A RESOLUTION OF THE LEUCADIA
COMMUNITY ADVISORY BOARD APPROVING A VARIANCE TO ALLOW
AN ADDITION TO AN EXISTING SINGLE FAMILY RESIDENCE TO ENCROACH
A MAXIMUM OF 19' INTO THE REQUIRED 25' FRONT YARD SETBACK
FOR A TOTAL SETBACK FOR 6'
AND TO ENCROACH A MAXIMUM OF l' INTO THE REQUIRED 5'
SIDE YARD SETBACK FOR A TOTAL SETBACK OF 4'
IN THE R-8 ZONE FOR PROPERTY LOCATED AT
277 1/2 HILLCREST DRIVE
(CASE NUMBER 93-040 V)
WHEREAS, a request for consideration of a Variance was filed
by Mr. Mark Bibler and Ms. Heather Carpenter to permit a maximum
19' encroachment into the required 25' front yard setback for a
total setback of 6' and a maximum of l' into the required 5' side
yard setback for a total setback of 4' in the R-8 zone to allow the
construction of a building addition pursuant to Chapters 30.16 and
30.78 of the City of Encinitas Municipal Code, for the property
located at 277 1/2 Hillcrest Drive, legally2 described as:
That portion of Lot 12 in Block 22, together with portions of
Monterey Street and Hygeia Avenue as said street and Avenue
were vacated and closed to public use on November 19, 1915,
and January 28,1925, by orders of the Board of Supervisors of
. the County of San Diego.
WHEREAS, a public hearing was conducted on the application on
April 8, 1993, and all persons desiring to be heard were heard; and
WHEREAS, the Community Advisory Board considered:
1. The Leucadia CAB staff report dated March 25, 1993;
2. The application and Statement of Justification;
3. site plan, floor plan, and elevations consisting of 5 pages
dated Received by the City of Encinitas on March 17, 1993;
4. Oral testimony from staff, applicant, and public made a
part of the record at said public hearing;
5. Additional written documentation.
WHEREAS, the Leucadia Community Advisory Board made the
following findings pursuant to Chapter 30.78 of the Encinitas
Municipal Code:

NOW, THEREFORE, BE IT RESOLVED by the Leucadia Community
. Advisory Board of the City of Encinitas that application 93-040 V
is hereby approved subject to the following conditions:

BE IT FURTHER RESOLVED by the Leucadia Community Advisory
Board of the City of Encinitas that:
This project was found to be exempt from environmental review under
Section 15301 (e) (1) and Section 15305, Class 5 (a) of the State
CEQA Guidelines.
PASSED AND ADOPTED this 8th day of April, 1993, by the
following vote, to wit:
