ENCINITAS SANITARY DISTRICT
The following filings to be made after the conducting authority has ordered the change(s)
of organization [boundary change(s)] must be processed by the LAFCO office:
1. County Recorder 3. County Assessor 5. County Surveyor
2. County Auditor 4. State Board of Equalization
Any other filings remain the responsibility of the conducting authority. Proceedings must
be initiated within 35 days after adoption of the Commission's resolution, and completed
within one year after LAFCO approval, or the proposal must be considered abandoned
(Government Code Sections 57001 and 57002).
If your Board/Council adopts a resolution/ordinance ordering the boundary change(s),
the following materials must be forwarded to the LAFCO office:
1. Six (6) certified copies of the resolution/ordinance, including the approved legal
description and map. with original signatures on each certification page.
2. Certificate Re: Terms and Conditions and Indebtedness (use attached form).
Please return signed, original copy.
3. State Board of Equalization fee in the amount of $ 200 (make checks payable to
"State Board of Equalization").
The Executive Officer will check all documents for compliance before filings are made.
Amendments to the LAFCO resolution, including boundary modifications, can only be
made by the Commission. All documents recorded and copies of letters of
acknowledgment will be returned to the conducting authority.

MAKING DETERMINATIONS AND APPROVING THE
IIBECK PROPERTIES ANNEXATIONII TO THE
ENCINITAS SANITARY DISTRICT
On motion of Commissioner Keller Childs, seconded by Commissioner Fromm, the
following resolution is adopted:
WHEREAS, a resolution of application was submitted to this Commission for
annexation of territory to the Encinitas Sanitary District, which resolution was adopted by
the Board of Directors of said District as Resolution No. 93-04, dated March 23, 1993,
pursuant to Title 5, Division 3, commencing with Section 56000 of the Government Code;
and
WHEREAS, the territory proposed for annexation is as described in the application
on file with the Local Agency Formation Commission; and
WHEREAS, the Executive Officer of the Commission has filed his report on said
annexation, which report was received and considered by the Commission; and
WHEREAS, all owners of land have consented in writing to the annexation;
NOW THEREFORE, BE IT RESOLVED, that this Commission hereby finds,
determines, and orders as follows:
(1) The Commission certifies that it has reviewed and considered the
information contained in the Negative Declaration prepared by the Encinitas Sanitary
District.
(2) The Commission hereby approves the annexation with modified boundaries,
as described in Exhibit A attached hereto, subject to the following condition:
Payment by the property owner of district annexation fees and State Board
of Equalization charges.
(3) The boundaries of the territory as described in Exhibit A are definite and
certain,
(4) The boundaries of the territory do conform to lines of assessment and
ownership.

(5) The district is a registered-voter district.
(6) The territory includes 12.64 acres and is uninhabited.
(7) The territory proposed for annexation is hereby designated the "Beck
Properties Annexation" to the Encinitas Sanitary District.
(8) The Commission hereby designates the Encinitas Sanitary District as the
conducting authority and authorizes the Board of Directors to conduct proceedings in
compliance with this resolution without notice and hearing.
(9) The Executive Officer is hereby authorized and directed to mail certified
copies of this resolution as provided in Section 56853 of the Government Code.

ADOPTED MITIGATION MEASURES FOR 91-212 TM/EIA
(1) All recommendations and specifications
contained in the Preliminary Soil and
Geotechni Gal Investigation report (MV
Engineering, Inc., 1991) shall be shown on the
face of final grading plans prior to their
approval, and implemented during site grading.
(2) site grading activities shall comply with APCD
Rules 51, 52, and 54 of the Air Quality
Chapter, as well as any additional dust
control measures required through future
discretionary review and approval of final
construction plans.
(3) Subject to future design review approval, a
conceptual landscape plan shall be prepared
which shows required street tree and erosion
control plantings for all manufactured slopes.
At a minimum, such a plan shall provide
specifications for the planting types, mixes,
sizes, spacing, irrigation, and maintenance
requirements. Landscaping for individual
homesites may be at the discretion of each
homeowner, pursuant to future design review.
Any proposed or future landscaping on-site
shall be required to conform to the City
Street Tree Ordinance and Landscape Design
Guidelines.
(4) Subject to future design review approval, a
conceptual site plan shall be prepared which
shows the individual lot layouts required to
ensure conformance with lot size, lot
coverage, FAR, building height, setbacks, and
other zoning requirements for R-5 residential
zones, as specified in the city of Encinitas
Municipal code and as modified by the Final
Map or the conditions contained herein.
(5) Prior to final map approval, the project
applicant shall arrange for payment of the
City's standard traffic mitigation fee for
each adjusted ADT. This shall be considered
appropriate contribution for the following
off-site traffic improvements: 1) Widen
Encinitas Boulevard to six lanes, its
Circulation Element classification east of I-
5; and 2) Restripe the intersection at the
Encinitas Boulevard/I-5 northbound ramp to
provide an exclusive right-turn lane and a

(6) At completion of approved roadway improvements
the city of Encinitas shall post a "No Parking
Zone" on the east side of Saxony Road for a
distance of about 200 feet south and 50 feet
north of Seacrest Way, and shall paint a 100-
foot centerline and a limit line on Seacrest
Way.
(7) Prior to final map approval, an infrastructure
improvement plan shall be submitted to the
city of Encinitas Engineering Department for
review and approval. This plan shall show all
temporary utility line connections required to
ensure that existing public service
interruptions do not occur in the project area
. during the period when permanent relocations
of these facilities are under construction.
Prior to final approval of infrastructure
improvement plans, the project applicant shall
submit these plans to the respective utility
companies for reVlew and approval to ensure
non-interference with existing public
facilities. Concurrent with the approval of
infrastructure improvement plans, the County
Sheriff's Department (Encinitas Substation)
and Encinitas Fire Department shall be
provided full disclosure of all the variables
potentially affecting emergency response mode
and time to the project area during
construction.
(8) All construction and grading activities shall
comply with the City Noise Ordinance which
limits such activities to between the hours of
7:00 a.m. and 7:00 p.m., Monday through
Saturday.
(9) The approved tentative map shall be
conditioned to require all street lighting to
be shielded and focused downward away from the
adjacent Quail Botanical Gardens to the east.
In addition, all exterior lighting structures
shall consist of low-pressure sodium vapor
lamps with 90° cutoff luminaries, or
equivalent source, to shield light from all
other adjoining properties.
(10) For purposes of this analysis, the threshold
for determining a significant visual impact is
assumed to be the maximum height of the
"building envelope" for proposed Lots #18-27.
The maximum "building envelope" shall be
measured at approximately four feet above the

of the adjoining ýrade of the Quail
Gardens property adjacent to the eastern
subj ect property boundary. This represents
the typical eye level by which a person
standing anywhere along the Quail Gardens
parking lot would have "ocean views" looking
westerly. For example, the maximum "building
envelope" for proposed Lot #22, as viewed from
the northwest corner of the adjacent Quail
Gardens parking lot, is at an elevation of
approximately 264 feet AMSL. Therefore, the
roof ridgelines of future homes constructed on
proposed Lots #18-27 shall not be allowed to
project above the maximum "building envelope",
where significant view opportunities occur for
visitors to the Quail Botanical Gardens,
without specific authority through design
review. Specifically, to ensure that future
homes on Lots #18-27 will not significantly
obstruct the views from the Quail Gardens
viewshed, a condition shall be placed on the
approved tentative map requiring a "line-of-
sight" analysis, "story poles", and any other
reasonable means deemed necessary by the
community Development Department, or other
authorized agency, during future design review
and approval of Lots #18-27.
As directed by the city Council at their
meeting of December 16, 1992, design review
for the future homes shall focus on preserving
and enhancing views from the location depicted
on the panoramic photograph "5A" submitted by
the applicant as part of their view study.
Future homes on Lots 19, 21, 22, 23, and 24
