1993-13 RESOLUTION NO. L-93-13 8 A RESOLUTION OF THE LEUCADIA COMMUNITY ADVISORY BOARD OF THE CITY OF ENCINITAS APPROVING A DESIGN REVIEW PERMIT FOR EXTERIOR SITE MODIFICATIONS FOR AN EXISTING MOTEL FOR PROPERTY LOCATED AT 607 LEUCADIA BLVD (CASE NO. 93-125 DR) WHEREAS, a Design Review application was filed by Holiday Inn Express pursuant to Chapter 23.08 of the City of Encinitas Municipal Code to allow a new canopy structure and a "signature" tower for property located at 607 Leucadia Blvd., and legally described as; Those portions of Lots 1, 2, l2 and 13 in Block 1 of AVOCADO ACRES, in the County of San Diego, State of California, according to Map thereof No. l791, filed in the Office of the County Recorder of San Diego County, 8 April 29, 1924, described more fully in Attachment "C" to this document. WHEREAS, a public hearing was conducted by the Leucadia Community Advisory Board on August 5, 1993 as required by law, and all persons desiring to be heard were heard; WHEREAS, evidence was submitted and considered to include without limitation: a. Project plans dated received July 8, 1993; b. Written information submitted with the application; c. Oral testimony from staff, applicant, and public made a part of the record at said public hearing; d. Staff report dated August 5, 1993, which is on file in the Department of Community Development; e. Additional written documentation. 8 JK/93125DR.RES (7/27/93) 1 8 WHEREAS, the Leucadia Community Advisory Board made the required findings relative to Chapter 23.08 of the Municipal Code; (SEE ATTACHMENT "A") NOW THEREFORE, BE IT RESOLVED by the Leucadia Community Advisory Board of the City of Encinitas that Design Review Application No. 93-125 DR is hereby approved subject to the following conditions: (SEE ATTACHMENT liB") BE IT FURTHER RESOLVED by the Leucadia Community Advisory Board of the City of Encinitas that the project was found to be exempt from environmental review under Section 15301(e) of the State CEQA Guidelines. L-93-13 Findings for Design Review (Chapter 23.08 of the Municipal Code) Case No. 92-125 DR Applicant: Holiday Inn Express A. The project design is not inconsistent with the General Plan, a Specific Plan or the provisions of this Code. Facts: The project meets all development standards contained in Section 30.20. (Commercial Zones) and Chapter 23.08 (Design Review) of the Municipal Code. Conclusion: The proposed archtictural additions to the existing motel site are consistent with the Municipal Code and the General Plan. There is no Specific Plan approved in area of the project site B. The project design is substantially consistent with the City's Design Review Guidelines. Facts: Chapter 23.08 of the Municipal Code contains Design Review Guidelines with which the authorized agency must find the project substantially consistent in order to grant 8 approval. The appl icant proposes to add a canopy structure in the area of the main lobby entrance to the motel. Additionally proposed is a "signature" tower attached to the north-west corner of the building. The colors and construction materials for these structures are intended to match the existing building with a light colored stucco treatment. Discussion: 1. site design: With regard to Design Guidelines 1.1 - 1. ll, the Board finds that the proposed project adequately addresses these required elements. Specifically, regarding Guideline 1. 4, the Board finds that the project adequately provides for views lito the site" in that the project proposes the addition of architectural features to enhance the project site in general. The Board finds that the project adequately provides for views "from the site" since the project will continue to maintain existing views from the site. And the Board finds that the project adequately provides for views "through the site" since the project proposes the addition of a canopy cover and a "signature" tower which would have minimal impact on any existing views through the site. 2. Building design: With regard to Guidelines 2.1 - 2.12, the Board finds that the subject elements are adequately addressed with the proposed addition. Specifically, regarding Guidelines 2.3 - 2.6, the Board finds that the proposed building 8 JK/93125DR.RES (7/27/93) 3 8 additions would create a design in which the architectural modifications are consistent and harmonious, and that the construction materials and colors are consistent with the existing structure on-site. The proposed additions are proposed to match the existing building in color and finish materials. 3. Landscape Desiqn: The applicant proposes to maintain and enhance existing landscape areas. Conclusion: The Board finds that the project is in substantial conformance with the Design Review Guidelines of Chapter 23.08 of the Municipal Code because of the consistency with Design Review Guidelines. C. The project would not adversely effect the health, safety, or general welfare of the community. Facts: The project has been found exempt from environmental review pursuant to Section 15301 (e) of the California Environmental Quality Act (CEQA) and no potential negative affects on the health, safety, or general wel fare of the community have been identified in conjunction with this project. Conclusion: The Board finds that the project would not 8 adversely affect the health, safety, or general welfare of the community. D. The project would not cause the surrounding neighborhood to depreciate materially in appearance or value. Facts: The surrounding neighborhood consists of residential uses, and generally may be considered to be in good condition. Discussion: The proposed project is to add structural architectural additions to the exterior of an existing motel. The project is to create a more visually interesting site with the addition of creative and architecturally pleasing design elements. Conclusion: The proposed project would constitute an enhancement to the neighboring area. 8 JK/93125DR.RES (7/27/93) 4 ~ ATTACHMENT liB" RESOLUTION NO. L-93-13 Conditions of Approval Case No. 92-125 DR Applicant: Holiday Inn Express 1. GENERAL CONDITIONS A. This approval will expire on August 5, 1995, two years from the date of approval, unless a building permit has first been obtained, or an extension has been approved by the Authorized Agency. B. This approval may be appealed to the authorized agent within 15 days from the date of this approval. C. The project is approved as submitted/modified as evidenced by the project plans dated received July 8, 1993, and consisting of four sheets, and per revised site plan sheet dated received July 29, 1993. D. Nothing in this permit shall relieve the applicant from complying with the conditions and regulations generally imposed upon activities similar in nature to the activity authorized by this permit. 8 E. Approval of this request shall not waive compliance with any sections of the Zoning Code and all other applicable City Ordinances in effect at the time of Building Permit issuance unless specified herein. F. The applicant shall comply with the latest adopted Uniform Building Code, Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code, Uniform Fire Code, and all other applicable codes and ordinances in effect at the time of building permit submittal. G. Permits or findings of exemption shall be obtained from the state Coastal Commission and any other applicable Government agencies. APPLICANT SHALL CONTACT THE DEPARTMENT OF COMMUNITY DEVELOPMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: 2. SITE DEVELOPMENT A. Prior to issuance of building permits all conditions of approval contained herein shall be completed to the satisfaction of the Director of Community Development. 8 JK/93125DR.RES (7/27/93) 5 . B. All cost recovery fees associated with the processing of this application shall be paid in full prior to issuance of the building permit. C. Minor modifications to this Design Review Permit, if deemed to be in substantial conformance with the original approval, may be approved, in writing, by the Director of Community Development. The Director may refer any modification request to the CAB for their review/approval in accordance with the Municipal Code. APPLICANT SHALL CONTACT THE FIRE PROTECTION DEPARTMENT REGARDING COMPLIANCE WITH THE FOLLOWING CONDITIONS: - Prior to the issuance of building permits, the applicant shall submit a letter from the Fire District stating that all development impact, plan check and/or cost recovery fees have been paid or secured to the satisfaction of the District. . 8 JK/93125DR.RES (7/27/93) 6
