8-723WP5 (3/11/91-2) specific plans since the project, with a density of 1.74 dwelling units per acre, is in conformance with the General Plan designation for the site of Rural Residential which allows a maximum of 2 dwelling units per acre. c. That the site is physically suitable for that type of development, in that the four parcels are proposed to be developed in single family dwelling units which is consistent with the RR-2 zoning designation and development standards for the site. d. That the site is physically suitable for the proposed density of development, since the topography and design of the lots can be adequately accommodated as proposed. e. That the design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat; having identified no aspects in which this proposal could have significant adverse impacts on the environment the Leucadia community Advisory Board determined on October 27, 1988 this proposal to be exempt from CEQA pursuant to section 15315 as the proposal is for a minor subdivision of land. f. That the design of the subdivision or type of improvements is not likely to cause serious public health problems, since documentation has been obtained stating that sewer and water service shall be available for the site. g. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision; since no easements of record are contained in the title report for the subject property with which this development would conflict. NOW THEREFORE, BE IT RESOLVED that Tentative Parcel Map Extension 90-249 TPM/EXT, is hereby approved which grants a one year extension to TPM 88-267, and a new expiration date of October 27, 1991. PARCEL 2: An easement for ingress and egress over and across the Southerly 40 feet of the following described property. Lot 34 of CREST ACRES, in the County of San Diego, State of California, according to Map thereof No. 2019, filed in the office of the County Recorder of San Diego County, May 3, 1927. PARCEL 3: Parcel 1 of Parcel Map 2928, filed in the office of the County Recorder of San Diego County, August 8, 1974, being a portion of Lot 34 of Crest Acres, according to Map thereof No. 2019, filed in the office of the County Recorder of San Diego County, May 3, 1927.
