RESOLUTION NO. L-91-23
A RESOLUTION OF LEUCADIA COMMUNITY ADVISORY BOARD
APPROVING A TENTATIVE PARCEL MAP AND DESIGN REVIEW EXTENSION
(91-179-TPM/DR/EXT; FOR CASE NO. 89-194 TPM/DR)
FOR PROPERTY LOCATED 137 JUPITER STREET
WHEREAS, Architura, on behalf of Marcus DeWood, submitted a
Tentative Parcel Map and Design Review Extension application as
required by the City of Encinitas Municipal Code Sections
24.50.130.B & C and 23.08.160 for the purpose of extending the
expiration date of previously approved Case Number 89-194 TPM/DR
for one year; for property located at 137 Jupiter Street, legally
described as;

WHEREAS, a public hearing was conducted by the Leucadia
Community Advisory Board on November 21, 1991 as required by law,
and all persons desiring to be heard were heard;
WHEREAS, the Community Advisory Board considered:
1. The staff report dated November 15, 1991;
2. The application, the tentative parcel map dated August
20, 1989 (two sheets), building perspective dated August
21, 1989 (one sheet), floor plan dated August 11, 1989
(one sheet), and building elevations dated July, 1990
(one sheet) all dated received on October 17, 1991;
3. Oral evidence submitted at the hearing; and
4. Written evidence submitted at the hearing;
WHEREAS, the Leucadia Community Advisory Board of the City of
Encinitas, made the following findings pursuant to Section
24.01.080 of the City of Encinitas Subdivision Ordinance:

a. That the proposed map is consistent with applicable
general and specific plans as specified in Section 65451
of the Subdivision Map Act.
Evidence: The subject property is designated as Residential
8.01 - 11.0 dwelling units per acre in the General Plan. This
designation would permit a minimum net lot area of 3,950
square feet well below the proposed lot area of 4,300 square
feet per unit. The proposed subdivision is therefore,
consistent with the Plan.
b. That the design or improvement of the proposed
subdivision is consistent with applicable General and
Specific Plans.
Evidence: The single lot with condominium air rights for four
units, is designed to accommodate the four proposed
combination of two attached ant two detached residential units
as specified in the General Plan.
c. That the site is physically suitable for the type of
development.
Evidence: Staff has identified no reasons why the site cannot
physically accommodate the residential development as
proposed. The development would be subject to Uniform
Building and Fire Codes.
d. That the site is physically suitable for the proposed
density of development.
Evidence: The relatively level lot with street access is
physically suitable for the proposed density of development.
All the findings needed to exceed the mid-range density were
made in the original approval of the project and are in
included in Resolution No. L-90-07 which is on file in the
Planning and Community Development Department.
e. That the design of the subdivision or the proposed
improvements are not likely to cause substantial
environmental damage or substantially and avoidably
injure fish or wildlife or their habitat.
Evidence: Having identified no aspects in which this proposal
could have any significant adverse impacts on the environment,
staff has found the project to be exempt under Section 15315
and Section 15061(b) (3) of the State CEQA.
f. That the design of the subdivision or type of
improvements is not likely to cause serious public health
problems.

Evidence: Sewer and water service is available on Jupiter
Street and the plan indicates internal utility connections.
The development, therefore, is not likely to cause any serious
public health problems.
NOW THEREFORE, BE IT RESOLVED that Tentative Parcel Map and
Design Review Extension 91-179 TPM/DR/EXT is hereby APPROVED which
grants a one year extension to 89-194 DR/TPM, and a new expiration
date of March 8, 1993.
PASSED AND ADOPTED this 21st day of November 1991 by the
following vote, to wit:
